Application for refund of travel agency warranty deposit

1. Materials required

(1) "Application for Refund of Tourism Service Quality Deposit

" issued by the travel agency;

< p>(2) The original and a copy of the "Tourism Service Quality Guarantee Deposit Agreement" or "Travel Agency Quality Deposit Bank Guarantee Commitment";

(3) Tourism Service Quality Guarantee Bank Deposit Certificate (the deposit certificate is lost The original and a copy of the certificate issued by the bank are required;

(4) The cancellation certificate of the travel agency (branch) industrial and commercial enterprise issued by the industrial and commercial department.

(5) Registration and cancellation certificate issued by the tourism administrative department where the branch is located (after August 1, 2017, branches established in the form of "multiple certificates in one" do not need to provide it).

2. Processing procedures

While the travel agency (head office) receives the "Certificate of Cancellation of Travel Agency Business License", it also handles the refund procedures for the travel agency's warranty deposit.

(1) The head office of the travel agency shall go to the Municipal Tourism Commission to obtain the "Certificate of Cancellation of Travel Agency Business License", and the branch shall provide the "Certificate of Cancellation of Registration Filing" issued by the tourism administrative department of the place of registration;

< p>(2) Submit the above materials on-site to the Municipal Tourism Commission, and simultaneously handle the cancellation and refund procedures of the travel agency’s quality deposit;

(3) After the Municipal Tourism Commission’s review and approval, the “Tourism Service Quality Deposit Withdrawal Notice” will be issued ; (4) After the travel agency receives the "Tourism Service Quality Guarantee Withdrawal Notice", go to the bank to complete the procedures.

Legal basis:

Article 67, Paragraph 1, of the Tourism Law of the People’s Republic of China stipulates that “due to force majeure or when the travel agency or the performance assistant has exercised reasonable care, If the obligation cannot be avoided and the event affects the travel itinerary, the following circumstances will apply: (1) If the contract cannot be continued to be performed, both the travel agency and the tourist can terminate the contract.

If the contract cannot be fully performed, the travel agency may change the contract within a reasonable range after explaining it to the tourist; if the tourist does not agree to the change, it may terminate the contract
