(II) Scope of acceptance

1. Travel agencies organize unreasonable low-cost tours with zero negative group fees, induce propaganda tourists to join tour groups, and deceive and coerce tourists to spend by lowering service standards, increasing shopping time or entering stores;

2. Tour guides forcibly buy and sell tourists in the course of traveling, and threaten tourists to forcibly shop with language (with video, audio and other supporting materials), causing adverse social impact;

3. The matters agreed between the travel agency and the tourists are inconsistent with the signed travel contract, which leads to the travel agency or tour guide refusing to perform the agreed obligations and selling tour groups, or buying and selling tour groups between travel agencies for illegal interests;

4 other illegal acts of tourism management, resulting in adverse social impact.

(3) Inadmissible

1. There is no clear target and specific illegal facts;

2. The same reporting matter has been accepted by other organs, and the informant reports to the tourism administrative department again;

3. The same reported matter has been dealt with by the tourism administrative department or other organs according to law, and there is no new fact or basis;

4. Other circumstances that do not conform to the provisions of laws and regulations.

Acceptance process

(1) Registration

The staff of Guiyang Tourism Reporting Platform shall accurately and completely record the name, contact information and report content of the informant. Informants who are unwilling to provide personal information such as names shall respect their wishes. Informants shall truthfully provide the basic information of the reported matters, including the name, illegal matters, time, place, means of transportation and other information of illegal units or individuals, and provide photos, videos or words that can be used as evidence. Reports of illegal travel-related activities in Guiyang are concentrated to Guiyang Cultural Market Comprehensive Administrative Law Enforcement Detachment (hereinafter referred to as the Municipal Law Enforcement Detachment) according to procedures.

(2) Accept

After receiving the report, Guiyang law enforcement detachment immediately confirmed whether the report content belongs to the report scope. If it can be confirmed on the spot, it shall be accepted and transferred on the spot. If it cannot be confirmed on the spot, it shall be verified within 5 working days and the informant shall be informed of the confirmation.

(3) Information disclosure

Guiyang Law Enforcement Detachment will notify the reporter of the results within 5 working days after the investigation and handling of the report clues are completed or the results transferred by other organs are received, and publish and publicize the results on the official website of Guiyang Culture and Tourism Bureau and related platforms, except those involving state secrets, personal privacy, business secrets or other circumstances that should not be published.

Encouragement and reward

(1) Awards shall meet the following conditions:

1. The place where the travel-related illegal acts occurred is under the jurisdiction of Guiyang City, or the travel-related reporting matters are within the scope of the responsibilities of the tourism administrative department of Guiyang City;

2. The clues provided by the informants are true and reliable, with clear objectives and specific illegal facts, and actively assist in the investigation;

3 to verify the report, make a decision according to law.

(B) the principle of reward

1. The principle of reporting reward is limited to real-name reporting. In the case of anonymous reporting and investigation, after the true identity of the informant is finally determined, if the informant is willing to receive a reward, it shall be rewarded with reference to these measures;

2. If the same case is reported by two or more informants respectively, the first informant will be rewarded. Two or more people (including two people) jointly report the same case, according to the same reward, the bonus is evenly distributed by the informants;

3 in the name of a unit or group to give a reward to the reporting unit or group;

4. If the same informant reports the same matter in different departments, it shall be handled by the department that accepted it for the first time according to law, and it shall not be accepted and rewarded repeatedly.

(three) the redemption period of the award

1. The administrative organ shall make a report reward decision within 15 days from the date of acceptance and verification, notify the informer and give the informer a one-time monetary reward (before tax);

2. If an administrative penalty is imposed on the informant, a report reward decision shall be made within 15 days from the date when the administrative penalty decision is made, and the informant shall be notified and given a one-time monetary reward (before tax);

3. If the reported object is subject to administrative detention or criminal punishment, it shall make a report reward decision within 15 days from the date of execution of administrative detention or the effective date of judicial judgment, notify the informant, and give the informant a one-time monetary reward (before tax).

(4) Award criteria

1. The reported object has serious illegal acts, including: the tour guide induces, deceives and forces tourists to shop during the tour, or the travel agency induces tourists to leave the tour group, sells tourist goods at unreasonable low prices, deceives and coerces tourists to shop, and finally causes adverse social impact, and is fined according to law, ordered to suspend business for rectification, or revoked the license, and rewards the informant1-30,000 yuan;

2. The reported object's illegal business behavior is particularly serious, causing particularly bad social impact. If the public security organ imposes administrative detention punishment or transfers it to the judicial organ for criminal responsibility, a reward of 30,000-50,000 yuan will be given as appropriate;

3. If the reward situation is coincident, it will not be calculated repeatedly, and will be rewarded according to the highest standard; The maximum reward for each case shall not exceed 50,000 yuan.

(five) the reward period

Informants shall, within 90 days from the date of receiving the reward, collect it by themselves or by an agent with valid identity documents. Those who fail to receive it within the time limit shall be deemed to have given up automatically.

Supervision and interpretation

(a) the whistleblower shall be responsible for the authenticity of the report. Informants who fabricate facts, falsely accuse others or disrupt the order of the tourism market in the name of reporting, and resort to deceit to defraud the reward for reporting, shall be transferred to judicial organs for handling according to law.

(two) the information of informants is kept strictly confidential, and the staff members who violate the law in the process of handling the report shall be transferred to the municipal supervision organ according to law, and the responsibility of the responsible unit and the relevant responsible person shall be investigated; Those suspected of committing a crime shall be transferred to judicial organs for handling.
