Regulations of Guangdong Province on Tourism Management
The term "tourism operators" as mentioned in these Regulations refers to business units or individual operators that specialize in or mainly engage in tourism business activities, such as travel agencies, tourist attractions (spots) and tourist hotels (hotels), restaurants, shops, travel companies and holiday entertainment places. Article 4 The development of tourism should adhere to the principles of combining strict protection, rational development and sustainable utilization of tourism resources, combining economic benefits with social benefits, combining short-term benefits with long-term benefits, and combining local interests with overall interests, and correctly handle the relationship between protection, research and utilization of natural and human landscapes to realize the sustainable development of tourism. Fifth people's governments at all levels should incorporate tourism into the national economic and social development plan, optimize the development environment, encourage and support domestic and foreign tourism operators to invest and operate tourism in this province according to law.
The principle of "who invests, who benefits and who protects" should be implemented in the development of tourism resources and tourism. Article 6 The tourism administrative departments of the people's governments at or above the county level shall be responsible for the tourism supervision and management within their respective administrative areas, and other relevant departments shall coordinate in the tourism management within their respective functions and duties. Chapter II Development and Protection of Tourism Resources Article 7 The tourism administrative department of the people's government at or above the county level shall, jointly with the relevant departments of planning, culture, environmental protection, forestry, water conservancy, ocean, ethnic and religious affairs, formulate a tourism development plan within its administrative area, which shall be examined by the tourism administrative department at the next higher level and submitted to the people's government at the same level for approval.
Tourism development planning should conform to the overall urban planning, land use planning and sea area development and utilization planning, and coordinate with other professional planning such as scenic spots, nature reserves, cultural and religious sites and cultural relics protection units.
When making a tourism development plan, if it needs to be entrusted, it shall be entrusted to an institution with professional qualifications.
If it is really necessary to change the tourism development plan, it shall go through the examination and approval procedures in accordance with the original examination and approval procedures. Article 8 The development and utilization of tourism resources involving the environment, the protection of cultural relics, overseas Chinese, ethnic and religious affairs, oceans, agriculture, forests, water resources, land resources and the management of nature reserves shall be implemented in accordance with the provisions of relevant laws and regulations.
No unit or individual may destroy tourism resources. Article 9 Disputes over the development and utilization of tourism resources across administrative regions shall be settled through coordination with the people's governments at higher levels. Tenth new construction, renovation and expansion of tourism infrastructure projects should be fully demonstrated, rational layout, to avoid blind and repeated construction, involving religion, cultural landscape, cultural relics protection units, nature reserves, should also be approved by the administrative departments of religion, culture and nature reserves in accordance with the law.
Tourist hotels, tourist attractions (spots), theme parks, large amusement parks and other construction projects shall solicit the opinions of the tourism administrative departments before approval. Chapter III Tourism Management Article 11 Tourism operators must obtain business qualifications according to law before starting business. Twelfth tourism operators' autonomy is protected by law, and no unit or individual may infringe upon it.
Tourism operators have the right to refuse the inspection without going through legal procedures and showing valid law enforcement certificates; Have the right to refuse to forcibly sell goods or resettle people; Have the right to refuse illegal charges and apportionment; Have the right to ask the tourism administration department and other relevant departments to keep their business secrets. Thirteenth tourism operators operating in the tourism industry, should be open to business projects, standards, the implementation of clear price tag; Providing services or commodities that meet the agreement.
Tourism operators shall implement the government pricing or government-guided prices set according to law, and shall not engage in unfair competition behaviors such as driving up prices, dumping at low prices, manipulating market prices, publishing false advertisements and promotional materials.
If a tourism operator needs to change the agreed service items, contents, standards or prices, he must obtain the consent of the tourists in advance and shall not harm the legitimate rights and interests of the tourists.
Tourism operators shall submit tourism statistics to the tourism administrative departments. Fourteenth tour operators shall not provide services that are detrimental to national dignity, personal dignity, national customs and religious beliefs; Do not use coercion or deception to make tourists accept services or buy goods; Do not ask tourists for fees other than those stipulated in the contract in an express or implied way; Do not set up stalls in or around tourist attractions (spots) without authorization. Fifteenth tour operators should be in accordance with the requirements of the relevant safety management regulations, equipped with safety management personnel, equipment and facilities, establish a safety management system, keep tourism equipment and facilities in good working condition, and effectively protect the personal and property safety of tourists.
Forest tourism should do a good job in fire prevention to prevent the occurrence of mountain fires. To engage in tourism activities in cultural relics protection areas, measures must be taken to prevent cultural relics from being damaged.
To operate special tourism projects involving personal safety, reliable safety measures should be taken, and they can only be operated after passing the inspection. For situations that may cause tourism risks, tourists should be given a true explanation and a clear warning in advance. When a safety accident occurs, the tour operator shall promptly organize rescue and treatment, and compensate the tourists for their losses according to law.
