Interim Measures for the Administration of Self-funded Travel Abroad by Chinese Citizens

Article 1: In order to strengthen the management of Chinese citizens traveling abroad at their own expense, regulate overseas tourism activities, and protect the legitimate rights and interests of tourists, in accordance with the "Exit and Entry Administration Law of the People's Republic of China" and Its implementation rules and the "Travel Agency Management Regulations" and its implementation rules are formulated to formulate these measures.

Article 2 Chinese citizens traveling abroad at their own expense are mainly conducted in groups. A team refers to an overseas travel group of three or more people (hereinafter referred to as the team) organized by a travel agency with operating rights. The destination countries and regions for overseas tourism shall be proposed by the National Tourism Administration in conjunction with the Ministry of Foreign Affairs and the Ministry of Public Security and submitted to the State Council for approval.

Article 3 Chinese citizens’ overseas travel at their own expense must be developed in an organized, planned and controlled manner. In accordance with the "Travel Agency Management Regulations" and the inbound tourism performance of travel agencies, the National Tourism Administration shall review and approve travel agencies that franchise Chinese citizens' self-financed overseas travel business (hereinafter referred to as tour groups), file a case with the Ministry of Public Security, and announce it to the public. Unapproved units and individuals are not allowed to operate this business.

Article 4 The National Tourism Administration shall, in accordance with the principle of total volume control, determine the number of people it organizes to travel abroad in groups based on a certain proportion of the number of inbound tourists accepted by tour groups, and uniformly print and number the "Chinese Citizens' Own Expenses" Overseas Travel Approval Certificate" (hereinafter referred to as the "Audit Certificate"). One copy of the "Audit Certificate" per person, in triplicate.

Article 5: The tour group organizer organizes groups according to the number of overseas travel quotas approved by the National Tourism Administration, handles registration, payment and other procedures for tourists, and fills in the "Audit Certificate". The content of the "Audit Certificate" includes the basic information of the tour participants, team name, tour route, charging standard and actual payment amount, etc.

Article 6 The "Audit Certificate" shall be stamped with an audit seal after being verified by the National Tourism Administration or the local provincial tourism administrative department. One copy will be retained by the tourism administrative department responsible for review, one copy will be handed over to the public security agency by the tourist participants for review, and one copy will be kept by the organizing agency. Without a qualified "Audit Certificate", the public security organs will not handle the procedures for traveling abroad.

Article 7. After registering with the tour group and paying the full fee, participants must hold their own documents in accordance with the relevant provisions of the "Exit and Entry Administration Law of the People's Republic of China" and its implementation rules. ID card, household registration book or other household registration certificate, submit the opinions of the work unit on the departure of tourists to the public security authority in the place of household registration, and at the same time submit the "Audit Certificate" issued by the tourism administrative department and the full travel fee issued by the organizing agency invoice.

Article 8 The public security organs should check the "Audit Certificate" and fee invoices submitted by the tour participants, and after confirming the legal qualifications of the group organizing agency and the tour participants, go through the procedures for traveling abroad in accordance with relevant laws and regulations. A decision of approval or disapproval shall be made within the legal time limit and all participants shall be notified. If a tourist is approved to leave the country, the exit and entry administration department of the public security organ will issue a passport and attach an exit registration card.

Article 9 The National Tourism Administration shall uniformly print the "List of Chinese Citizens' Self-funded Overseas Travel Groups" (hereinafter referred to as the "List"), and issue the number to the organizing agency. The organizing agency shall fill in the form truthfully and have it stamped with a verification seal after being verified by the National Tourism Administration or the provincial tourism administrative department. "List" in triplicate. When leaving the country, the first and second border inspection stations will be inspected and will not be released if there is no "list" or the actual departure of the person does not match the registration status of the "list". After the border inspection station notes the actual number of people on the "List" and stamps the verification stamp, the first copy will be kept; the second copy will be temporarily kept by the team leader and will be handed over to the border inspection station for verification and storage when the team enters the country.
