Chapter 1 General Provisions Article 1 In order to strictly protect, unified management, rational development and sustainable utilization of scenic spots resources, accelerate the construction of scenic spots and promote economic and social development, in accordance with relevant laws and regulations, combined with Yunnan actually formulates these regulations. Article 2 These regulations apply to all types of scenic spots at all levels within the administrative region of our province. Article 3 The scenic spots mentioned in these regulations refer to scenic spots with relatively concentrated resources, consisting of several scenic spots, beautiful environment, with a certain scale, named and demarcated by the people's government at or above the county level, and used for sightseeing, viewing or scientific research. Area of ??cultural activities.

The scenic resources mentioned in these regulations refer to natural scenery and cultural scenery with ornamental, cultural or scientific value. Article 4 Various development zones, resorts, etc. shall not be established in scenic spots. The areas where development zones, resorts and scenic spots intersect with scenic spots and various parks and amusement parks established before the implementation of this Regulation shall implement this Regulation and the relevant laws and regulations on the management of scenic spots.

The areas that intersect with scenic spots, nature reserves and cultural relics protection units shall be unified planned by the people's governments at or above the county level, with clear division of responsibilities and good management. Article 5 People’s governments at or above the county level shall strengthen leadership over the management of scenic spots.

The provincial construction administrative department is responsible for the work of scenic spots in the province; the prefecture, state, city and county construction administrative departments are responsible for the work of scenic spots within their own administrative regions in accordance with the responsibilities specified in these regulations.

The tourism, culture, religion, transportation, industry and commerce, public security, agriculture and forestry, water conservancy, environmental protection, land and other departments shall, in accordance with their respective responsibilities, cooperate with the construction administrative department and the scenic spot management agency to manage the scenic spots. Article 6 A scenic spot or scenic spot shall establish a unified management agency to exercise the management functions stipulated in these regulations and granted by the people's government at or above the county level, be fully responsible for the planning, protection, utilization and construction of a scenic spot or scenic spot, and accept the instructions of the construction administrative department. Management and guidance. Article 7 Units and individuals that have made outstanding achievements in the protection, planning, construction and management of scenic spots shall be commended and rewarded by the people's government at or above the county level or the construction administrative department. Chapter 2 Establishment and Planning Article 8 To establish a scenic spot, the scenic spot resources shall be investigated and evaluated first to determine their resource status, characteristics and value.

In accordance with relevant national regulations, scenic spots are divided into three levels according to their ornamental, cultural, scientific value, environmental quality, scale, etc.: national key scenic spots, provincial scenic spots, cities and counties level scenic spot. Article 9 The investigation and evaluation of scenic and historic resources shall be organized by the construction administrative department. National key scenic spots, provincial-level scenic spots and city- and county-level scenic spots are reviewed and announced in accordance with relevant national and provincial regulations.

After the scenic spot is approved and announced, if it needs to be upgraded due to changes in circumstances, it shall be re-examined in accordance with the prescribed procedures; if it should be downgraded or revoked, the construction administrative department shall submit it to the original approval authority for approval. Article 10: After the scenic spots are approved and announced, plans shall be prepared in a timely manner. Scenic area planning is divided into overall planning and detailed planning.

The preparation of scenic spot plans should be undertaken by units with corresponding planning and design qualifications. Scenic area planning shall organize technical appraisal and approval in accordance with relevant national and provincial regulations. Article 11 The approved planning of scenic spots must be strictly implemented, and no unit or individual may change it without authorization. If changes are really needed, they must be submitted separately for approval according to prescribed procedures. Chapter 3 Protection Article 12 Scenic and historic areas shall maintain their original natural and historical features.

Scenic and historic area management agencies should be equipped with specialized personnel, improve the protection system, and implement protection measures. Protection instructions and signboards should be installed at the entrances of scenic spots and related scenic spots.

All units, residents and tourists entering the scenic area must abide by the various management regulations of the scenic area, care for the scenery and facilities, protect the environment, and must not damage the scenic resources or arbitrarily change them. form. Article 13 Scenic and historic areas and their peripheral areas shall be subject to three levels of protection based on their landscape value and protection needs, with each tourist area as the core.

(1) The first-level protected area is the core protected area, which refers to various tourist areas directly for people to visit and watch, as well as other areas that need special protection.

(2) The second-level protected area is a landscape protected area, which refers to the area within the scope of the scenic spot and outside the scope of the first-level protected area.

(3) The third-level protected areas are peripheral protected areas.

The scope of first-, second- and third-level protected areas shall be defined by the people's government of the city or county where they are located based on the approved scenic area plan, and boundary posts shall be erected to mark them. Article 14 Scenic and historic resources and scenic lands owned by the state shall not be transferred in any name or manner or in any disguised form.

Units and facilities built in scenic areas that affect the protection of scenic resources must be moved out within the prescribed period. Article 15 Scenic and historic areas shall establish and improve rules and regulations for tree planting and greening, mountain closure for afforestation, forest protection and fire prevention, and prevention and control of forest diseases and insect pests, so as to protect the plant ecological environment.

It is prohibited to cut down trees in scenic spots.

If thinning and renewal are really needed, the approval of the scenic area management agency must be obtained, and the approval procedures must be completed in accordance with regulations.

After investigation and identification of ancient and famous trees in scenic spots, they should be registered, archives established, protection instructions set up, strictly protected, and felling and transplanting are strictly prohibited.

Collecting specimens, wild medicinal materials, etc. in scenic spots must be approved by the scenic spot management agency and the relevant procedures must be completed in accordance with regulations before collection can be done at fixed points and in limited quantities, and trees and landscapes must not be damaged.
