Measures of Taiyuan Municipality on Tourism Management

Article 1 In order to strengthen tourism management, rationally develop, utilize and protect tourism resources, standardize the order of tourism market, safeguard the legitimate rights and interests of tourists and tour operators, and promote the healthy development of tourism, these Measures are formulated in accordance with relevant laws and regulations and the Regulations of Shanxi Province on Tourism Management, combined with the actual situation of this Municipality. Article 2 All units and individuals engaged in tourism management, tourism activities and tourism management within the administrative area of this Municipality, as well as other personnel entering tourist attractions and scenic spots, shall abide by these Measures. Article 3 The municipal tourism administrative department is the competent department of tourism management of the Municipal People's Government. In accordance with the principle of unified leadership and hierarchical management, responsible for tourism management within the administrative area of this Municipality.

County (city, district) tourism administrative departments shall be responsible for the tourism management within their respective administrative areas under the guidance of the municipal tourism administrative departments.

The administrative department for industry and commerce is responsible for the supervision and management of the tourism market, and other administrative departments shall, according to their respective responsibilities, do a good job in tourism management according to law. Article 4 Tourism management shall adhere to the principle of unifying the development, utilization and protection of tourism resources with social, economic and environmental benefits, highlight the characteristics of Taiyuan, give play to the radiation advantages of provincial capital hubs, and create a civilized, orderly, clean and beautiful tourism environment. Article 5 The people's governments of cities and counties (cities, districts) shall incorporate tourism into the national economic and social development plan, raise funds through multiple channels, increase financial input, include it in the annual budget, and increase it year by year according to the social and economic development. Article 6 The government encourages all economic sectors to set up tourism, develop tourism resources, build tourism projects, train professionals to adapt to the development of tourism, and promote the development of tourism. Seventh tourism administrative departments shall, jointly with relevant departments, investigate and evaluate the tourism resources within the scope of this Municipality, and establish archives and databases of tourism resources. Article 8 All units and individuals have the obligation to protect tourism resources.

Quarrying, mining, dredging, logging, burning wasteland, hunting, building graves, dumping wastes and building industrial production facilities that pollute the environment are prohibited in tourist attractions and scenic spots. Article 9 Tourism operators shall operate according to law, follow the principles of voluntariness, equality, fairness, honesty and credit, observe professional ethics, disclose service items and charging standards, provide services according to national standards or industry standards and contractual agreements, and accept social supervision. Tenth tourism administrative departments should strengthen the tourism business skills training and professional ethics education, legal education and safety education for employees, and improve the quality of employees.

Tourism operators shall sign labor contracts with employees according to law, and stipulate the rights and obligations of both parties. Eleventh tour operators and their employees should consciously safeguard the legitimate rights and interests of tourists, and shall not commit any of the following acts:

(a) to raise or lower the charging standards set by the government price management department without authorization;

(two) without authorization to increase the cost of the contract with the tourists;

(3) Providing false tourism service information and making false advertisements;

(4) Deceiving or coercing tourists to consume, forcibly selling commodities to tourists or buying commodities from tourists;

(five) unauthorized increase or decrease of tourism services, change of reception plan, suspension of tour guide activities;

(6) Asking for tips, kickbacks or other property by express or implied means;

(seven) failing to provide safety services for the personal and property safety of tourists;

(eight) selling fake or inferior or deteriorated goods;

(9) Participating in the competition at a price lower than the normal cost price;

(ten) unauthorized occupation of points to collect photo fees,

(eleven) chasing and selling goods or setting up stalls in tourist attractions without authorization;

(twelve) other acts prohibited by laws, regulations and rules. Twelfth the establishment of a travel agency shall apply to the municipal tourism administrative department, and after examination and approval, report to the higher tourism administrative department for examination and approval, and obtain the business license of the travel agency. Those who have not obtained the Travel Agency Business License shall not engage in travel agency business or engage in travel agency business in disguised form.

Travel agencies shall not illegally transfer or transfer the business license of travel agencies in disguised form. Article 13 If a travel agency changes its organizational form, name, business place, legal representative or closes down, it shall go through the corresponding registration of change or registration with the administrative department for industry and commerce, and file with the tourism administrative department. Fourteenth travel agencies to set up a retail department shall obtain the consent of the municipal tourism administrative department, and within 30 working days from the date of completing the industrial and commercial registration procedures, report to the original examination and approval and the tourism administrative department where the retail department is located for the record. Fifteenth travel agencies shall abide by the following provisions:

(a) the organization of tourism must sign a standard contract with tourists;

(two) tourists shall not be transferred to other travel agencies without authorization;

(three) shall not provide travel contracts and service documents for units or individuals engaged in illegal tourism business;

(four) the accommodation, shopping, entertainment and other services of the tourism team should be arranged in star-rated hotels or designated tourism business units;

(five) the employment of tour guides must sign an employment agreement and report to the tourism administration department for the record;

(six) shall not exceed the scope of business to provide service information to tourists or to attract publicity;

(seven) the release of tourism service information, promotional materials and advertisements shall indicate the name of the travel agency, the license number and the complaint telephone number of the tourism service quality supervision of the municipal tourism administration department;

(eight) timely reporting statistics, financial statements and related information;

(nine) other matters stipulated by laws, regulations and rules.
