Notice of the National Tourism Administration on printing and distributing the measures for the implementation of the Interim Regulations on the Administration of Travel Agencies
(1) It must be an enterprise owned by the whole people;
(2) Having been engaged in the business of category II travel agencies for three years;
(3) Receiving no less than 15000 person-times of foreign tourists and overseas Chinese, compatriots from Hongkong, Macao and Taiwan Province, and earning no less than $5 million in foreign exchange from travel agency business;
(4) The general manager has a college education or above, has been engaged in management or reception work in the tourism department for three years, and his professional knowledge and working ability have passed the examination by the tourism administrative department;
(5) Tour guides and outreach personnel who have passed the examination in English, Japanese, French, German and local languages in China. There are not less than 25 tour guides and outreach personnel, including not less than 20 foreign language tour guides and outreach personnel of travel agencies whose main business is to receive foreign tourists;
(six) full-time accounting personnel who have obtained the title of accountant or above;
(seven) the actual use area of the business premises is not less than 200 square meters;
(8) There are telex machines, fax machines, direct-line telephones (not less than four, one of which is a special telephone for receiving tourists' inquiries and complaints), computers, photocopiers, typewriters and other equipment and office appliances. Article 2 To apply for the establishment of Class II travel agencies, the following conditions shall be met:
(1) It must be an enterprise owned by the whole people;
(two) the management personnel have technical secondary school education or above, have experience in economic management, and their professional knowledge and working ability have passed the examination by the tourism administration department;
(3) Having qualified tour guides in foreign languages such as English and Japanese and local languages in China. There are no less than 15 tour guides in the compilation, among which there are no less than 10 foreign language tour guides of travel agencies whose main business is to receive foreign tourists;
(4) Full-time accounting personnel who have obtained the title of assistant accountant or above;
(five) the actual use area of the business premises is not less than one hundred square meters;
(six) there are telex machines, direct-line telephones (not less than two), photocopiers, typewriters and other equipment and office supplies;
(seven) a stable source of tourists. Article 3 To apply for the establishment of three types of travel agencies, the following conditions shall be met:
(a) managers should be familiar with the tourism business, business knowledge and working ability by the tourism administrative departments to assess qualified;
(two) there are more than five qualified Mandarin or local language tour guides;
(3) Having full-time accounting personnel;
(4) Having a direct dial telephone and a business place of not less than 30 square meters. Article 4 A class of travel agencies established before the date of promulgation of these Measures cannot meet the conditions stipulated in Article 1, and must do so within two years from the date of promulgation of these Measures; If it still fails to meet the prescribed conditions, it can be registered as a second-class travel agency if it meets the conditions stipulated in Article 2. Article 5 The proportion of self-owned liquidity of various travel agencies in registered capital shall not be less than 50%. Article 6 Chinese-foreign joint ventures, Chinese-foreign cooperation and foreign-funded travel agencies shall not be established in China. Chapter II Examination and Approval of Travel Agencies Article 7 The National Tourism Administration and the tourism bureaus of provinces, autonomous regions and municipalities directly under the Central Government shall, according to the needs of tourism development and changes in the relationship between supply and demand, make macro-control on the number and structural proportion of various travel agencies in the whole country or the region, and may approve, suspend or stop approving the establishment of various travel agencies. Article 8 Units applying for running various types of travel agencies shall, in accordance with the provisions of Articles 9, 10 and 11 of the Provisional Regulations on the Administration of Travel Agencies, fill in the Registration Form for Applying for Travel Agency Business uniformly printed by the National Tourism Administration, and issue travel agency business licenses after being approved by the relevant tourism administrative departments; Then go through the registration formalities with the administrative department for industry and commerce with this certificate and other relevant approval documents. Article 9 An entity applying for the establishment of a travel agency shall submit the following documents:
(1) application for starting business.
(2) Articles of association of the travel agency. The articles of association shall include the following contents:
(1) Name of travel agency (English translation should be attached to the first and second travel agencies);
(2) office address, telex and telephone number;
(3) economic nature;
(4) aims and purposes;
(5) Business scope;
(six) the amount of registered capital and the source of bonus;
(7) organization;
(8) Financial management system;
(9) Responsibility for tourists;
(10) Other issues that need to be explained.
(3) Resumes of the travel agency manager and deputy manager.
(four) the credit certificate issued by the superior competent financial department.
(5) If the office or business premises are rented, the contract certificate of renting the premises for not less than one year shall be presented.
(six) signed agreements with civil aviation, railways, road transport, shipping, hotels, etc.
(seven) the travel agency that uses the name of the package tour agency shall submit the certificate that the package tour agency agrees to use its name.
(eight) to apply for the establishment of a travel agency restricted or prohibited by the state, the central department shall produce the approval document of the State Council; The local departments shall produce the approval documents of the governments of provinces, autonomous regions and municipalities directly under the Central Government.
