Provisions on nationality: In China, people engaged in tour guide work must be citizens with China nationality. 2. Academic qualifications: Applicants should have a senior high school or secondary specialized school education. 3. Physical regulations: Tour guides must have good physical fitness and can adapt to the needs of work. 4. Must have the basic knowledge and language expression ability to meet the needs. Candidates can participate in the pre-test training of tour guide qualification examination organized by tourism administrative departments at all levels. The pre-test training of tour guide qualification examination is not only the basic knowledge training for candidates to meet the needs of tour guide work. Those who meet the above conditions and pass the examination shall be awarded the qualification certificate of tour guides by the tourism administrative department of the State Council or the tourism administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government entrusted by the State Council. Types of tour guide cards Tour guide cards can be divided into formal tour guide cards and temporary tour guide cards (1), namely formal tour guide cards. Refers to the tour guide certificate issued by the tourism administrative department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, and refers to the personnel who have passed the tour guide qualification examination, obtained the tour guide qualification certificate, entered into a labor contract with the travel agency or registered in the tour guide service company. Holders of official tour guide certificates can be full-time tour guides or part-time tour guides. The tour guide card is valid for 3 years and the temporary tour guide card is valid for no more than 3 months; In addition, after the expiration of the tour guide card, you can apply for a new tour guide card, but after the expiration of the temporary tour guide card, it cannot be extended. If it is necessary to continue employment, the travel agency must re-apply to the tourism administration department. 3. Time limit for issuing tourist guide cards and relevant regulations. The issuance of tourist guide cards by tourism administrative departments is a specific administrative act that allows applicants to engage in tourist guide activities. According to the regulations on the management of tour guides, the tourism administrative department must issue the tour guide card within 15 days from the date of receiving the application for the tour guide card. (4) the rights and obligations of tour guides 1. The rights of tour guides (1) Tour guides have the right to personal dignity. The Regulations on the Administration of Tour Guides stipulates: "Tour guides should respect their personal dignity and their personal safety is inviolable. Tour guides have the right to refuse unreasonable demands of tourists that insult personal dignity or violate professional ethics. " (2) The tour guide has the right to adjust or change the reception plan in tourism activities. "Regulations on the Administration of Tour Guides" stipulates: "In the course of sightseeing, tour guides may adjust or change the reception plan with the consent of most tourists in case of emergency that may endanger the personal safety of tourists, but they shall report to the travel agency immediately." (3) Tour guides have the right to apply for reconsideration according to law when they are dissatisfied with the tourism administrative act. According to the provisions of the Administrative Reconsideration Law, combined with the actual situation of tourism management, tour guides can apply for reconsideration when they are dissatisfied with the administrative actions of the tourism administrative department, such as: a. They are dissatisfied with administrative penalties such as fines, revocation of tour guide cards, order to make corrections, and temporary suspension of tour guide cards; B. The tourism administrative department refuses to issue or reply to the application for the qualification certificate and tour guide card issued by the administrative organ that meets the statutory requirements; C. think that the tourism administrative department illegally requires tour guides to fulfill their obligations; D think that the tourism administrative department infringes the personal rights and property rights of tour guides; (five) other specific administrative acts that can bring an administrative lawsuit or apply for reconsideration according to laws and regulations. (4) Tour guides have the right to bring a lawsuit to the people's court if they are dissatisfied with the following specific administrative acts of the tourism administrative department. B, to meet the statutory requirements of the tourism administrative departments to issue qualification certificates, tourist guide card application, the tourism administrative departments shall not issue or not reply, you can bring a lawsuit; C. If the tourism administrative organ requires the tour guide to perform his obligations in violation of the law, it may bring a lawsuit; (four) to bring a lawsuit against the specific administrative acts of the tourism administrative organs that infringe on the personal rights and property rights of tour guides; 2. Duty of tour guides (1) Tour guides should constantly improve their professional quality and skills. (2) The tour guide must be appointed by the travel agency before conducting tour guide activities. Tour guides are not allowed to undertake tour guide business privately or directly conduct tour guide activities in any other way. (3) Tour guides should consciously safeguard national interests and national dignity when conducting tour guide activities, and must not have words and deeds that harm national interests and national dignity. (four) tour guides should abide by professional ethics, dress neatly, be polite to guests, and respect the religious beliefs, national customs and living habits of tourists. When conducting tour guide activities, tour guides should explain to tourists the humanities and natural conditions of the tourist destination and introduce the local customs; However, in order to cater to the low taste of individual tourists, vulgar and obscene content should not be mixed in the explanation and introduction. (5) Tour guides shall arrange tourists' sightseeing activities in strict accordance with the reception plan determined by the travel agency, and shall not arbitrarily increase or decrease tourism projects or suspend tour guide activities. In the process of guiding tourists to travel and visit, tour guides may adjust or change the reception plan with the consent of most tourists, but they shall report to the travel agency immediately. (6) When guiding tourists to travel and visit, tour guides should make a true explanation and clear warning to tourists about the situation that may endanger the personal and property safety of tourists, and take measures to prevent the occurrence of harm according to the requirements of travel agencies. (7) Tour guides shall not sell goods to tourists or buy goods from tourists, and shall not ask tourists for tips in an express or implied way. (8) Tour guides shall not cheat or coerce tourists' consumption or collude with operators to cheat or coerce tourists' consumption when conducting tour guide activities. (nine) tour guides should wear a tour guide card when conducting tour guide activities. 3. Legal liability (1) punishment for engaging in tour guide activities without a tour guide card. Without a tour guide card, the tourism administrative department shall order it to make corrections and impose a fine of 1000 yuan to 30,000 yuan; Illegal income, if any, shall also be confiscated. When conducting tour guide activities, tour guides have words and deeds that harm national interests and national dignity, and the tourism administrative department shall order them to make corrections; If the circumstances are serious, the tourism administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall revoke the tourist guide card and make an announcement; Give a warning to the travel agency where the tour guide is located until it is ordered to suspend business for rectification. (four) punishment for not wearing a tour guide card. If the tour guide does not wear a tour guide card in the tour guide activities, the tourism administrative department shall order it to make corrections; Refuses to correct, a fine of 500 yuan. (five) the punishment of tour guides who violate the tourism laws and regulations shall be ordered by the tourism administrative department to make corrections, and the tour guide card shall be temporarily suspended for 3 to 6 months; If the circumstances are serious, the tourism administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall revoke the tourist guide card and make an announcement: a. Adding or reducing tourist projects without authorization; B. changing the reception plan without authorization; C. stop the tour guide activities without authorization. (six) the punishment of selling goods to tourists or buying goods from tourists and asking for tips. If a tour guide sells goods to tourists or buys goods from tourists, or asks tourists for tips in an express or implied way, the tourism administrative department shall order him to make corrections and impose a fine of 1000 yuan to 30000 yuan; Illegal income, confiscate the illegal income; If the circumstances are serious, the tourism administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall revoke the tourist guide card and make an announcement; Give a warning to the travel agency that appointed the tour guide until it is ordered to suspend business for rectification. (VII) Punishment for Cheating and Coercing Tourists' Consumption If a tour guide cheats or coerces tourists' consumption or colludes with operators to cheat or coerce tourists' consumption in the tour guide activities, the tourism administrative department shall order it to make corrections and impose a fine of 1000 yuan to 30,000 yuan; Illegal income, confiscate the illegal income; If the circumstances are serious, the tourism administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall revoke the tourist guide card and make an announcement; Give a warning to the travel agency that appointed the tour guide until it is ordered to suspend business for rectification; If a crime is constituted, criminal responsibility shall be investigated according to law.
