Can the company organize employees to travel and drown?

Work-related injuries are counted as drowning deaths in the unified activities of employee tourism organized by the unit.

In order to strengthen team cohesion and improve work efficiency, the company organizes employees to travel abroad. It is the "period during which employees go out to engage in other work-related activities" as mentioned in Item (3) of Article 5 of the Provisions of the Supreme People's Law on Several Issues Concerning the Trial of Administrative Cases of Work-related Injury Insurance (Fa Shi [2014] No.9).

When the company organizes a tour, the employee drowns in the activities organized by the company, and is injured due to work, which meets the provisions of Item (5) of Article 14 of the Regulations on Work-related Injury Insurance and shall be recognized as a work-related injury; Workers' activities are not organized by the company, so they cannot be identified as work-related injuries.

Regulations on industrial injury insurance

Fourteenth employees in any of the following circumstances, should be identified as work-related injuries:

(1) Being injured by an accident during working hours and in the workplace;

(two) before and after working hours, in the workplace, engaged in preparatory or finishing work related to the work and was injured by an accident;

(three) during working hours and workplaces, due to the performance of duties by violence and other accidental injuries;

(4) Suffering from occupational diseases;

(five) during the business trip, injured or missing due to work reasons;

(six) on the way to work, I was injured by a traffic accident or an urban rail transit, passenger ferry or train accident for which I was not primarily responsible;

(seven) other circumstances that should be recognized as work-related injuries as stipulated by laws and administrative regulations.
