Interim Provisions of Heilongjiang Province on International Tourism Management

Article 1 In order to strengthen the management of tourism and ensure the sustained and coordinated development of international tourism in our province in a planned way, these Provisions are formulated in accordance with the relevant provisions of the state and the actual situation in our province. Article 2 These Provisions shall apply to the first-and second-class travel agencies, foreign-related tourist hotels, tourist transportation units, tourist shops, key scenic spots, tourist spots and other foreign-related tourist business units in this province. Article 3 The Heilongjiang Provincial Tourism Bureau is a specialized agency of the provincial government to manage the tourism industry, exercising the functions and powers of industry management.

The administrative offices, city and county tourism bureaus are responsible for the management of tourism in this region. Article 4 The development of local tourism resources and the construction of tourist areas shall be planned by tourism bureaus at all levels in conjunction with relevant departments, approved by the tourism bureau at the next higher level and the competent department, and reported to the government at the same level for approval, and incorporated into the local national economic plan. Article 5 The planning and construction of key tourist areas in this province shall be reviewed by the Provincial Tourism Bureau, the Provincial Construction Committee and the Planning Commission and submitted to the provincial government for approval. Where the National Tourism Administration or the provincial government invests (or participates in the investment) in the construction of scenic spots and tourist spots, the provincial government authorizes the provincial tourism bureau to participate in the leadership and management. Article 6 Any newly-built, rebuilt or expanded foreign-related tourist hotels (including Sino-foreign joint ventures, Sino-foreign cooperative hotels and wholly foreign-owned hotels) or hotel groups from foreign countries, Hongkong, Macao and Taiwan Province provinces are hired to operate foreign-related tourist hotels in this province, which should be reported to the Provincial Tourism Bureau for approval first, and then to the National Tourism Administration and relevant departments for approval. Seventh new foreign-related tourism units, must be approved by the Provincial Tourism Bureau, and issued a tourism business license, can apply for a business license to the administrative department for Industry and commerce. Article 8 All kinds of foreign-related tourism units that have been established shall renew their tourism business licenses to the Provincial Tourism Bureau and implement fixed-point listing services. Ninth travel agencies to start tourism business, must be approved by the Provincial Tourism Bureau, and reported to the National Tourism Administration for approval. Tenth travel agencies to start second-class tourism must be approved by the Provincial Tourism Bureau and reported to the National Tourism Administration for the record. Eleventh travel agencies have the right to attract foreign and Hongkong, Macao and Taiwan Province tourists, and the Provincial Tourism Bureau will notify them to apply for visas. The administrative office, the Municipal Tourism Bureau and the travel agency shall report to the Provincial Tourism Bureau for examination and approval before reporting to the relevant departments for examination and approval (except Harbin) for business activities abroad. Twelfth foreign-related tourism business units shall implement the service standards stipulated by the National Tourism Administration and the Provincial Tourism Administration. Specialized agencies in charge of tourism at all levels have the right to punish units with poor service quality with warnings, fines, improvement within a time limit, suspension of business for rectification and even revocation of tourism business licenses. Thirteenth foreign-related tourism business units shall implement the price standards formulated by the Provincial Tourism Bureau and the Provincial Price Bureau; The off-season quotation shall not exceed the minimum protection price. Fourteenth foreign-related tourism business units should strictly abide by the regulations on foreign exchange control, receive foreign tourists and tourists from Hongkong, Macao and Taiwan Province Province, and accept foreign exchange certificates. It is strictly forbidden to intercept, misappropriate or exchange foreign exchange certificates. Violators shall be punished according to the detailed rules for the implementation of foreign exchange management. Fifteenth foreign-related tourism business units to print tourism promotional materials, should be submitted to the tourism bureaus at all levels in accordance with the scope of management plan, after examination and approval by the Provincial Tourism Bureau, before printing, manuscripts and designs should be sent to the Provincial Tourism Bureau for examination. Article 16 When the administrative offices, the Municipal Tourism Bureau and foreign-related tourism business units invite foreign and Hongkong, Macao and Taiwan Province news organizations to hold tourism exhibitions abroad, they should first put forward plans to the Provincial Tourism Bureau and report them to the National Tourism Administration or the provincial foreign affairs department for examination and approval. Seventeenth Provincial Tourism Bureau is responsible for the development of the province's tourism professionals training plan and the training of the administrative office, the Municipal Tourism Bureau and the managers of key foreign-related tourism business units. The administrative office, city and county tourism bureau is responsible for the development of local tourism professionals training plan and middle-level management cadres, business backbone training. Without professional training, tourism professionals are not allowed to work at their posts.
