Chapter 1 General Provisions Article 1 In order to strengthen the management of scenic spots and effectively protect and rationally utilize scenic spots resources, in accordance with the "Regulations on Scenic Spots" of the State Council and relevant laws and administrative regulations, combined with the provisions of Sichuan Province Actually, this regulation is enacted. Article 2 These Regulations shall apply to the establishment, planning, protection, construction, utilization and management of scenic spots within the administrative region of Sichuan Province. Article 3 The management of scenic and historic areas shall implement the principles of scientific planning, unified management, strict protection, and sustainable utilization. Article 4 Local people's governments at or above the county level shall incorporate the protection and utilization of scenic and historic resources into national economic and social development plans and urban and rural planning, strengthen the management of scenic spots, and realize the harmonious development of man and nature. Article 5 The construction administrative department of the provincial people's government is responsible for the supervision and management of scenic spots throughout the province; the construction administrative departments of the municipal (prefecture) and county people's governments are responsible for the supervision and management of scenic spots within their respective administrative regions.

Other relevant departments of the local people's governments at or above the county level shall be responsible for the relevant supervision and management of scenic spots in accordance with the division of responsibilities.

The funds required for the establishment, planning, protection, construction and management of scenic spots are included in the department's comprehensive budget. Article 6 The local people's government at or above the county level where a national-level or provincial-level scenic spot is located shall set up a scenic spot management agency to be responsible for the protection, utilization and unified management of scenic spots.

The establishment of management agencies for scenic spots across administrative regions in the province shall be determined by the construction administrative department of the Provincial People's Government in conjunction with relevant departments in accordance with regulations. Article 7: Any unit or individual has the obligation to protect scenic and historic resources, and has the right to discourage, report, and accuse acts that damage scenic and historic resources. Article 8 The local people's government at or above the county level where the scenic area is located and the administrative agency of the scenic area shall provide support, assistance and care for the production and life of the indigenous residents in the scenic area. Chapter 2 Establishment Article 9 Scenic spots are divided into national-level scenic spots and provincial-level scenic spots.

If natural landscapes and cultural landscapes can reflect important natural changes and major historical and cultural development processes, are basically in a natural state or maintain their historical original appearance, and are nationally representative, apply for the establishment of a national-level scenic spot; if they are regionally representative If necessary, apply for the establishment of a provincial-level scenic spot. Article 10 The application for national and provincial scenic spots shall be handled in accordance with the provisions of the "Regulations on Scenic Spots" of the State Council.

Newly established scenic spots and nature reserves shall not overlap or intersect; if already established scenic spots and nature reserves overlap or intersect, the planning, protection, construction and management of scenic spots and nature reserves shall be coordinated. Article 11 After the establishment of a scenic spot is approved and announced, the management agency of the scenic spot shall establish an entrance sign at the main entrance of the scenic spot and erect stakes according to the approved scope to mark the boundaries of the area.

The content of entrance signs and logo patterns of national scenic spots shall be approved and published by the construction administrative department of the State Council.

The content of entrance signs and logo patterns of provincial scenic spots shall be approved and announced by the construction administrative department of the Provincial People's Government. Chapter 3 Planning Article 12 After the establishment of a scenic spot is approved, a scenic spot plan shall be prepared in accordance with the law. Scenic area planning is divided into overall planning and detailed planning. Article 13 The preparation of the overall plan for scenic spots shall reflect the requirements of harmonious coexistence between man and nature, coordinated regional development and comprehensive economic and social progress, adhere to the principle of giving priority to protection and subordinate development to protection, and highlight the natural characteristics and cultural connotation of scenic spots resources. and local characteristics.

The overall planning of scenic spots should include the following contents:

(1) Scenic resource evaluation;

(2) Ecological resource protection measures, layout of major construction projects, Intensity of development and utilization;

(3) Functional structure and spatial layout of scenic spots;

(4) Scope of prohibited development and restricted development;

(5) ) Visitor capacity of scenic spots;

(6) Relevant special planning.

A scenic area shall prepare a master plan within 2 years from the date of its establishment. The planning period of a master plan is generally 20 years.

The overall planning of scenic spots and historic areas shall conduct environmental impact assessment in accordance with the law. Article 14 Detailed planning of scenic spots shall be prepared based on the different requirements of core scenic spots and other scenic spots, determine the location, layout and scale of infrastructure, tourist facilities, cultural facilities and other construction projects, and clarify the scope of construction land and planning and design conditions.

The detailed planning of the scenic area shall conform to the overall planning of the scenic area. Article 15 The preparation of the overall plan for scenic spots shall be consistent with the national economic and social development plan, urban and rural planning, and land use overall plan, and shall comply with relevant national technical specifications and standards.

The planning of towns, townships and villages in scenic spots and scenic spots should be coordinated with the planning of scenic spots. Article 16 The planning of national-level scenic spots shall be organized and compiled by the construction administrative department of the provincial people's government; the planning of provincial-level scenic spots shall be organized and compiled by the local people's government at the county level.

The planning of scenic spots across administrative regions shall be organized and prepared by the people's government that applies for the establishment of scenic spots or its construction administrative department.
