Measures for the administration of water conservancy tourist areas (for Trial Implementation)

Article 1 In order to rationally develop and utilize water and soil resources and promote the development of water conservancy tourism, these Measures are formulated in accordance with the Water Law of People's Republic of China (PRC) and the relevant provisions of the state. Article 2 The term "water conservancy tourist area" as mentioned in these Measures refers to the place where tourism, entertainment, vacation or scientific, cultural and educational activities are carried out by using the waters, water projects and water cultural landscapes within the management scope of the water conservancy department.

The scenery of water conservancy tourist area includes rivers, lakes, reservoirs, canals, ponds and other natural or artificial waters with tourist value and their islands, beaches and coasts; Embankments, water control projects, sluices, hydropower stations and other engineering buildings; Water cultural relics and other landscapes; The natural landscape and human landscape in this area. Article 3 The Ministry of Water Resources is in charge of the national water conservancy tourism work, which is under the centralized management of the water conservancy management department. At or above the county level (including county-level cities and districts, the same below), the water administrative department is in charge of water conservancy tourism within its administrative area.

Water conservancy tourism work of water projects that cross administrative regions or are not subordinate to the water administrative department at the same level shall be managed by the water administrative department at the next higher level. Article 4 The water conservancy tourist area management organization, namely the water project management organization, is responsible for the development, construction, operation and management of this water conservancy tourist area. Fifth development and utilization of water conservancy tourism resources should follow the following principles:

(a) does not affect the safe operation and normal management of water projects. Within the scope of water project management, no deforestation, sand digging, pit digging or grave burial are allowed, and no water project management facilities are occupied.

(2) Protect the water environment. It is forbidden to pollute water bodies, and strict protection measures should be formulated for water bodies with urban water supply tasks.

(3) Do a good job in the overall planning of water conservancy tourist areas. In the core scenic spots, key scenic spots, especially historical water cultural relics, necessary protection facilities should be established, and hotels, guest houses, nursing homes and other construction projects are not allowed.

(4) Take effective measures to protect the personal safety of tourists, and establish safety protection facilities and management systems. Sixth water conservancy tourist areas are divided into three levels according to their landscape function, cultural and scientific value, environmental quality, scale and other factors, namely, national, provincial and county water conservancy tourist areas.

(1) National Water Conservancy Tourist Area: Beautiful water landscape, concentrated natural landscape and human landscape, large-scale water conservancy projects, water conservancy cultural relics with historical significance, high ornamental and scientific and cultural value, superior geographical location, certain regional representation, complete tourism service facilities and high popularity.

(2) Provincial water conservancy tourist area: beautiful water landscape, relatively concentrated natural landscape and human landscape, large-scale water conservancy engineering facilities, high ornamental, scientific and cultural value, representative in this administrative area, necessary tourism service facilities and certain popularity.

(3) County-level water conservancy tourist area: the water landscape and scenic spots are relatively concentrated, and the water engineering facilities have a certain scale, which has certain ornamental, scientific and cultural value and certain popularity in the local area. Article 7 To establish a national water conservancy tourist area, the management organization shall apply to the provincial water conservancy administrative department and report the feasibility study report of the water conservancy tourist area. After the preliminary examination, the provincial water conservancy administrative department shall report it to the Ministry of Water Resources with official documents and preliminary examination opinions. After the demonstration by the corresponding water conservancy tourism resources evaluation institution, it shall be reported to the Ministry of Water Resources for approval.

The Ministry of Water Resources will regularly organize relevant personnel to inspect the approved national water conservancy tourist areas and announce the inspection results to the public through the news media.

The establishment of provincial and county-level water conservancy tourist areas shall be approved only after the feasibility study report is prepared by the management organization and submitted to the corresponding water administrative department for examination and demonstration.

Provincial and county-level water conservancy tourist areas approved for establishment shall be reported to the Ministry of Water Resources by the provincial water administrative department in accordance with relevant regulations for the record and announced to the public. Article 8 To declare a national water conservancy tourist area, the following conditions shall be met:

(a) in line with the basic conditions of the national water conservancy tourist area as stipulated in Item (1) of Article 6 of these Measures, and there are opinions and documents issued by the provincial water administrative department agreeing to declare.

(two) the management of water conservancy tourist areas is sound, the affiliation is clear, and the owners are clear.

(three) the feasibility study report of the water conservancy tourist area has been completed, and the application form has been filled in according to the relevant regulations.

(four) the scope of management and protection of water conservancy tourist areas is clear, and the ownership is clear. Ninth feasibility study report includes the basic situation of water conservancy tourist area, the necessity and feasibility of development, benefit analysis and investment sources. And attach the master plan of water conservancy tourist area and related drawings, photos, videos and other materials.

The management institution of water conservancy tourist area is responsible for organizing the preparation of the overall planning of water conservancy tourist area. Tenth water conservancy tourism development and construction must be carried out in accordance with the planning and design approved by the water administrative department with corresponding management authority. Eleventh water conservancy tourist area management agencies, should operate in accordance with relevant laws and regulations. Their legitimate rights and interests are protected by law, and no unit or individual may infringe upon them.

On the premise of ensuring that the state-owned assets of water conservancy are not lost, the management institutions of water conservancy tourist areas can also jointly develop with other units and individuals in the form of joint venture construction and cooperative operation, but the subordinate relationship of the management institutions shall not be changed.
