Tear up the agreement
Legal analysis: It is not illegal to tear up the contract itself, but if you fail to perform the obligations of the contract after tearing up the contract, it will constitute a breach of contract, and you must bear the corresponding liability for breach of contract.
Legal basis: Article 60 of the "Contract Law of the People's Republic of China" The parties shall fully perform their obligations in accordance with the agreement.
The parties shall abide by the principle of good faith and perform notification, assistance, confidentiality and other obligations in accordance with the nature, purpose and transaction habits of the contract.
Article 107 If a party fails to perform its contractual obligations or performs its contractual obligations inconsistently with the agreement, it shall bear liability for breach of contract such as continuing to perform, taking remedial measures, or compensating for losses.
Article 108 If one party expressly states or shows by its own behavior that it will not perform its contractual obligations, the other party may require it to bear liability for breach of contract before the expiration of the performance period.
Article 109: If one party fails to pay the price or remuneration, the other party may require it to pay the price or remuneration.
