If tourists are unable to travel due to illness, they can request the travel agency to refund the group fee.
According to the provisions of Article 12 of the Supreme People's Court's "Provisions on Several Issues Concerning the Application of Law in the Trial of Travel Dispute Cases", before the start of the travel trip or during the trip, due to the tourist's unilateral termination of the contract, the tourist requests to travel If an operator refunds expenses that have not actually been incurred, or if a tourism operator requests tourists to pay reasonable expenses, the people's court shall support it.
If the tourist terminates the contract before the end of the tour, the travel agency will return the balance after deducting necessary expenses.
Article 65 of the "Tourism Law" stipulates that if the tourist terminates the contract before the end of the travel itinerary, the tour operator shall return the remaining balance to the tourist after deducting necessary expenses.
Circumstances under which the travel agency may terminate the contract:
Article 66 stipulates that if the tourist falls into any of the following circumstances, the travel agency may terminate the contract:
( 1) Suffering from infectious diseases and other diseases that may endanger the health and safety of other tourists;
(2) Carrying items that endanger public safety and refusing to hand them over to relevant departments for processing;
(3) Engaging in activities that are illegal or contrary to social morality;
(4) Engaging in activities that seriously affect the rights and interests of other tourists and refusing to listen to dissuasion and being unable to stop them;
(5) Other circumstances stipulated by law.
If the contract is terminated due to the circumstances specified in the preceding paragraph, the tour organizing agency shall return the balance to the tourists after deducting necessary expenses; if losses are caused to the travel agency, the tourists shall bear liability for compensation in accordance with the law.
