New land use policy for cultural tourism projects

Legal analysis: The pilot conversion of permanent basic farmland into construction land and the approval of land expropriation in the State Council are entrusted to the people's governments of some provinces, autonomous regions and municipalities directly under the Central Government for approval. The State Council entrusted the people's governments of some pilot provinces, autonomous regions and municipalities directly under the Central Government with the approval of the conversion of permanent basic farmland into construction land as stipulated in the second paragraph of Article 44 of the Land Management Law, and the approval of the expropriation of permanent basic farmland and land other than permanent basic farmland exceeding 35 hectares and other land exceeding 7 hectares as stipulated in the first paragraph of Article 46. The first batch of pilot provinces are Beijing, Tianjin, Shanghai, Jiangsu, Zhejiang, Anhui, Guangdong and Chongqing, and the pilot period is one year. The State Council will establish and improve the evaluation mechanism for land use approval of provincial people's governments, and dynamically adjust the pilot provinces according to the comprehensive evaluation results of land management level of all provinces, autonomous regions and municipalities directly under the Central Government.

Legal basis: Article 12 of the Provisional Regulations of the People's Republic of China on the Assignment and Transfer of State-owned Land Use Rights in Cities and Towns is determined according to the following purposes:

(1) seventy years of residential land;

(2) fifty years of industrial land;

(3) fifty years of land for education, science and technology, culture, health and sports;

(4) forty years for commercial, tourism and entertainment purposes;

(5) 5 years of comprehensive or other land use.
