Chapter I General Provisions Article 1 In order to protect and rationally develop and utilize tourism resources, standardize the order of the tourism market, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Regulations are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. Article 2 Organizations and individuals that develop tourism resources, build tourism facilities, engage in tourism management, participate in tourism activities and implement tourism management within the administrative area of this province shall abide by these regulations. Article 3 The local people's governments at or above the county level shall, according to the local tourism resources, strengthen their leadership over the tourism industry, incorporate tourism into the national economic and social development plan, formulate tourism planning and tourism development policies, coordinate and deal with major problems in the development of tourism, improve the tourism environment, cultivate and standardize the tourism market, and develop the tourism economy. Article 4 The tourism administration departments of local people's governments at or above the county level (hereinafter referred to as tourism administration departments) shall be responsible for the tourism administration within their respective administrative areas and perform the functions of administrative supervision and management according to law.

The relevant administrative departments of the local people's governments at or above the county level shall perform their respective duties according to law, and support and cooperate with the tourism management departments to do a good job in tourism management and service. Article 5 According to the needs and financial situation of local tourism development, local people's governments at or above the county level may set up tourism development funds for tourism planning, public welfare tourism project construction, etc. And supervised by the financial and auditing departments. Article 6 Local people's governments at various levels encourage domestic and foreign enterprises, organizations and individuals to invest in tourism according to law, and develop tourism resources, build tourism facilities and set up tourism enterprises according to the principle that whoever invests will benefit. Seventh tourism industry associations should carry out activities according to law, improve the industry self-discipline system, play the role of service, guidance and supervision, and provide quality services for the development of tourism. Chapter II Development and Protection of Tourism Resources Article 8 The development of tourism resources shall follow the principles of unified planning, rational development, environmental protection and sustainable utilization, and adhere to the combination of natural landscape, human landscape, history and culture with modern science and technology.

No organization or individual may destroy tourism resources; Shall not violate the tourism planning to develop tourism resources. Ninth tourism management departments shall, jointly with the relevant administrative departments, investigate and evaluate the tourism resources within their respective administrative areas, and establish the archives of tourism resources.

The identification of tourism resources should be reported to the people's government at the same level for approval and publication, and signs should be set up. The relevant departments shall formulate and implement protection plans, and define the protection units and responsible persons. Tenth tourism management departments should formulate tourism planning according to the local tourism resources, and solicit the opinions of the tourism management departments at higher levels in accordance with the relevant provisions of the state, and report to the people's government at the same level for approval before implementation. Lower-level planning should be subject to higher-level planning, and local planning should be subject to overall planning.

Before the tourism planning is submitted for examination and approval, the economic, social and environmental feasibility shall be demonstrated, and the tourism management department shall organize expert review to solicit opinions from relevant departments. Eleventh tourism planning should conform to the national land planning, land use planning and urban planning, and coordinate with the planning of scenic spots, nature reserves, forest parks, transportation development, environmental protection, cultural relics protection and cultural and religious activities.

The planning and construction of other large-scale projects with tourism value should be considered as a whole. Twelfth tourism project construction and regional tourism resources development, should be fully investigated and scientifically demonstrated to avoid duplication of construction; Should conform to the local tourism planning and urban and rural construction planning, reasonable layout, distinctive features, architectural style and the surrounding environment.

The development of tourist attractions, the construction of tourist resorts and other large-scale tourism projects, before the project, should seek the opinions of the tourism management department in advance, and in accordance with the relevant construction procedures for approval. Thirteenth to encourage the development of characteristic tourism projects; Encourage the development of intellectual, interesting and participatory entertainment projects; Encourage the development of tourist commodities and souvenirs with local characteristics and cultural connotations.

Encourage the use of existing conditions, in accordance with the relevant provisions of the state and province to set up low-cost, public-oriented tourist accommodation facilities.

It is forbidden to build tourism projects that promote feudal superstition, have low style and are harmful to tourists' physical and mental health. Fourteenth tourism management departments shall, jointly with relevant departments, set up tourist routes and participate in the planning of tourism transportation, the formulation of transportation infrastructure standards and the management of tourism transportation service standards. Chapter III Tourism Management Article 15 Tourism operators shall obtain business qualifications according to law and follow the principles of honesty and credit, fair competition, standardized services and recognized business ethics.

The legitimate rights and interests of tourism operators are protected by law; Tourism operators have the right to refuse fees and apportionment in violation of laws and regulations; Have the right to refuse the inspection of personnel without administrative law enforcement certificates; Have the right to refuse tourists who violate laws, regulations and social ethics and exceed the requirements stipulated in the travel contract. Sixteenth tour operators should improve the internal management system, strengthen the professional skills training, professional ethics education and legal education for employees, and constantly improve the quality of service.
