Australian spouse immigration DIY: applying for a visa "two steps"
Definition of terms
Spouse immigration refers to the status of spouse, potential spouse (fiancee or fiance) or dependent relationship of Australian citizens and permanent residents. Applicants for such immigrants must have a marriage relationship or cohabitation relationship with the guarantor. (If the application is based on cohabitation, this relationship must have been maintained for at least 12 months before the application. To apply as a potential spouse (fiancee or fiance), the applicant must have been engaged to the guarantor and plan to get married. To apply for dependency relationship, the applicant must be at least 18 years old and have dependency relationship with the guarantor (including same-sex husband and wife relationship, but not limited to this kind).
Spouse visa processing flow
Spouse visa is generally conducted in two stages. The first stage: temporary spouse visa (subclass39/82);); The second stage: permanent spouse visa (subclass1/81).
under normal circumstances, applicants can only obtain a temporary spouse visa first. You can only apply for a permanent visa two years after you get a temporary visa. When applying for a permanent visa, the applicant does not have to pay the application fee.
under special circumstances, the applicant can directly apply for a permanent residence visa. The prerequisite is: the applicant and guarantor have been in a spouse relationship for more than 5 years, or the applicant and guarantor have given birth to children.
No matter what kind of visa, the most important thing is to prove that the relationship between the two parties is true and ongoing.
in the immigration law of Australia, living together is an important criterion to prove the true and long-term relationship between husband and wife. When the spouses do not live together, or have known each other for a short time, the application for a spouse visa may be subject to more rigorous examination to prove that their separation is temporary or necessary, and sufficient evidence should be provided to show that the two sides maintain their relationship during the period of living apart.
Practical case
Ordinary 39 spouse
Immigration visa process
Narrator: Aili
My husband and I registered to get married in Australia, and then lived in Australia for some time. After returning to China, I applied for a 39 spouse immigrant visa. The information required for the visa was mailed to the Australian Consulate in Shanghai by myself.
According to the requirements of applying for 39 spouse immigrant visa, I filled in Form No.47, and the main contents of the form are as follows:
1. My basic information, name, ID number, date of birth, etc.
2. marital status. if you have been married, you should provide the name of your ex-husband/wife, date of birth, place of birth, date of marriage, how to terminate it, and whether you have children;
3. The application includes whether the child or any other person has served in military service and can use a gun; Family members include parents, siblings, children's gender, date of birth, marital status and country of residence;
4. Whether there is any record of visa cancellation and whether there is any criminal punishment (notarization without crime is required);
5. Spouse details, including spouse's name, gender, date of birth, place of birth, passport copy, etc., spouse's nationality or residence status in Australia, address, telephone number, fax number, e-mail address, spouse's financial guarantee information (spouse's tax bill, income, bank account, etc.);
6. Copy and original of Australian marriage certificate (only one piece of paper);
7. details of love and marriage, 1) when and where they met, 2) when and where they started their spouse relationship and provided details of marriage. This is very important, the more detailed, the better.
when posting materials, I collect all our things together, including our phone bills, our photos, photos of my husband visiting my family, letters I received at home in Australia, etc. This is necessary. These things will be returned to you intact after they have read them.
then the interview. My husband and I were interviewed separately. I was received by a young female immigration officer in China. She was very friendly, quality and kind, and she didn't feel condescending, but she was very strict. She asked me a lot of questions, such as chatting at home, which seemed to be small daily questions, but it was these humble small questions that made the immigration officer judge whether the marriage was true or not.
For example, she asked me: How many friends does your husband have? What are their names? What color is your husband's car? Your home phone number, address, what your husband calls you, what you call your husband, and so on.
After the interview, the immigration officer asked me to add some information, and then made an appointment to ask me to go again.
my materials are basically complete, and there are not many supplementary materials. After that, I went to their designated hospital for physical examination, including blood pressure, blood drawing, urine examination and chest X-ray. It is said that I was checking AIDS, hepatitis, tuberculosis and heart disease.
During the last interview at the consulate, the immigration officer asked small daily questions. After that, the visa was approved soon. (Zhou Jia))
