Regulations of Jiangsu Province on Tourism

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of tourists, tour operators and tourism professionals, standardize the order of the tourism market, protect and rationally develop and utilize tourism resources, and promote the sustained and healthy development of the tourism industry, these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the tourism activities of tourists and the protection, planning, industrial promotion, public services, business services and related supervision and management of tourism resources within the administrative area of this province. Article 3 The development of tourism in this province should follow the principle of integrating social benefits, economic benefits and ecological benefits, highlight local characteristics, adhere to the combination of effective protection and rational development and utilization of tourism resources, improve tourism quality, and advocate healthy, civilized and environmentally friendly tourism modes. Article 4 Local people's governments at or above the county level shall incorporate the development of tourism into the national economic and social development plan, and increase policy support and support for tourism.

The local people's governments at or above the county level shall strengthen the organization and leadership of tourism work, clarify the relevant departments or institutions, and coordinate the development, supervision and management of tourism within their respective administrative areas. Fifth local people's governments at or above the county level shall be responsible for the guidance, coordination, public service, supervision and management of tourism within their respective administrative areas.

The relevant departments of the local people's governments at or above the county level shall, in accordance with their respective responsibilities, safeguard and promote the development of tourism. Encourage and guide tourism operators and tourism professionals to join tourism industry organizations voluntarily.

Tourism industry organizations should strengthen the publicity and education of members on the rule of law, guide members to operate in a law-abiding manner, operate in good faith and compete fairly, and provide members with services such as market information release, tourism market expansion, product promotion, industry training and exchange, and rights protection according to law.

Tourism authorities shall guide tourism industry organizations to formulate industry business norms and service standards, and strengthen industry supervision and self-discipline. Chapter II Tourism Planning and Promotion Article 7 The tourism authorities of the local people's governments at or above the county level shall, jointly with relevant departments, organize a general survey and evaluation of tourism resources within their respective administrative areas, establish a database of tourism resources, implement dynamic management, and coordinate the protection, development and utilization of tourism resources. Article 8 The local people's governments at or above the county level shall, according to the requirements of the national economic and social development plan, organize the formulation of the tourism development plan and make it public.

Cross-administrative tourism development planning shall be organized by the people's government at the next higher level or worked out through consultation by the relevant local people's governments. The development and utilization of key tourism resources in this province shall be organized by the provincial people's government to prepare special plans.

Departments of land and resources, planning, culture, agriculture, forestry, water conservancy, transportation, economy and information technology shall solicit the opinions of the tourism authorities at the same level when formulating relevant plans for tourism development. Ninth tourism development planning should conform to the main functional area planning and the tourism development planning at the next higher level.

The formulation of tourism development planning should be connected with the overall land use planning, urban and rural planning, ecological red line protection planning, environmental protection planning and protection and utilization planning of scenic spots, nature reserves, cultural relics protection areas, drinking water sources, forest parks and wetlands. , and publicly solicit the opinions of the public and experts.

Tourism development planning should highlight local characteristics, strengthen tourism cooperation and development with surrounding areas and other regions, give full play to the comprehensive advantages of tourism resources, and promote the process of tourism integration in the Yangtze River Delta. Article 10 The local people's governments at or above the county level shall be responsible for organizing the implementation of the tourism development plan in their own areas and evaluating the implementation, and the evaluation results shall be announced to the public. Eleventh tourism resources development should conform to the tourism development plan, environmental impact assessment according to law, and take effective measures to protect the natural landscape and ecological original appearance.

For tourism resources development projects that need to be approved according to law, the relevant departments shall solicit the opinions of the tourism authorities at the same level when examining and approving them. Twelfth the use of natural reserves, forest parks, wetlands and other natural resources to develop tourism projects, should protect the biodiversity of natural resources and the integrity of the ecosystem, to ensure the sustainable use of resources.

If a tourism operator fails to develop and utilize tourism resources in accordance with the tourism development plan and the contract during the operation period, resulting in serious damage to tourism resources or long-term idleness, the local people's government shall recover the right to operate state-owned tourism resources according to law. Article 14 Local people's governments at or above the county level shall formulate and organize the implementation of industrial policies and measures conducive to the sustained and healthy development of tourism, promote the integrated development of tourism and related industries, strengthen cross-regional tourism cooperation and management, and realize information exchange, resource sharing and complementary advantages.

The tourism administrative department of the provincial people's government should integrate tourism resources, develop theme tourism routes and products with Jiangsu characteristics, and promote the coordinated development of regional tourism in the province.
