The National Tourism Administration collects and manages the deposits of central first-class travel agencies engaged in attracting and receiving international tourism and travel agencies franchised abroad.
The tourism administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government shall, according to the authorization of the National Tourism Administration, collect and manage the deposit for travel agencies engaged in international tourism attraction and reception business in the region; Directly collect and manage the deposit of travel agencies affiliated to provincial units engaged in international tourism reception business and domestic tourism business.
Entrusted by the tourism administrative departments of provinces, autonomous regions and municipalities directly under the central government, the tourism administrative departments of all localities, prefectures and cities collect and manage the deposit for travel agencies engaged in international tourism reception business in the region; With the approval of the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government, collect and manage the deposit of travel agencies engaged in domestic tourism business in this region. Article 4 All kinds of travel agencies shall pay the deposit to the tourism financial management departments at all levels in accordance with the standards stipulated in the Interim Provisions on Quality Deposit of Travel Agencies. Among them, the extra deposit (6,543,800 yuan) paid by the travel agency for franchising overseas (outbound) tourism business should be directly turned over to the National Tourism Administration. Article 5 The deposit paid by travel agencies must be in cash. Article 6 The tourism financial management departments at all levels shall, according to the Notice of Payment of Quality Margin by Travel Agencies issued by the competent department (office) of the tourism industry, collect the deposit in full at one time and issue a receipt as a necessary condition for examining the applicant's starting conditions and issuing the Travel Agency Business License; All kinds of travel agencies that have been allowed to start business before the promulgation and implementation of the Interim Provisions on Quality Margin for Travel Agencies shall pay the deposit in full before June 30. 1995. The payment and payment of the deposit of each travel agency will be an important assessment content of the annual business inspection of the tourism administrative department. Article 7 In case of various claims, if the travel agency does not bear or is unable to bear the liability for compensation, the tourism financial management departments at all levels shall pay compensation to the claimant within 5 days (postponed in case of holidays) after receiving the Notice of Compensation for Quality Margin of Travel Agency finally approved by the tourism industry management department at the same level or at a higher level.
Where foreign currency compensation is involved, the relevant travel agency shall, after receiving the Notice of Compensation for Quality Margin of Travel Agency, which is finally ruled by the tourism industry management department, cooperate with the tourism financial management department to exchange foreign currency according to the national foreign exchange rate on the day of payment of compensation, and pay the compensation claimant. Article 8 The deposit of each travel agency shall be kept in full in accordance with the provisions. After paying the compensation with the deposit, the relevant travel agency shall make up for it within 60 days. Article 9 The deposit interest shall be calculated according to the unit deposit interest rate stipulated by the People's Bank of China. Among them, the interest of 1/3 belongs to all paying units, and it is settled annually by tourism financial management departments at all levels, and it is settled in one lump sum before the end of February of the following year and returned to the travel agency; The rest is used as the deposit management fee, which is used by tourism quality supervision and management institutions at all levels to deal with tourism complaints and claims, including the start-up expenses and daily expenses of tourism quality supervision and management institutions. Margin and interest income are managed by tourism financial management departments at all levels. Article 10 Where a travel agency is merged, dissolved, transferred or bankrupt, the deposit shall be treated as a part of the property of the travel agency enterprise in accordance with relevant laws and regulations. Tourism financial management departments at all levels shall, within 30 days after receiving the notice from the tourism administrative department to terminate the operation of the travel agency, settle and return the principal and interest of the deposit of the travel agency (clearing institution). Article 11 Establish a financial reporting system for margin financing and securities lending. The tourism financial management department at the next level shall report the collection, use and management of the margin within its jurisdiction to the tourism financial management department at the next higher level. The financial management departments of the tourism bureaus of all provinces, autonomous regions and municipalities directly under the Central Government shall report in writing to the Financial Management Department of the National Tourism Administration the income and expenditure and management of the deposit in their respective jurisdictions in the previous year before 1 and 3 1 each year. Twelfth tourism financial management departments at all levels should regularly check the financial management of deposits within their respective jurisdictions; The superior tourism financial management department has the right to check the financial management of the deposit by the subordinate tourism financial management department. Thirteenth tourism finance and auditing departments at all levels should conduct financial inspection or audit on the income and expenditure and management of the deposit every year, and regularly publish the financial management of the deposit for travel agencies and relevant departments to inquire and accept supervision.
