Huangshan Scenic Area Management Regulations (2018 revision)
Article 1 Huangshan is a national scenic spot, a world cultural and natural heritage, and a world geopark. In order to strictly protect Huangshan scenic spots resources, natural and cultural ecological environment, rationally develop, scientifically utilize and effectively manage scenic spots resources, in accordance with the "Regulations on Scenic Areas" of the State Council and relevant laws and administrative regulations, and in combination with the actual situation of Huangshan Mountain Scenic Areas, this document is formulated regulations. Article 2 The scope of the Huangshan Scenic Area (hereinafter referred to as the Scenic Area) is: Huangshi in the east, Xiaolingjiao in the west, Tangkou in the south, and Erlong Bridge in the north, covering an area of ??166.6 square kilometers. Based on the need to protect scenic resources and ecological environment, determine the protection zone outside the scenic area. The specific scope of the scenic area protection zone is delineated in accordance with the "Huangshan Scenic Area Master Plan" approved by the State Council. Article 3 Scenic and historic areas shall implement the principles of scientific planning, unified management, strict protection, and sustainable utilization. Article 4 The topography, mountains, rocks, soil, glacial relics, waterfalls, famous springs, rivers, forest vegetation, wild animals and plants, special geological environment and other natural scenery and cultural relics and historic sites, garden architecture, stone carvings and other humanities in the scenic area Scenery and its environment are all scenic and historic resources and should be strictly protected. Article 5 The Huangshan Municipal People’s Government shall establish the Huangshan Scenic Area Management Committee (hereinafter referred to as the Management Committee). The director of the management committee is concurrently served by the mayor. Under the leadership of Huangshan Municipal People's Government, the Management Committee is responsible for the protection, utilization and unified management of scenic spots. Its main responsibilities:
(1) Protect scenic resources, natural and cultural ecological environment;
(2) Organize and implement scenic area planning and rationally utilize scenic resources;
(3) Construct, manage and maintain infrastructure and other public facilities, and improve tourist service conditions;
(4) Responsible for closing mountains for afforestation, planting trees and greening, forest protection, fire prevention, soil and water conservation, biological Diversity protection, pest prevention and control, and disaster prevention and reduction work;
(5) Do a good job in publicity and education about caring for and protecting Huangshan;
(6) Responsible for construction, tourism , transportation, sanitation, water resources, environmental protection, cultural markets, production safety, social security, ethnic and religious affairs, food and drug safety and other management work;
(7) Prepare and implement relevant emergency plans;< /p>
(8) Manage other matters related to the protection of scenic spots.
The Administrative Committee may establish a comprehensive law enforcement agency with the approval of the Provincial People's Government to exercise administrative penalty powers in a relatively centralized manner.
All units within the scenic area shall be subject to the unified management of the management committee.
Land, forests, etc. that are collectively owned and managed by forestry units shall be managed and protected by their owners or contractors under the guidance of the management committee. Article 6 The Huangshan Municipal People's Government and Management Committee shall build an ecological security system focusing on a virtuous cycle of the ecosystem and effective prevention and control of environmental risks, maintain the stability of the ecosystem in scenic spots and maintain biodiversity and species authenticity.
The Huangshan Municipal People's Government should establish a consultation and coordination mechanism to coordinate the preparation and implementation of plans for land use, resource and environmental management, urban and rural construction, and regulation of low-mountain scenic spots in scenic area protection zones.
The Provincial People's Government, the Huangshan Municipal People's Government, and the Management Committee should establish an ecological compensation mechanism to provide compensation for areas that have been restricted from development to protect Huangshan's scenic resources. Article 7 The construction department of the Provincial People's Government shall organize the preparation of detailed plans for the scenic spots in accordance with the "Master Plan for the Huangshan Scenic Spots", and the specific work shall be undertaken by the Management Committee.
Before the detailed planning of scenic spots is submitted for approval in accordance with the law, it shall be reviewed by the Standing Committee of the Huangshan Municipal People’s Congress. Article 8 It is prohibited to build industrial and mining enterprises in scenic spots; it is prohibited to build or expand office buildings, hotels, hostels, rest and recuperation institutions, and other buildings and structures that have nothing to do with the protection of scenic spots and resources in violation of the planning of scenic spots; original buildings, Structures must be cleaned up and rectified. If they pollute the environment or are an eyesore, they must be dismantled within a time limit or relocated. Within the core scenic area, any project construction unrelated to resource and environmental protection is prohibited.
It is prohibited to store flammable, explosive, toxic, radioactive and corrosive items in scenic spots.
It is prohibited to build factories and facilities that pollute the environment or damage the ecology and landscape within the protection zones of scenic spots.
The construction planning and building design of towns adjacent to scenic spots such as Tangkou Town should be coordinated with the landscape of the scenic spots. Article 9 Construction projects in scenic spots and historic areas shall conduct environmental impact assessments in accordance with the law, and construction projects that do not conduct environmental impact assessments in accordance with the law shall not start construction.
The management committee should formulate the "Measures for the Management of Environmental Impact Assessment of Construction Projects in Huangshan Scenic Area".
Projects that really need to be constructed for protection or management in scenic spots will be reviewed by the management committee based on the approved scenic spot plan, and after review by the Huangshan Municipal People's Government, they will be reported to the construction department of the Provincial People's Government for approval. Other approval procedures shall be handled in accordance with relevant laws and regulations.
The layout and design of the building should be coordinated with the surrounding landscape. During project construction, the scenery and environment around the construction site should be strictly protected.
Environmental engineering supervision should be implemented for larger construction projects.
If temporary construction is indeed necessary due to conservation management and engineering, it must be approved by the management committee. Temporary construction shall be dismantled within the approved period of use.
