Travel accident insurance system (hereinafter referred to as insurance system) The travel accident insurance (hereinafter referred to as accident insurance) refers to the insurance behavior that the travel agency pays the insurance premium to the insurance company on behalf of the tourists in order to protect the interests of the tourists when organizing a group tour. Once the tourists have an accident during the tour, the technical contract stipulates that the underwriting insurance company will pay the insurance premium to the tourists.
Travel agencies in China should abide by the Interim Provisions on Travel Agency Handling Travel Accident Insurance when handling travel accident insurance.
1. The scope of compensation for travel accident insurance. Travel agencies must take out travel accident insurance for tourists when organizing group tours. The scope of insurance compensation should include the following compensation caused by tourists' accidents during their travels: (1) compensation caused by personal injury or death due to acute illness; (2) medical expenses for the treatment of injuries and acute diseases; (3) the cost of death treatment or repatriation of remains; (4) Compensation for lost, damaged or stolen luggage carried by tourists; (5) Compensation caused by third party liability.
The proportion of the above compensation in travel accident insurance for inbound tourism, domestic tourism and outbound tourism shall be agreed by the travel agency and the insured insurance company.
2. duration and amount of insurance (1) duration. The term of inbound tourism organized by a travel agency begins when the tourists participate in the travel itinerary arranged by the travel agency after entering the country, and ends when the travel itinerary ends and the exit formalities are completed. For domestic tourism and outbound tourism, the time limit begins when the tourists board the means of transportation arranged by the travel agency at the agreed time, and ends when the trip ends and they leave the means of transportation arranged by the travel agency. Tourists voluntarily terminate the travel itinerary arranged by the travel agency, and their insurance period is until the time when they terminate their travel itinerary. Tourists who travel by themselves after stopping the travel itinerary agreed by both parties are not covered by travel insurance.
(2) amount. The amount of travel accident insurance handled by travel agencies for tourists shall not be lower than the following basic standards: ① inbound tourism: 3, yuan per tourist; ② Outbound tourism: 3, yuan per tourist; ③ Domestic tourism: 1, yuan per tourist; ④ One-day tour (including inbound tour, outbound tour and domestic tour): RMB 3, per tourist. Travel agencies to carry out special tourism projects such as mountaineering, hunting, rafting, car and motorcycle rally, etc., can agree on the insurance amount with the insurance company on the basis of the above basic standard of the amount and according to the risk degree of the project.
3. Insurance procedures (1) Insurance clauses. When a travel agency organizes a group tour, the following insurance clauses should be specified in the contract signed with tourists: ① insurance premium; ② Insurance amount; ③ The compensation ratio of various travel accidents agreed by the travel agency and the underwriting insurance company.
(2) insurance procedures. Travel agencies must handle accident insurance in domestic insurance companies. The insurance procedures should be handled by the tour group agency at one time, and the tour group agency will not repeat the insurance.
(3) insurance procedures between travel agencies and insurance companies. According to the insurance contract stipulated in the Insurance Law of the People's Republic of China, the travel agency should sign the Travel Accident Insurance Contract with the underwriting insurance company, and go through the insurance formalities in the following ways: ① Every travel company should go through the insurance formalities once; (2) on the basis of the number of tourists organized in the previous year, apply to the insurance company for insurance this year at one time. In addition, the travel agency should make an agreement with the underwriting insurance company on the validity period of the travel accident insurance claim in the insurance clause, which should generally be limited within 18 days from the date of the accident.
(4) valid vouchers. When a tourist has an accident within the scope of insurance liability within the validity period of insurance, the travel agency shall promptly obtain the valid vouchers of the public security, medical care, underwriting insurance company or its branch company where the accident occurred, and the package tour agency shall handle the claims with the underwriting insurance company. The travel agency and the underwriting insurance company should make provisions in the insurance clauses for the compensation of tourists' small baggage losses; Within the agreed amount, the travel agency may make advance payment to the tourists, and the travel agency shall go through the compensation procedures with the underwriting insurance company on the basis of the claim application and loss certificate.
4. industry supervision (1) supervision department. The tourism administrative department of the people's government at or above the county level shall, in accordance with the relevant provisions of the Regulations on the Administration of Travel Agencies, supervise and inspect the travel agency's handling of travel accident insurance, and include the insurance and claims of travel accident insurance in the annual inspection scope of travel agencies.
(2) obligations of travel agencies. Travel agencies shall handle accident insurance for tour guides who provide services to tourists. The sales price of travel agencies should include accident insurance premium, which can be listed separately. Travel agencies should properly keep all kinds of information about travel accident insurance and claim settlement, and accept the inspection of tourism administrative departments; After the settlement case occurs, the settlement should be reported to the local tourism administration department for the record in time.
Travel agencies should choose insurance companies with good insurance business reputation, wide service network and no bad business records.
5. Penalty If the travel agency fails to handle accident insurance according to administrative regulations, the tourism administrative department shall order it to make corrections within a time limit; Illegal income, confiscate the illegal income; If it fails to do so within the time limit, it shall be ordered to suspend business for rectification for 15 days to 3 days, and may be imposed with a fine of more than 5, yuan and less than 2, yuan; If the circumstances are serious, its Travel Agency Business License shall be revoked.
if a travel agency fails to handle accident insurance according to the prescribed time limit and amount, fails to make an agreement on the validity period of claims, and fails to handle travel accident insurance for its tour leader who provides services to tourists, the tourism administrative department shall order it to make corrections within a time limit and impose a warning; If it fails to do so within the time limit, it shall be fined between 5, yuan and 1, yuan.
if the travel agency fails to obtain valid vouchers in time and does not accept the supervision and inspection of the industry, the tourism administrative department shall order it to make corrections within a time limit and impose a warning; If it fails to do so within the time limit, it shall be ordered to suspend business for rectification for 3 to 15 days, and may be fined between RMB 3, yuan and RMB 1, yuan.
if a travel agency refuses to accept the administrative punishment given by the tourism administrative department, it can apply for reconsideration to the people's government at the same level or the tourism administrative department at the next higher level that made the decision on punishment within 15 days from the date of receiving the notice of punishment, or it can directly bring a lawsuit to the people's court; If you are still dissatisfied with the reconsideration decision of the tourism administrative department at the next higher level, you may bring a suit in a people's court within 15 days from the date of receiving the notice of reconsideration decision. If it fails to apply for reconsideration, bring a lawsuit or perform the punishment decision at the expiration of the time limit, the tourism administrative department that made the punishment decision shall apply to the people's court for compulsory execution.
