Measures of Nanning Municipality for the Administration of Collection and Release of Enterprise Credit Information

Chapter I General Provisions Article 1 In order to build a credible Nanning, improve the business environment of enterprises and promote the publicity and enjoyment of credit information of enterprises, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the collection, collation, disclosure, use, consultation and management of enterprise credit information within the administrative area of this Municipality. Article 3 The management activities of enterprise credit information collection and release shall follow the principles of legality, fairness, objectivity and accuracy, protect state secrets, business secrets and personal privacy according to law, and shall not infringe upon the legitimate rights and interests of enterprises. Article 4 The municipal credit system construction management institution shall be responsible for organizing, managing and supervising the collection and release of enterprise credit information in the whole city.

Administrative organs, judicial organs and financial management institutions shall, within their respective functions and powers, supervise the publicity activities of enterprise credit information according to law. Article 5 The enterprise credit information collection agency established by the Municipal People's Government according to law is responsible for the collection, collation, storage, release, daily maintenance and data security of enterprise credit information, providing enterprise credit information services and realizing the interconnection and sharing of enterprise credit information resources in the whole city. Chapter II Collection Article 6 The enterprise credit information collected by the municipal enterprise credit information collection agency includes:

(a) the basic situation of enterprise registration;

(2) The operating conditions of the enterprise;

(three) other important information that affects the credit of the enterprise. Seventh administrative organs and other organizations with administrative functions shall, within the scope of their respective duties, provide relevant information to the municipal enterprise credit information collection agencies in accordance with the provisions of these Measures:

(a) the industrial and commercial departments to provide basic information of enterprise registration, trademarks, change registration, annual inspection, mortgage registration, contract performance, industrial and commercial cases and other records of rewards and punishments;

(2) The statistics department provides information on the assets, liabilities, owners' rights and interests, operating conditions, statistical violations and other records of rewards and punishments of the enterprise;

(3) The quality supervision department provides information such as enterprise organization code, quality certification, production license, implementation standards, national inspection exemption, famous products, geographical indication protection, supervision and spot check, handling of quality violations and other rewards and punishments records;

(four) the competent economic departments to provide information such as rewards and punishments records generated by enterprises in technological innovation, technological transformation and management;

(five) the supervision and administration department of production safety shall provide information such as safety production conditions, safety production license, safety quality standard certification, illegal acts of production safety and relevant records of rewards and punishments;

(6) The tax authorities provide information such as enterprise tax registration, tax declaration, tax violations (including tax evasion, tax evasion, tax arrears, tax refusal, tax fraud, etc.). ), inspection, corporate tax credit rating and other reward and punishment records;

(seven) the environmental protection department to provide enterprises with information about the construction project environmental approval, environmental protection facilities completion acceptance records, enterprise cleaner production, pollutant discharge, environmental violations and related rewards and punishments, environmental certification and other records;

(eight) the information provided by the civil affairs department on the annual inspection of welfare enterprises and other records of rewards and punishments;

(nine) the labor and social security departments provide information such as the signing and performance of labor contracts between enterprises and employees, the payment of wages, the payment of social insurance premiums and other records of rewards and punishments;

(ten) the competent department of construction to provide information about the enterprise quality and safety accident responsibility and other rewards and punishments records, and regularly provide information about the construction qualification;

(eleven) the information provided by the centralized government procurement agencies about the illegal bidding records and other rewards and punishments records of enterprises;

(twelve) the health department to provide information on the qualification grade of medical institutions, the quantitative grade of health supervision of food production and business units, rewards and punishments;

(thirteen) the science and technology department provides information such as technical appraisal, intellectual property protection and other rewards and punishments records;

(fourteen) the land and resources department provides information on the land use of enterprises, the punishment of enterprises in violation of laws and regulations on land and mineral resources, and other records of rewards and punishments;

(fifteen) agriculture, forestry and other departments to provide agricultural and forestry products production and operation enterprises to implement quality and safety standards and other information;

(16) The commercial department shall provide information such as import and export enterprise codes, approved commodity business qualifications, annual inspection of import and export licenses and qualification certificates, rectification and standardization of market economic order, and other rewards and punishments records;

(seventeen) the price department provides information such as price violations and other records of rewards and punishments;

(eighteen) the traffic and public security departments provide special records and other information such as reward and punishment records in the annual inspection and payment of vehicles;

(19) The food and drug supervision department provides information such as the license number, approval number, food and drug quality violations and other rewards and punishments records of pharmaceutical production and business enterprises;

(twenty) the cultural department to provide business licenses and other rewards and punishments record information.

Other administrative organs and organizations with administrative functions provide enterprise credit information related to their own business.

Where there are other provisions in laws and regulations on the disclosure of enterprise credit information, those provisions shall prevail. Article 8 Customs, entry-exit inspection and quarantine departments, financial management institutions, other vertical management departments and judicial organs shall provide relevant enterprise credit information as agreed.
