Tourism Regulations of Xishuangbanna Dai Autonomous Prefecture in Yunnan Province (revised in 2020)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Tourism Law of the People's Republic of China, the Tourism Regulations of Yunnan Province and the actual conditions of Xishuangbanna Dai Autonomous Prefecture (hereinafter referred to as the Autonomous Prefecture) in order to standardize the tourism market order and promote the healthy development of tourism. Article 2 These Regulations shall apply to the planning, construction, business activities, supervision and management and services of tourism within the administrative area of Autonomous Prefecture. Article 3 The development of tourism should adhere to the principles of ecological priority, scientific planning, rational utilization and coordinated development, highlight the characteristics of tropical rain forest, national culture and frontier areas, and promote the unity of social, economic and ecological benefits. Article 4 Autonomous Prefecture shall implement the strategy of strengthening the country through tourism, develop global tourism and build a world famous tourist city. Article 5 The people's governments of autonomous prefectures and counties (cities) shall incorporate the development of tourism into the national economic and social development plan, increase investment and support for tourism, improve the tourism infrastructure and service guarantee system, and include the required funds in the annual fiscal budget at the corresponding level. Article 6 The people's governments of autonomous prefectures and counties (cities) shall establish and improve the overall coordination mechanism for tourism development, and guide, coordinate and solve major problems in tourism development. Seventh autonomous prefecture and county (city) people's government tourism administrative departments responsible for the guidance, coordination, supervision, management and service of tourism within their respective administrative areas; Other relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in the development of tourism.

Township (town) people's governments and sub-district offices shall assist in the relevant work of tourism development within their respective jurisdictions. The farm management committee shall cooperate with the relevant administrative departments to do a good job in the development of tourism.

Village (neighborhood) committees and communities shall assist in the related work of tourism management and service. Eighth tourism industry associations should formulate and implement industry norms, strengthen industry self-discipline, play the role of service, guidance, coordination and supervision, promote the construction of industry integrity, and safeguard the legitimate rights and interests of the industry and fair competition order. Chapter II Tourism Planning and Promotion Article 9 The tourism development of Autonomous Prefecture shall conform to the tourism development plan, strengthen the integration of cultural tourism, promote the innovation of traditional tourism, promote the development of border tourism and improve the service level of urban tourism. Article 10 The tourism administrative department of the people's government of an autonomous prefecture or county (city) shall be responsible for the preparation of the tourism development plan within its administrative area, which shall be submitted to the people's government at the corresponding level for approval and organization of implementation after being examined and approved by the tourism administrative department at a higher level.

The tourism administrative departments of the people's governments of autonomous prefectures and counties (cities) may, according to the needs of regional tourism development and the development and construction of tourism products, compile special tourism plans in different categories, and organize their implementation after being approved by the people's governments at the corresponding levels. The special tourism plans of counties (cities) shall be filed with the tourism administrative departments of the people's governments of autonomous prefectures.

Autonomous prefecture tourism special planning, county (city) tourism development planning and tourism special planning should be linked with autonomous prefecture tourism development planning. The special planning of regional tourism development and tourism product development and construction should be included in the land space planning at the same level. Eleventh autonomous prefectures and counties (cities) people's governments shall support and encourage various economic organizations and individuals to invest in the development of tourism projects that conform to the tourism development plan. Article 12 The people's governments of autonomous prefectures and counties (cities) may, under the premise of protection, support the rational utilization of biological resources such as tropical rain forests, wild Asian elephants, Cephalotaxus fortunei, natural rubber and ecological ancient tea gardens to develop tourism projects, and promote the integrated development of biological resources and tourism.

The people's governments of autonomous prefectures and counties (cities) shall support the development of tourism projects by using intangible cultural heritages such as traditional villages, characteristic villages, cultural relics and historic sites, Dai Water-splashing Festival, Dai medicine and Pu 'er tea production skills, so as to promote the integrated development of national culture and tourism. Article 13 The people's governments of autonomous prefectures and counties (cities) encourage and support the research and development, design and processing of tourism commodities with national and local characteristics, such as food, clothing, souvenirs and handicrafts, and promote the industrialization of tourism commodities. Fourteenth tourism infrastructure construction and tourism project development should conform to the tourism development plan. The relevant administrative departments shall solicit the opinions of the tourism administrative departments at the same level when examining and approving tourism construction projects such as tourist attractions (spots) and tourist hotels (hotels).

Tourism activities in tourist attractions (spots) shall be reported to the tourism administrative department of the county (city) people's government for the record.

Around the tourist attractions (spots), no projects that destroy the overall landscape of the scenic spots or pollute the environment of the scenic spots may be built.

It is forbidden to construct tourism projects that distort and belittle national traditional culture. Article 15 The people's governments of autonomous prefectures and counties (cities) shall rationally arrange traffic routes, plan and construct tourist distribution centers, transit stations, tourist passenger dedicated lines and self-driving camps, and strengthen the construction of public service facilities such as tourist roads and parking lots. Article 16 The people's governments of autonomous prefectures and counties (cities) shall encourage institutions of higher learning and vocational training to cooperate with tourism industry associations and tourism operators, set up tourism talent training institutions, strengthen the education and training of tourism professionals, and improve their service level. Chapter III Tourism Management Standards Article 17 Tourism operators shall go through the examination and approval procedures in accordance with the relevant provisions of the state and the province when operating high-risk tourism projects such as high altitude, high speed, water and exploration; Operators shall formulate emergency plans for safety accidents and make safety warning signs; Regularly check the facilities that may endanger personal safety in tourism activities; Provide risk warning and safety training for tourists who participate in high-risk tourism projects.
