According to the Contract Law of the People's Republic of China, Road Transport Regulations of the People's Republic of China, Interim Measures for the Administration of Standard Clauses Contracts in Xinjiang Uygur Autonomous Region and relevant laws and regulations on tourism management, in order to ensure the safety and smoothness of tourism transportation and safeguard the legitimate rights and interests of Party A, Party B and tourists. Based on the principles of equality, voluntariness, honesty and credit, mutual benefit and cooperation, and * * * taking risks, the following contracts are signed through consultation:

1. This contract is the main contract for travel agencies to rent passenger vehicles from tourist car service companies or passenger limited companies instead of tourists, that is, the long-term car rental contract (valid from: year, month, day to year, month, day). If one party cancels its registration or its business license is revoked by the industrial and commercial department, it shall notify the other party in writing in time, and this contract will automatically become invalid. The specific contents and requirements of each car use shall be subject to the Confirmation Sheet for Tourist Cars and its annexes, which shall be the annexes and settlement basis of this contract.

third, the tourist bus to which Party A belongs must have a valid driving license, a Road Transport Certificate issued by the transportation management department, a (tourist) charter sign and other tourist passenger operation procedures, and the passenger vehicle should be fully insured according to the regulations (carrier liability insurance (the amount of insurance for each seat is not less than 1, yuan)).

Fourth, the service standard of tourist bus and bus driver provided by Party A should conform to the Regulations of the Ministry of Communications on the Employment of Road Transport Personnel (. In 1995, bus drivers were required to hold the Qualification Certificate for Road Transporters issued by the transportation management department, the Certificate for Tourist Car Drivers issued by the post training steering committee of Xinjiang Uygur Autonomous Region Tourism Bureau, and the Certificate for Tourist Car Drivers issued by the post training steering committee of Xinjiang Uygur Autonomous Region Tourism Bureau. The provided tourist buses should be clean and tidy, and the in-car audio and other equipment can be used normally.

5. The tourist bus provided by Party A must be delivered to Party B for use on time at the designated time and place. If there is any delay due to Party A's own reasons, such as the passenger car itself breaks down and needs to be replaced, which will affect the normal trip and cause the scenic spots not to be visited, Party A will bear the related expenses.

VI. The procedure for Party B to use the car is: Party B will send the team itinerary to Party A by fax, and after negotiation, both parties will sign the "Confirmation Sheet for Tourist Car". After the tour team's trip is over, if the bus driver has no complaints about the service quality, he/she shall go to Party B to settle the related freight with this Confirmation Form for Tourist Cars, its attachments and invoices. Both sides should do one car, one regiment and one clearing. Party B shall not unreasonably delay the payment of the agreed fare, otherwise Party A may report to the competent authorities of the industry, and the competent authorities of the industry will issue a warning to Party B for three consecutive times, and will list Party B as dishonest for more than five times and announce it to the public.

VII. Once this contract is signed, both parties shall strictly abide by it. If it is necessary to cancel the Confirmation Sheet for Tourist Cars for some reason, the entry-exit team should notify the other party in writing 72 hours ago and the domestic team should notify the other party 36 hours ago, and the exemption can only be obtained after the other party confirms it. Otherwise, it will be regarded as a breach of contract, and the defaulting party will pay the other party% of the original total freight of the group as liquidated damages.

VIII. The bus driver provided by Party A for Party B should have good professional ethics and safety skills. The bus driver should be destined to cooperate with Party B's tour guide to do a good job in service. If there is any contradiction between the two parties, they should settle it through consultation and avoid class as much as possible. Party A's bus driver should not abandon the group without authorization for any reason, otherwise all the losses caused will be borne by Party A and announced to the public as dishonest behavior.

9. During driving, both parties shall drive according to the route agreed in the contract, and shall not change the itinerary and route at will, otherwise the breaching party shall be responsible for the consequences. If it is really necessary to change the itinerary, the driver shall be arranged to have a rest after consultation by both parties, even if the change record is supplemented and recognized.

1. If the trip cannot be completed or delayed due to force majeure, such as landslide, debris flow, strong wind, dust, heavy snow, flood, long-term traffic jam or traffic restriction by the traffic police department, the losses caused shall be borne by both parties through negotiation.

Xi. If the bus driver of Party A and the tour guide of Party B encounter any situation that may cause damage to the tourists' personal or property during the operation of the tour team, they should give a true explanation and clear warning to the tourists, obtain their written confirmation, take appropriate safety measures according to the instructions of the travel agency, and properly keep relevant evidence.

12. If the loss of luggage and articles is the responsibility of the bus driver of Party A, Party A to which the bus belongs shall pay the tourists' emergency in advance according to each piece of luggage 8 yuan, which shall be signed and confirmed by the bus driver and the on-board tour guide. Regarding the baggage compensation, Party B shall assist the tourists to handle the corresponding compensation matters according to the relevant insurance procedures, and deduct the prepaid expenses.

XIII. In order to ensure safety, Party B must provide and bear the corresponding accommodation expenses for Party A's bus drivers, of which the accommodation is an ordinary standard room (especially Party B shall not arrange for Party A's drivers to live in groups in Turpan, Brzin and Kanas)

XIV. In order to ensure the safety of tour guides, all large tourist vehicles with more than 3 seats must be equipped with special seats for tour guides (that is, blue seat covers, outside the back of early drivers) supervised by the Tourism Law Enforcement Corps of Xinjiang Uygur Autonomous Region.

Fifteenth, the individual group must arrange the seating order of tourists in advance, and reserve 1-2 empty seats for emergency use. Party B shall clearly inform Party A of the fixed boarding and alighting places for bus drivers and tourists, and Party A shall ensure that the provided tourist vehicles arrive at the designated places on time.

XVI. In case of an accidental traffic accident, which causes personal injury or property loss to tourists, the advance payment for rescuing tourists shall be made as follows according to the specific circumstances:

(1) If the bus driver of Party A is fully responsible for the accident, Party A shall fully pay the medical assistance expenses of tourists, and Party B shall assist in the rescue.

(2) The release of the accident was caused by a third party. If Party A and Party B are not responsible, the third party will pay the full cost of rescuing tourists first. If the third party cannot cash in, Party A and Party B will share the rescue cost first and then claim compensation from the third party.

(3) If the accident is caused by both Party A and a third party, Party A and the third party shall pay all the expenses for rescuing tourists in advance according to the proportion of responsibilities divided by relevant departments or the proportion negotiated, and Party B shall assist in the rescue.

(4) If the accident is caused by Party B, Party B shall fully pay the tourists' medical assistance expenses.

All the above compensation fees shall be recovered by the responsible party identified in traffic accident responsibility confirmation or the Civil Judgment and Civil Ruling of the appointed court. After the occurrence of medical assistance and property losses, the compensation demanded by tourists shall be settled through consultation between Party A and Party B; if negotiation fails, it shall be settled through mediation by the traffic police department at the place where the accident occurred; if the settlement fails, it can be settled through judicial channels. After the accident, both parties should report the case to the insurance company in time to get the corresponding compensation.

XVII. Any dispute arising from the performance of this contract shall be settled through negotiation by both parties on the principle of honesty, long-term cooperation and risk-bearing. If the negotiation fails, it can also be coordinated by the local tourism administrative department, the road transport administrative department and the industrial and commercial administrative department; If negotiation or mediation fails, it shall be settled in the following way:

(1) Submit it to the Arbitration Commission for arbitration;

(2) bring a lawsuit to people's court according to law.

XVIII. this contract is made in duplicate, with each party holding one copy.
