Notice of the National Tourism Administration on Printing and Distributing the Trial Measures for the Overtime Allowance for Translation Guides of Travel Agencies

Article 1 A travel agency that implements the Trial Measures for Overtime Subsidies for Translators and Tour Guides of Travel Agencies (hereinafter referred to as the Trial Measures) must meet the following conditions:

(1) China Travel Agency Head Office, China Travel Agency Head Office, China Youth Travel Agency Head Office and their local branches officially approved by the National Tourism Administration;

(2) It meets the provisions of Article 2 of the Interim Regulations on the Administration of Travel Agencies and has the special foreign exchange income of "escort service fee" stipulated by the state;

(three) the reception task is heavy, and the translation guide can't arrange a compensatory time off after the tour. Article 2 If the translation tour guide stays with him for more than eight hours on the same day, the allowance per person per day shall not exceed one yuan and fifty cents, and the annual per capita allowance shall not exceed one hundred and eighty yuan. Article 3 In order to encourage the logistics personnel to cooperate with the front-line translation tour guide work, a part (generally not more than 30%) can be drawn from the overtime allowance fund and paid to the logistics personnel. However, the actual annual per capita payment should be lower than that of the first-line translation guides, so that the logistics personnel can keep a necessary gap with the first-line personnel in the allocation of overtime allowance funds, and the actual payment should not exceed 30% of the total actual payment of the enterprise in that year (the actual payment = the actual payment of the translation guides ÷ 70%). Article 4 Those who join the group within eight hours of the holidays stipulated by the state shall be paid overtime wages in accordance with the provisions of the state, and those who exceed eight hours on the same day shall be paid overtime allowance; On public holidays, it is generally necessary to arrange shifts to rest. If you can't change your rest, you can plan to pay overtime pay, which will be charged from the overtime subsidy fund without overtime pay. The amount of the above overtime pay may not be limited by the "annual average per capita not exceeding 180 yuan" stipulated in Article 2. However, when calculating overtime pay, the per capita overtime days on public holidays in the whole year shall not exceed 25 days at most. Article 5 Travel agencies shall extract a certain proportion of the accompanying labor expenses paid by tourists who come to China at their own expense as overtime subsidy funds, which shall be managed as special funds and charged to the cost. Calculated on an annual basis, the proportion of service fee shall not exceed 10% in hot tourist cities, 1 1% in warm tourist cities, 12% in cold tourist cities, and all kinds of cities. Sixth travel agencies in the implementation of these measures, should be based on the principle of distribution according to work and the local actual situation, formulate specific implementation measures. China Travel Agency Head Office, China Travel Agency Head Office and China Youth Travel Agency Head Office shall be reported to the National Tourism Administration for the record, and local branches shall be reported to the tourism bureaus of the provinces, autonomous regions and municipalities directly under the Central Government for the record. Article 7 The tourism bureaus of all provinces, autonomous regions and municipalities directly under the Central Government shall guide, inspect and supervise the implementation of these Measures, correct the improper use of subsidy funds that do not expand the trial scope on their own according to the conditions, and investigate the responsibility for the acts of falsely claiming or taking funds in violation of these Measures. At the same time, travel agencies should accept the supervision and inspection of labor and personnel, finance and taxation departments. Article 8 The National Tourism Administration shall be responsible for the interpretation of these Trial Measures. Article 9 These Trial Measures shall be implemented as of January 1st, 1986.
