Shaanxi Province Huashan Scenic Area Regulations

Chapter 1 General Provisions Article 1 In order to strengthen the protection and management of Huashan Scenic Area and make reasonable use of scenic resources, these Regulations are formulated in accordance with the "Regulations on Scenic Areas" of the State Council and in combination with the actual situation of Huashan Scenic Area. Article 2 These Regulations shall apply to the planning, construction, protection, utilization and management of Huashan Scenic Area.

The specific scope of Huashan Scenic Area and its peripheral protection zones is determined in accordance with the "Huashan Scenic Area Master Plan" approved by the State Council. Article 3 Huashan Scenic Area follows the principles of scientific planning, unified management, strict protection, and sustainable utilization. Article 4 The administrative department of housing and urban-rural development of the Provincial People's Government is responsible for the supervision and management of Huashan Scenic Area. Article 5 The Weinan Municipal People's Government shall strengthen its leadership over the work of the Huashan Scenic Area and incorporate the protection and construction of the Huashan Scenic Area into the city's national economic and social development plan.

The Huashan Scenic Area Management Agency established by the Weinan Municipal People's Government is specifically responsible for the protection, utilization and unified management of the Huashan Scenic Area. Article 6 The main responsibilities of the Huashan Scenic Area Management Agency are:

(1) Promote and implement laws and regulations related to the protection and management of scenic areas;

(2) Participate in the preparation And organize the implementation of the overall plan and detailed plan of Huashan Scenic Area;

(3) Formulate and organize the implementation of specific protection and management systems for Huashan Scenic Area;

(4) Organize the Huashan Scenic Area Survey, evaluation, and registration of resources, and carry out external image planning and publicity and tourism promotion;

(5) Protect the landscape and ecological environment of Huashan Scenic Area;

(6) Construction, Maintain and manage the infrastructure and public facilities of Huashan Scenic Area;

(7) Responsible for tourism safety, market order, scenic environment and sanitation management of Huashan Scenic Area;

(8) Responsible for the supervision and management of construction projects and related activities in Huashan Scenic Area;

(9) Other responsibilities assigned by the Weinan Municipal People's Government. Article 7 The Huayin Municipal People's Government is responsible for the construction and management of the peripheral protection zones of Huashan Scenic Area.

Other county-level people's governments around the Huashan Scenic Area should make practical use of Huashan Scenic Area resources to develop tourism and promote county economic development. Chapter 2 Planning Article 8 Construction, protection, utilization, management and other related activities in the Huashan Scenic Area and its peripheral protection zones shall comply with the Huashan Scenic Area Plan. Article 9 The planning of the Huashan Scenic Area is divided into an overall plan and a detailed plan, and the provincial housing and urban-rural development administrative department is responsible for organizing the preparation. The overall plan of Huashan Scenic Area shall be submitted by the Provincial People's Government to the State Council for approval; the detailed plan shall be submitted by the provincial administrative department of housing and urban-rural development to the administrative department of housing and urban-rural development of the State Council for examination and approval.

The provincial housing and urban-rural development administrative department shall announce the approved Huashan Scenic Area plan to the public. Article 10 The overall plan of Huashan Scenic Area shall include the following contents:

(1) Scenic resource evaluation;

(2) Measures for the protection of ecological resources and cultural relics, layout and development of major construction projects Utilization intensity;

(3) Functional structure and spatial layout of scenic spots;

(4) Scope of prohibited development and restricted development;

(5) The tourist capacity of scenic spots;

(6) Relevant special planning.

The detailed planning of Huashan Scenic Area should be prepared according to the different requirements of core scenic spots and other scenic spots, determine the location, layout and scale of infrastructure, tourism facilities, cultural facilities and other construction projects, and clarify the scope of construction land and planning and design conditions.

The detailed planning of Huashan Scenic Area shall comply with the overall plan of Huashan Scenic Area. Article 11 Once approved, the overall plan and detailed plan of Huashan Scenic Area shall not be modified without authorization.

The scope, nature, protection objectives, ecological resource protection measures, layout of major construction projects, development and utilization intensity of the Huashan Scenic Area master plan, as well as the functional structure, spatial layout, and tourist capacity of the scenic area do need to be modified. If any other content really needs to be modified, it should be reported to the original examination and approval authority for record.

If the detailed planning of Huashan Scenic Area really needs to be revised, it must be reported to the original approval authority for approval. Article 12 When the Huayin Municipal People's Government prepares urban planning and approves rural planning involving the Huashan Scenic Area and its peripheral protection zones, it shall comply with the planning requirements of the Huashan Scenic Area and seek written opinions from the Huashan Scenic Area management agency. Chapter 3 Construction Article 13 The construction of Huashan Scenic Area and its peripheral protection zones shall be carried out in accordance with the planning of Huashan Scenic Area. Except for necessary protection facilities and ancillary facilities, no other facilities may be built in important scenic spots in Huashan Scenic Area. Article 14 It is prohibited to violate the planning of the Huashan Scenic Area by setting up various development zones, industrial and mining enterprises in the Huashan Scenic Area, and constructing hotels, hostels, training centers, sanatoriums, and other buildings that have nothing to do with the protection of scenic resources in the core scenic area. Structures; those that have been built should be gradually moved out in accordance with the Huashan Scenic Area Plan.

No construction projects that pollute the environment shall be established within the Huashan Scenic Area and its peripheral protection zones; if they have been constructed, the Huashan Scenic Area Management Agency or the Huayin Municipal People's Government shall order them to be demolished within a time limit.
