Chongqing Municipal Scenic Area Regulations

Chapter 1 General Provisions Article 1 In order to strengthen the management of scenic spots and protect and utilize scenic spots resources, in accordance with the "Regulations on Scenic Spots" of the State Council and relevant laws and administrative regulations, combined with the actual situation of this city, Establish these regulations. Article 2 These regulations apply to the establishment, planning, protection, utilization and management of scenic spots within the administrative region of this city. Article 3 Scenic and historic areas shall implement the principles of scientific planning, unified management, strict protection, and sustainable utilization. Article 4 The municipal and district/county (autonomous county) people's governments shall incorporate the protection and utilization of scenic and historic resources into the national economic and social development plans. Article 5 The municipal landscaping department is responsible for the supervision and management of the city’s scenic spots and performs the following duties:

(1) Organizing investigations and evaluations of the city’s scenic resources;

(2) Organize the formulation of the city's scenic and historic area development plan;

(3) Responsible for the review and approval of the establishment of scenic and historic areas;

(4) Responsible for the preparation and review of the overall plan and detailed planning of the scenic and historic areas , review and approval;

(5) Supervise the implementation of the scenic area planning;

(6) Provide guidance and supervision to the scenic area management agencies set up by the Municipal People’s Government;

< p>(7) Formulate relevant measures, norms and standards for the management of scenic spots;

(8) Other responsibilities prescribed by laws and regulations. Article 6 The administrative departments of scenic spots determined by the people's governments of districts and counties (autonomous counties) are responsible for the supervision and management of scenic spots within their own administrative regions and perform the following duties:

(1) Organizing investigations and evaluations of their own administrative regions Scenic and historic resources within the administrative region;

(2) Organize the formulation of development plans for scenic spots within the administrative region in accordance with the city’s scenic spot development plan;

(3) Responsible for the establishment of scenic spots Related work;

(4) Responsible for the preparation, approval and other related work of the overall planning and detailed planning of municipal scenic spots;

(5) Management of scenic spots set up by the people's government at the same level Institutions provide guidance and supervision.

(6) Other responsibilities prescribed by laws and regulations. Article 7 The management agencies of national-level and city-level scenic spots across districts and counties (autonomous counties) shall be set up by the municipal people's government; the management agencies of other city-level scenic spots shall be set up by the people's governments of the districts and counties (autonomous counties) where they are located.

Scenic and historic area management agencies are responsible for the protection and unified management of scenic and historic areas, and perform the following duties:

(1) Formulate and implement various management systems for the protection of scenic and historic resources;

(2) Organize and implement the overall planning and detailed planning of the scenic area;

(3) Responsible for the construction, maintenance and management of infrastructure and public facilities in the scenic area;

(4) Responsible for the protection of the ecological environment in scenic spots and the implementation of relevant pollution prevention and control measures;

(5) Responsible for the relevant safety management of scenic spots;

(6) Investigate and deal with or assist relevant departments to investigate and deal with illegal activities in scenic spots in accordance with the law;

(7) Other responsibilities conferred by the State Council's "Regulations on Scenic Spots" and these regulations. Article 8 The relevant departments of the municipal and district/county (autonomous county) people's governments shall, in accordance with the division of responsibilities, be responsible for the relevant supervision and management of scenic spots. Chapter 2 Establishment Article 9 Scenic spots are divided into national-level scenic spots and municipal-level scenic spots.

If natural landscapes and cultural landscapes can reflect important natural change processes and major historical and cultural development processes, are basically in a natural state or maintain their historical original appearance, and are nationally representative, they can apply for the establishment of national-level scenic spots; if they have regional For representative ones, you can apply for the establishment of municipal-level scenic spots. Article 10 Newly established scenic spots and nature reserves shall not overlap or intersect; if already established scenic spots overlap or intersect with nature reserves, the planning of scenic spots and nature reserves shall be coordinated. Article 11 Applications for the establishment of scenic spots shall submit materials containing the following contents:

(1) The distribution, characteristics, value and other basic conditions of scenic resources;

(2) The scope of the proposed scenic spot and the scope of the core scenic spot;

(3) The nature and protection objectives of the proposed scenic spot;

(4) The conditions for visiting the proposed scenic spot;

(5) The contents and results of negotiations with the owners and users of land, forests and other natural resources and houses and other properties within the proposed scenic area. Article 12 To establish a scenic spot, the district or county (autonomous county) people's government shall submit an application to the municipal people's government, and the municipal landscaping department shall organize the establishment together with the municipal planning, environmental protection, forestry, cultural relics, development and reform, construction, tourism and other relevant departments. Demonstrate, put forward review opinions, and report to the Municipal People's Government.

For the establishment of scenic spots across districts and counties (autonomous counties), the people's governments of the districts and counties (autonomous counties) across which they cross shall jointly submit an application. Article 13 The establishment of national-level scenic spots shall be subject to the approval of the Municipal People's Government and then submitted to the State Council for approval.

The establishment of municipal-level scenic spots shall be approved and announced by the Municipal People's Government.

Article 14 If the establishment of a scenic spot causes losses to the owners or users of land, forests and other natural resources and houses and other properties within the scenic spot, compensation shall be provided in accordance with the law. If the establishment of a scenic spot affects the production and life of relevant units or individuals, the local district or county (autonomous county) people's government shall handle it properly.

Qualified scenic spots can organize the relocation of units or personnel that have nothing to do with the protection of scenic spots and resources in core scenic spots in accordance with the law.
