Regulations of Yunnan Province on Tourism

Chapter I General Provisions Article 1 In order to protect and rationally develop tourism resources, maintain the order of the tourism market, protect the legitimate rights and interests of tourists, tour operators and tourism professionals, and promote the development of tourism, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to tourism planning, tourism resource development, tourism management, tourist activities and tourism supervision and management within the administrative area of this province. Article 3 The development of tourism should adhere to the principle of Scientific Outlook on Development, the combination of protection and rational development, and the coordinated development of economy and society, so as to promote the sustainable development of tourism. Article 4 Where conditions permit the development of tourism, the people's governments at or above the county level shall incorporate the development of tourism into the national economic and social development plan, increase investment and support for tourism, and promote the coordinated development of tourism and related industries.

The people's governments at or above the county level and their relevant departments shall support the development of tourism in ethnic autonomous areas, develop characteristic tourism projects, and train minority tourism management talents. Fifth tourism administrative departments of the people's governments at or above the county level shall be responsible for the guidance, management and supervision of tourism within their respective administrative areas.

The tourism quality supervision and management institutions affiliated to the tourism administrative departments are responsible for the supervision and inspection of tourism quality and the handling of tourism complaints, and their funds are included in the fiscal budget at the same level.

The relevant departments shall, in accordance with their respective responsibilities, ensure and promote the healthy development of tourism. Article 6 The people's governments at or above the county level and relevant departments shall commend and reward the units and individuals that have made remarkable achievements in promoting the development of tourism. Chapter II Promotion and Development of Tourism Article 7 Units and individuals are encouraged to invest in the development of tourism resources and engage in tourism management; Tourism administrative departments and relevant departments shall provide information and guidance, and do a good job in service coordination. Eighth people's governments at or above the county level shall, according to the needs of tourism development, establish a coordination mechanism for tourism work to guide and coordinate major issues in tourism work; Organize tourism, price, public security, transportation, industry and commerce, health, culture, safety production, quality and technical supervision and other departments to carry out joint tourism law enforcement, and be responsible for the supervision and inspection of the tourism market order; Organize relevant departments and units to establish and improve the tourism rescue system, formulate plans for preventing and handling major tourism safety accidents, and coordinate their implementation. Ninth people's governments at or above the county level shall, according to the needs of tourism development, establish special funds for tourism development, and the specific management measures shall be formulated by the people's governments at the same level. People's governments at or above the county level shall promote regional tourism economic cooperation and eliminate barriers to trade in tourism services between regions. Tenth tourism administrative departments should provide public welfare information consulting services for tourism operators and tourists in transportation hubs and tourist distribution centers.

Tourism, information, telecommunications, postal services, finance, industry and commerce, public security and other departments should support the establishment of tourism e-commerce platform, develop online information inquiry, reservation and payment services, and realize online tourism transactions. Eleventh tourism administrative departments shall, in conjunction with the quality and technical supervision and management departments, organize the implementation of national standards, industry standards and local standards for the tourism industry.

Local standards for tourism shall be formulated by the quality and technical supervision department of the provincial people's government in conjunction with the tourism administrative department of the provincial people's government. Twelfth traffic administrative departments should adapt to the needs of tourism development when formulating traffic planning and traffic service standards and arranging key traffic routes and stations. Thirteenth price administrative departments in the formulation or adjustment of tourist attractions (spots) ticket prices, should listen to the opinions of the tourism administrative departments at the same level, listen to the opinions of the relevant sectors of society, and in accordance with the provisions of the price hearing.

The formulation or adjustment of ticket prices for tourist attractions (spots) shall be announced to the public three months before implementation. Fourteenth tourism industry associations should formulate industry service standards, implement industry self-discipline, expand the tourism market, carry out publicity and promotion, release market information, and carry out industry training and exchanges.

Tourism industry associations shall accept the guidance, management and supervision of tourism administrative departments. Fifteenth to encourage the use of related professional conferences, exhibitions, cultural performances, sports events, scientific and technological exchanges, national festivals and other activities to promote the development of tourism. Sixteenth state organs, enterprises, institutions and social organizations may entrust travel agencies to arrange transportation, accommodation, catering, meetings and other matters for their approved official activities. Seventeenth in accordance with the principle of "who is in charge, who approves, who manages, who is responsible", the people's governments at or above the county level shall transfer the tourism supervision and management affairs beyond the scope of duties of the tourism administrative department to the relevant departments for handling. Chapter III Protection and Development of Tourism Resources Article 18 The tourism administrative department of the people's government at or above the county level shall be responsible for organizing the general survey, evaluation and establishment of tourism resources information database within its administrative area. Nineteenth tourism administrative departments of the people's governments at or above the county level shall organize the preparation of tourism development plans within their respective administrative areas. Cross-administrative regional tourism development planning is organized by the tourism administrative department of the people's government at the next higher level.

The tourism administrative department of the people's government at or above the county level shall, when preparing the tourism development plan, listen to opinions extensively, organize expert argumentation and review by the tourism administrative department of the people's government at the next higher level, report to the people's government at the same level for approval and organize implementation.

Special planning shall be formulated by relevant departments or units and reported to the tourism administrative department at the same level for the record.
