Provisions of Guangzhou Municipality on Safety Management of Special Tourism Projects

Article 1 In order to strengthen the safety management of special tourism projects in this Municipality and protect the legitimate rights and interests of tourists, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Consumers' Rights and Interests and the Interim Measures for the Administration of Tourism Safety issued by the National Tourism Administration, combined with the actual situation of this Municipality. Article 2 Special tourism projects mentioned in these Provisions refer to high-altitude, high-speed and amusement projects that may endanger personal safety. Including:

(1) roller coaster, ferris wheel, hot air balloon, umbrella tower, electric swing, pirate ship, electric swivel chair, high-altitude train, high-speed racing car, cable car, high-altitude slide, hunting, diving, rock climbing and bungee jumping.

(two) other recreational projects that may endanger personal safety confirmed and announced by the municipal tourism administrative department in conjunction with the public security, labor and technical supervision departments. Article 3 Units and individuals that offer special tourism projects within the administrative area of this Municipality shall abide by these provisions. Article 4 Guangzhou Tourism Administration Department is the competent department of safety management of special tourism projects in this Municipality, and is responsible for organizing and coordinating the implementation of these Provisions.

District and county-level city tourism administrative departments in accordance with the management authority, responsible for the safety management of special tourism projects within their respective jurisdictions.

Public security, labor, health, technical supervision, landscape, environmental protection, transportation and other administrative departments shall, in accordance with their respective responsibilities, coordinate the implementation of these Provisions. Fifth tourism administrative departments shall perform the following duties in the safety management of special tourism projects:

(a) to guide and supervise the operators of special tourism projects within their jurisdiction to implement the relevant provisions on tourism safety;

(two) to check the safety management system and safety facilities of the operators of special tourism projects;

(three) in accordance with the relevant provisions of the examination and approval of special tourism projects, and in conjunction with the public security, labor, technical supervision, health and other relevant departments for acceptance;

(four) to organize the implementation of publicity, education and training for safety management personnel;

(5) Accepting tourists' complaints about tourism safety management and properly handling them;

(six) to coordinate the handling of tourism safety accidents. Article 6 Operators of special tourism projects shall do a good job in safety management according to the following requirements:

(a) the establishment of safety management post responsibility system, the safety management responsibility to the post;

(two) in accordance with the relevant provisions and standards of the state, regularly check and maintain amusement equipment, facilities and safety operation procedures, and eliminate hidden dangers of safety accidents in time;

(3) Operators of special tourism projects shall hold certificates approved by the tourism and labor administrative departments;

(four) equipped with medical personnel trained in emergency medical treatment, as well as the necessary first-aid drugs and equipment; The infirmary should set up obvious signs or signs;

(five) to participate in the city's tourism accident emergency rescue network, and to insure tourists;

(six) to establish and improve the purchase, installation, acceptance, operation, maintenance and annual inspection files of amusement equipment for special tourism projects;

(seven) other safety matters that should be observed according to law. Seventh special tourism projects, should apply to the district (county-level city) tourism administrative department where the project is located, after examination and approval, report to the municipal tourism administrative department for examination and approval.

(1) An application for setting up special tourism projects;

(3) written materials such as instruction manual, inspection and maintenance instruction manual, drawings and product certificate of amusement equipment (Chinese instruction manual shall be provided for imported equipment, and production license number shall be provided for products subject to production license management);

(4) Materials for formulating operation, maintenance, maintenance and inspection systems;

(5) Other written materials that should be submitted. Article 9 After accepting the application, the municipal tourism administrative department shall organize labor, public security, technical supervision and other departments to conduct safety assessment of the project within their respective functions and duties. Except in special circumstances, labor, public security, technical supervision and other departments should put forward written safety assessment opinions within 30 working days; The municipal tourism administrative department shall review the special tourism projects according to the review opinions of the above-mentioned relevant departments; Give approval to projects that have passed the safety assessment, and send the approval results to labor, public security, technical supervision and other departments for the record. Tenth special tourism projects after the completion of the project, the municipal tourism administrative department in conjunction with the public security, labor, technical supervision and other relevant departments for acceptance, qualified rear can operate.

The specific acceptance measures shall be formulated and promulgated by the tourism department in conjunction with relevant departments. During the annual inspection, the operators of special tourism projects shall provide the inspection report on the running status of amusement equipment at that time issued by professional inspection institutions recognized by the technical supervision department.

If it fails to pass the annual safety audit, it shall suspend its operation, make rectification within a time limit, and continue its operation only after passing the re-inspection.
