Interim Measures for the Administration of Tourism Safety

Chapter I General Provisions Article 1 These Measures are formulated in accordance with relevant laws and regulations in order to strengthen the management of tourism safety and ensure the personal and property safety of tourists. Article 2 Tourism safety management shall follow the principle of "safety first, prevention first". Article 3 These Measures shall apply to enterprises and institutions engaged in tourism business. Fourth tourism administrative departments at all levels are responsible for organizing the implementation of these measures.

Chapter II Safety Management Article 5 Tourism safety management shall follow the principles of unified guidance, hierarchical management and grass-roots units as the mainstay. Sixth tourism administrative departments at all levels must establish and improve the tourism safety management institutions. Seventh tourism administrative departments at all levels, under the leadership of the local government, in conjunction with relevant departments, to manage tourism safety. Article 8 The responsibilities of tourism safety management institutions are as follows:

(a) to guide, supervise and inspect the implementation of these measures and the laws and regulations on tourism safety formulated by the state by tourism enterprises and institutions in the whole region;

(two) organize the implementation of tourism safety education and publicity;

(three) in conjunction with the relevant departments to inspect and accept the safety facilities before the opening of tourism enterprises and institutions;

(four) supervision and inspection of tourism enterprises and institutions to implement the personal and property safety insurance system for tourists;

(5) Accepting tourists' complaints about safety issues and properly handling them together with relevant departments;

(six) to establish and improve the safety inspection system and hold regular safety work meetings;

(seven) to participate in the handling of accidents involving the personal and property safety of tourists.

Chapter III Handling of Accidents Article 9 After an accident occurs, the accident unit shall handle it according to the following procedures:

(a) the accompanying personnel shall immediately report to the competent department, which shall promptly report to the centralized management department;

(two) in conjunction with the relevant units at the scene of the accident to strictly protect the scene;

(three) to cooperate with the relevant departments to carry out rescue and investigation;

(four) the person in charge of the relevant units should arrive at the scene in time;

(five) for particularly serious accidents, should be handled in strict accordance with the "Interim Provisions of the State Council municipality on the investigation procedures of particularly serious accidents". Article 10 When dealing with the accidents of heavy casualties of foreign tourists, we should pay attention to the following matters:

(a) immediately notify the relevant countries and organizations in embassies and consulates in China through the administrative department of foreign affairs;

(two) to provide convenience for the personnel of embassies and consulates abroad, the group units and the families of the casualties who come to understand and deal with the accident;

(three) to coordinate the relevant departments to facilitate the participation of international first aid organizations in the treatment of casualties of overseas insured tourists (groups);

(4) The death of foreign tourists in China shall be handled in strict accordance with the Procedures for Handling the Death of Foreigners in China issued by the Ministry of Foreign Affairs. Eleventh compensation for foreign tourists, in accordance with the relevant provisions of the state insurance. Twelfth after the accident treatment, immediately write an accident investigation report, which includes:

(1) The course and handling of the accident;

(2) Causes and responsibilities of the accident; (3) accident lessons; (4) Preventive measures in the future.

Chapter IV Awards and Penalties Article 13 Units or individuals that have made outstanding achievements or contributions in tourism safety work shall be commended or rewarded. Fourteenth in violation of relevant safety laws and regulations, causing casualties to tourists and not implementing these measures, the tourism administrative department in conjunction with relevant departments shall give the following penalties to the directly responsible person and the responsible unit respectively: (1) warning; (2) a fine; (3) Rectification within a time limit; (4) suspend business for rectification;

(5) Revocation of business license.

Those who violate the criminal law shall be investigated for criminal responsibility by judicial organs according to law.

Chapter V Supplementary Provisions Article 15 These Measures shall be interpreted by the National Tourism Administration. Sixteenth provinces, autonomous regions and municipalities directly under the central government tourism bureau can formulate implementation measures according to these measures, combined with the actual situation in the region, and report to the National Tourism Administration for the record. Article 17 These Measures shall be implemented as of 1 March, 9901day.
