Yunnan Provincial Population and Family Planning Regulations (2022 revision)

Article 1 In order to achieve the coordinated development of population, economy, society, resources and environment, promote family planning, safeguard the legitimate rights and interests of citizens, and promote family happiness, national prosperity and social progress, according to the "People's Republic of China* **The Population and Family Planning Law of the People's Republic of China" and other relevant laws and administrative regulations are formulated in conjunction with the actual conditions of this province. Article 2 These regulations apply to citizens, legal persons and other organizations within the administrative area of ??this province, as well as citizens whose household registration is in this province but who have left the administrative area of ??this province. Article 3 Citizens have the right to have children, and they also have the obligation to implement family planning in accordance with the law. Both husband and wife have equal responsibilities in implementing family planning. Article 4: Promote age-appropriate marriage and childbearing, and good health and education. A couple can have three children. Article 5 People's governments at all levels shall lead the population and family planning work within their respective administrative regions. Family planning work implements a target management responsibility system.

Health administrative departments at or above the county level are responsible for population and family planning work within their respective administrative regions. Other relevant departments shall carry out relevant population and family planning work in accordance with their respective responsibilities.

Trade unions, the Communist Youth League, women's federations, family planning associations and other social groups, enterprises, institutions and citizens should assist the people's government in carrying out population and family planning work.

Village (resident) committees should carry out family planning work in accordance with the law and incorporate family planning work into the content of village (resident) autonomy. Article 6 People's governments at all levels shall include population and family planning funds in the general public fiscal budget and gradually increase them based on economic and social development.

People's governments at all levels should provide key support for family planning work in ethnic minority areas, border areas, and underdeveloped areas.

Enterprises, institutions and other organizations should allocate funds to ensure the development of family planning work.

It is prohibited to withhold, deduct or misappropriate family planning funds. Article 7 People's governments at all levels shall commend and reward units and individuals that have made outstanding achievements in population and family planning work in accordance with relevant national and provincial regulations. Article 8 People's governments at or above the county level shall scientifically prepare population development plans for their respective administrative regions, incorporate them into national economic and social development plans, and formulate and organize the implementation of population and family planning implementation plans.

The health administrative departments at or above the county level are responsible for the daily work of population and family planning implementation plans.

The township (town) people's government and sub-district offices are responsible for the specific implementation of the population and family planning implementation plan.

People's governments at all levels should establish and improve a comprehensive population and family planning information system and be responsible for the collection and management of relevant information. Article 9 People's governments at all levels should improve family planning service mechanisms, improve service management levels, strengthen reproductive health services, prevent and reduce birth defects, and ensure that the people enjoy basic family planning services. Article 10: Departments of health, judicial administration, education, science and technology, culture and tourism, civil affairs, ethnic and religious affairs, radio and television, etc. shall organize and carry out publicity and education on population and family planning.

Public *** media should carry out social publicity on population and family planning work.

Schools should carry out family planning national policy education, physiological hygiene education, puberty education and sexual health education to students in a manner that is consistent with the age and psychological characteristics of the educated. Article 11 Government agencies, enterprises, institutions, social groups and other organizations shall carry out family planning work and accept the guidance and management of the local township (town) people's government and sub-district offices. Article 12 The family planning work for floating population shall be jointly responsible for the people's government of the place where they have their registered permanent residence and the place of their current residence, with the people's government of the place of their current residence taking the lead and the people's government of the place of their registered residence providing cooperation.

People's governments at all levels should incorporate family planning services and management for floating populations into the target management responsibility system for family planning work within their respective administrative regions. Governments, enterprises, institutions, social groups and other organizations should have full-time (part-time) staff to manage the family planning work of their units, and may set up family planning agencies according to work needs.

The remuneration of floating population family planning administrators and family planning propagandists shall be included in family planning funds by finance at all levels. The remuneration of family planning attendants is the responsibility of the county (city, district), township (town) people's government and sub-district office, and the village (neighborhood) committee may provide subsidies. Article 14: The health administrative department shall make public the regulations and procedures for family planning.

The township (town) people's government, sub-district offices and village (resident) committees should establish a family planning publicity system and accept social supervision. Article 15: Education, public security, civil affairs, health, medical insurance, human resources and social security and other departments should do a good job in sharing basic information on population services.

Article 16 If a couple gives birth to a child, before the child is born or within one year after the child is born, they must go to the township (town) people's government, sub-district office or village (resident) committee where one party has their household registration or current residence to handle the childbirth. Register and receive the "Maternity Service Certificate".
