Jiangxi Tourism Regulations (20 15)

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of tourists, tour operators and their employees, protect and rationally utilize tourism resources, standardize the order of the tourism market, promote the sustained and healthy development of tourism, and promote the construction of a strong tourism province, these Regulations are formulated in accordance with the provisions of the Tourism Law of the People's Republic of China and relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the compilation of tourism planning, the protection, development and utilization of tourism resources, the operation and service of tourism, the development of tourism activities and the implementation of tourism supervision and management within the administrative region of this province. Article 3 The development of tourism should highlight local characteristics, adhere to the principles of government guidance, social participation, market operation and industry self-discipline, and realize the integration of urban and rural tourism, red tourism, green tourism, antique tourism, sightseeing tourism and holiday and leisure tourism, and realize the unity of social, economic and ecological benefits. Article 4 People's governments at or above the county level shall strengthen the organization and leadership of tourism development within their respective administrative areas, incorporate tourism development into national economic and social development plans, establish and improve comprehensive coordination and incentive mechanisms for tourism, increase investment and support for tourism, improve policies and measures to promote tourism development, standardize tourism management, optimize tourism development environment and promote tourism development.

The provincial people's government should strengthen the publicity of the overall image of tourism in this province, promote the construction of regional tourism integration and the transformation of tourism product structure, formulate tourism industry policies, cultivate tourism pillar industries, improve the comprehensive coordination mechanism of tourism, improve the supervision and management system of tourism quality, and promote the coordinated development of major tourism projects and key regions. Article 5 The tourism authorities of the people's governments at or above the county level shall be responsible for the comprehensive coordination, industrial promotion, public service, supervision and management of tourism within their respective administrative areas.

The people's governments at or above the county level shall be responsible for development and reform, industry and information technology, finance, transportation, housing and urban and rural construction, land and resources, agriculture, forestry, water conservancy, ethnic and religion, industry and commerce, quality and technical supervision, public security, production safety supervision, education, culture, science and technology, radio, film and television, press and publication, environmental protection, health and family planning, and commerce. Do a good job in tourism according to their respective responsibilities. Article 6 People's governments at all levels shall carry out publicity and education on civilized tourism, advocate and cultivate healthy, low-carbon, green and civilized tourism modes, and raise public awareness of civilized tourism.

Tourism operators and their employees shall publicize the norms of civilized tourism behavior to tourists in tourism business activities, and guide tourists to travel healthily and civilized. Seventh tourism industry organizations established according to law shall formulate industry norms, implement self-discipline management, and promote the construction of tourism integrity. Chapter II Rights and Obligations of Tourists Article 8 The legitimate rights and interests of tourists are protected by law, and no unit or individual may infringe upon them.

The elderly, the disabled, minors, active servicemen and full-time students enjoy convenience and preferential treatment in tourism activities in accordance with laws, regulations and relevant provisions. Ninth tourists enjoy the following rights in tourism activities:

(a) to enjoy the true and complete right to know about the qualifications of tourism operators, related tourism products and services and prices;

(two) to choose tourism operators and service methods independently, to choose tourism projects and commodities independently, and to refuse the compulsory trading behavior of tourism operators;

(three) require the tour operators to sign a written contract according to law and fully perform the contract;

(four) personal and property safety and health conditions are guaranteed;

(five) personal dignity, customs and religious beliefs are respected according to law, and personal information is protected according to law;

(six) when the legitimate rights and interests are damaged, the right to compensation according to law;

(seven) other rights stipulated by laws and regulations or stipulated in the travel contract. Tenth tourists should fulfill the following obligations in tourism activities:

(1) Abide by laws, regulations, rules, public order and social morality, and respect the cultural traditions, customs and religious beliefs of tourist destinations;

(two) comply with the provisions of the traffic, health, safety and other tourism management;

(three) care for places of interest, cultural relics and tourist facilities;

(four) in order to safeguard their own rights and interests, they shall not interfere with the normal tourism business activities;

(five) in the event of force majeure and emergencies, assist and cooperate with relevant departments, institutions or tour operators to take safety precautions and emergency measures;

(six) other obligations stipulated by laws and regulations or stipulated in the travel contract.

Outbound tourists are not allowed to stay illegally outside the country, and tourists who leave the country with the group are not allowed to join or leave the group without authorization. Eleventh tourists and tour operators dispute or think their legitimate rights and interests have been violated, can be resolved through the following channels:

(1) Both parties negotiate;

(two) to apply for mediation by tourism industry organizations and consumer rights protection organizations;

(three) complaints to the tourism, industry and commerce administration, price and other relevant departments;

(four) if there is an arbitration clause in the travel contract or a written arbitration agreement is reached afterwards, apply to an arbitration institution for arbitration;

(5) bring a lawsuit to the people's court. Chapter III Tourism Planning and Resource Protection Article 12 People's governments at or above the county level shall, according to the requirements of national economic and social development planning, organize the formulation of local tourism development planning.

Tourism development planning should be linked with urban and rural planning, overall land use planning, transportation planning, environmental protection planning and protection and utilization planning of natural resources and cultural relics, and coordinated with the planning of scenic spots, nature reserves, geological parks, geological relics protection areas, cultural and ecological protection areas, forest parks, wetland parks, historical and cultural cities, towns and villages. Other relevant planning should take into account the tourism function and tourism development.
