Xizang Autonomous Region Tourism Regulations (202 1 Amendment)

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of tourists, tour operators and tourism professionals, standardize the order of the tourism market, protect and rationally develop tourism resources, and promote the development of tourism, these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China and other relevant laws and regulations, combined with the actual situation of the autonomous region. Article 2 These Regulations shall apply to tourism activities and tourism resources protection and development, planning, industrial promotion, public services, business services and related supervision and management within the administrative area of the autonomous region. Article 3 The development of tourism in the autonomous region adheres to the principle of government leading and market operation. Strengthen government planning and guidance, overall planning of resources, construction of public services and supporting facilities, give play to the decisive role of the market in resource allocation, and form a tourism market environment with independent operation, fair competition and equal exchange. Article 4 The development of tourism resources shall adhere to unified planning, outstanding features, comprehensive development, rational utilization, benefiting the people and the people, scientific protection and sustainable development, so as to achieve the unity of economic benefits, social benefits and ecological benefits. Article 5 The people's government of the autonomous region shall formulate and organize the implementation of the industrial policy of the sustainable and healthy development strategy of tourism, develop the tourism with characteristics, high-end and high quality, enhance the cultural connotation of tourism products, cultivate the main body of the tourism market, and promote the construction of important world tourism destinations. Article 6 The people's governments at or above the county level shall strengthen the organization and leadership of the tourism industry, incorporate the tourism development into the national economic and social development plan, establish and improve the comprehensive coordination mechanism and incentive mechanism of the tourism industry, improve the policies and measures to promote the tourism development, promote regional tourism cooperation, optimize the tourism development environment and promote the tourism development. Seventh people's governments at or above the county level shall, according to the needs of tourism development, increase investment in tourism and set up special funds for tourism development. Special funds included in the fiscal year budget at the same level. Eighth people's governments at or above the county level shall strengthen the construction of tourism infrastructure, establish and improve public tourism service facilities. Municipal construction planning, transportation, communications, water supply, power supply, environmental protection and other infrastructure and public service facilities construction, should consider the development of tourism. Article 9 The tourism authorities of the people's governments at or above the county level shall be responsible for the overall coordination, comprehensive guidance, supervision and management of the tourism industry within their respective administrative areas. The relevant departments shall, in accordance with their respective responsibilities, do a good job in tourism-related work. Tenth people's governments at or above the county level shall commend and reward the units and individuals that have made outstanding contributions to promoting the development of tourism or promoting the development of related industries through tourism. Chapter II Tourists Article 11 Tourists shall enjoy the following rights:

(a) have the right to require tour operators to provide tourism products and services in accordance with the agreement, and have the right to refuse other tourism services other than those stipulated in the tourism contract;

(two) have the right to require tour operators to protect their personal and property safety when providing tourism services;

(three) when the personal and property safety of tourists is threatened, they have the right to request assistance and protection from the tourism authorities of the local people's government and the public security organs;

(four) personal and property damage, have the right to compensation according to law;

(5) Personal dignity, national customs and religious beliefs should be respected;

(six) other rights stipulated by laws and regulations. Twelfth tourists' legitimate rights and interests are infringed by tour operators or disputes between the two sides can be resolved through the following channels:

(1) self-consultation;

(two) to complain to the administrative department of tourism and market supervision and management;

(three) to apply for mediation to the consumer association;

(four) if there is an arbitration clause in the travel contract or an arbitration agreement is reached voluntarily after a dispute arises, apply to an arbitration institution for arbitration;

(5) bring a lawsuit to the people's court. Thirteenth tourists should fulfill the following obligations:

(a) abide by social order and social morality, civilized tourism;

(two) respect for local customs, cultural traditions and religious beliefs;

(three) consciously protect tourism resources, historical and cultural heritage and ecological environment;

(four) abide by the public order of tourism, and take good care of tourism facilities;

(five) measures to temporarily restrict tourism activities due to major emergencies and safety precautions and emergency measures taken by relevant departments, institutions or tourism operators should be coordinated;

(six) other obligations stipulated by laws and regulations. Chapter III Planning and Promotion Article 14 The people's governments at or above the county level shall, in accordance with the national economic and social development plan, organize the formulation of tourism development plans and make overall arrangements for the protection of tourism resources, the construction of tourism infrastructure and public service facilities, the development of tourism market and the development of tourism within their respective administrative areas.

The people's governments at or above the county level may, according to the tourism development plan, formulate special plans and new tourism plans for various tourism industries.

The people's government of the autonomous region is responsible for organizing the preparation of cross-regional (city) tourist scenic spot development planning and scenic spot planning for more than 4A, and guiding local (city) organizations to prepare the overall planning of local (city) tourism development. Fifteenth tourism development planning should highlight the local characteristics, and with the overall land use planning, urban and rural planning, nature reserve planning, environmental protection planning, traffic construction planning, cultural relics protection planning, port planning and other natural and human resources protection and utilization planning. Relevant departments should make overall plans for tourism functions and give consideration to the development of tourism.
