As well as the business of soliciting, organizing, and hosting foreigners in mainland China, residents of the Hong Kong Special Administrative Region and Macao Special Administrative Region in the mainland, and residents of the Taiwan area in the mainland to travel within the country. \x0d\ The term "outbound tourism business" as mentioned in Article 2 of the "Regulations" refers to travel agencies' solicitation, organization and reception of mainland Chinese residents to travel abroad, travel to the Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan, as well as solicitation, organization and reception of residents in China Outbound travel business for foreigners from the mainland, residents of the Hong Kong Special Administrative Region and the Macao Special Administrative Region in the mainland, and residents of the Taiwan area in the mainland. \x0d\ Article 4 For the supervision and management of travel agencies and their branches, the tourism administrative departments at or above the county level shall implement hierarchical management and territorial management in accordance with the provisions and responsibilities of the Regulations and these Rules. \x0d\ Article 5: Encourage travel agencies to implement a service quality grade system; encourage travel agencies to develop toward specialization, networking, and branding. \x0d\ Chapter 2 Establishment and Change of Travel Agencies \x0d\ Article 6 The business premises specified in Item 1 of Article 6 of the Regulations shall meet the following requirements: \x0d\ (1) The business premises for which the applicant has property rights House, or business premises rented by the applicant with a lease term of not less than one year;\x0d\ (2) The business premises shall meet the applicant's business operation needs. \x0d\ Article 7 Item 2 of Article 6 of the Regulations stipulates that business facilities shall include at least the following facilities and equipment: \x0d\ (1) More than 2 direct landline telephones; \x0d\ (2) Fax machines , photocopier; \x0d\ (3) Computers that are capable of networking with tourism administrative departments and other tourism operators. \x0d\ Article 8 To apply for the establishment of a travel agency, the following documents shall be submitted to the tourism administrative department of the province, autonomous region, or municipality directly under the Central Government (referred to as the provincial tourism administrative department, the same below): \x0d\ (1) Application for establishment. The content includes the Chinese and English name and English abbreviation of the travel agency applying for establishment, establishment address, enterprise form, investor, amount and method of investment, full name of the applicant, the department accepting the application, name of the application form and time of application; \x0d\ 2) Resume and identity certificate of the legal representative; \x0d\ (3) Articles of Association; \x0d\ (4) Capital verification certificate issued by a capital verification institution established in accordance with the law; \x0d\ (5) Proof of business location; \x0d\ (6) Certification or description of business facilities and equipment; \x0d\  (7) "Notice of Pre-approval of Enterprise Name" issued by the industrial and commercial administration department. \x0d\ The provincial tourism administrative department may entrust the districted city (including prefecture, league, the same below) level tourism administrative department to accept the application of the parties and make a decision on permission or disapproval. \x0d\ Article 9 The tourism administrative department that accepts the application may conduct on-site inspections of the applicant’s business premises, business facilities, and equipment, or entrust the lower-level tourism administrative departments to conduct inspections. \x0d\ Article 10 When a travel agency applies for outbound tourism business, it shall submit to the tourism administrative department of the State Council a certificate issued by the original licensing tourism administrative department proving that it has operated the travel agency business for two consecutive years and has not violated the lawful laws of tourists for two consecutive years. A travel agency shall register a change in its business scope with the industrial and commercial administration department with a travel agency business license. \x0d\ The tourism administrative department of the State Council may entrust the provincial tourism administrative department to accept the application of a travel agency for operating outbound tourism business and make a decision on whether to grant permission or not. \x0d\ When a travel agency applies to operate border tourism business, the provisions of the "Interim Measures for the Administration of Border Tourism" shall apply. \x0d\ When a travel agency applies to operate tourism business in Taiwan, the provisions of the "Regulations on the Administration of Travel to Taiwan by Mainland Residents" shall apply. \x0d\ Article 11: Due to business operation needs, a travel agency may apply to the original licensing tourism administrative department for issuance of a copy of the travel agency business license. \x0d\Travel agency business licenses and copies shall be formulated in a unified format by the tourism administrative department of the State Council and printed separately by the tourism administrative department of the State Council and the provincial tourism administrative departments. \x0d\  If the travel agency business license and its copy are damaged or lost, the travel agency shall apply to the original licensing tourism administrative department for a replacement or reissue. \x0d\ When applying for the reissue of a travel agency business license and its copy, the travel agency shall publish a statement of damage or loss and invalidation through publicly distributed newspapers and periodicals within the province, autonomous region, or municipality directly under the Central Government, or on the website of the tourism administrative department at or above the provincial level. \x0d\ Article 12 If the travel agency's name, business location, investor, legal representative and other registered items are changed, it shall, after completing the change registration, file a record with the original licensing tourism administrative department with the changed "Enterprise Legal Person Business License" . \x0d\ If a travel agency terminates its operations, it shall, after completing the cancellation procedures, file a record with the original licensing tourism administrative department with the cancellation document issued by the industrial and commercial administration department. \x0d\ If foreign investors invest in travel agencies, the provisions of Chapter 3 of the "Regulations" shall apply. Without approval, travel agencies are not allowed to introduce foreign investment. \x0d\ Article 13 The commercial bank designated by the tourism administrative department of the State Council as a travel agency to deposit quality guarantee funds shall submit a written commitment with the following contents: \x0d\ Agreement stipulated in Article 15 of the Implementation Rules; \x0d\ (2) When the tourism administrative department at or above the county level or the people's court allocates the quality guarantee deposit in accordance with the "Regulations", within 3 working days after allocating the quality guarantee deposit, the transfer status and amount will be reported. Notify the provincial tourism administrative department where the travel agency is located, and provide the transfer document issued by the tourism administrative department at or above the county level or a copy of the effective legal document of the People's Court;\x0d\ When the quality deposit is reduced, the company shall bear the obligation to make up the amount. \x0d\ Travel agencies shall choose a bank to deposit quality guarantee funds within the scope of banks designated by the tourism administrative department of the State Council. \x0d\ Article 14 If a travel agency deposits a quality guarantee deposit in a bank, it shall establish an independent account, and the deposit period shall be determined by the travel agency, but shall not be less than one year. Quality deposit. \x0d\ Article 16 If a travel agency meets the conditions stipulated in Article 17 of the "Regulations" for reducing the amount of quality guarantee deposit, the originally licensed tourism administrative department shall issue to the travel agency within 10 working days a notice of reduction of the amount of quality guarantee deposit according to the request of the travel agency. document. \x0d\ Article 17: Within 7 working days after making up the quality guarantee deposit in accordance with Article 18 of the Regulations, the travel agency shall submit the supplementary certification documents to the original licensing tourism administrative department. \x0d\ Chapter 3 Branches of Travel Agencies\x0d\ Article 18 Travel agency branches (referred to as branches, the same below) and travel agency service outlets (referred to as service outlets, the same below) do not have legal person status to establish branches or service outlets If a travel agency (hereinafter referred to as the establishment agency, the same below) engages in business activities stipulated in the Regulations, the responsibility and consequences of its business activities shall be borne by the establishment agency. \x0d\ Article 19 After registering the establishment of a branch with the industrial and commercial administrative department where the branch is located, the establishment of a branch shall submit the following documents to the tourism administrative department at the same level as the industrial and commercial registration where the branch is located: \x0d\ (1) Establishment of a branch Copy of the travel agency business license and corporate business license; \x0d\ (2) "Business License" of the branch; \x0d\ (3) Resume and identity certificate of the branch manager; \x0d\ (4) Quality of additional deposits Documentary evidence of the security deposit. \x0d\ If there is no tourism administrative department at the same level, the tourism administrative department at the next higher level shall be registered.

\x0d\ Article 20 The business premises, business facilities and equipment of the branch shall comply with the requirements stipulated in Article 6 Items (1) and (2) of the Regulations and Articles 6 and 7 of these Implementing Rules . \x0d\ The name of the branch shall include the name of the establishment, the name of the place where the branch is located and the words "branch" or "branch". \x0d\ Article 21 Service outlets refer to sales departments and other institutions established by travel agencies to recruit tourists for travel agencies and sign travel contracts with tourists in the name of travel agencies. \x0d\ The scope of the area where the establishment agency establishes service outlets shall be within the administrative division of the districted city where the establishment agency is located. \x0d\ The establishment shall not establish service outlets outside the area specified in the preceding paragraph. \x0d\ Article 22: Service outlets should be located in public places that are convenient for tourists to recognize and access. \x0d\ The name and signboard of the service outlet shall include the name of the establishment agency, the place where the service outlet is located, etc., and shall not contain content that may cause consumers to misunderstand it as a travel agency or branch, nor shall it be an abbreviation that may easily misunderstand consumers. \x0d\ Service outlets shall solicit tourists and provide tourism consulting services within the business scope of the establishment. \x0d \ Filing: \x0d\ (1) A copy of the travel agency business license and corporate business license of the established agency; \x0d\ (2) "Business License" of the service outlet; \x0d\ (3) Resume of the service outlet manager and proof of identity. \x0d\ If there is no tourism administrative department at the same level, the tourism administrative department at the next higher level shall be registered. \x0d\ After the branches and service outlets have been registered, the tourism administrative department that accepts the registration shall issue the "Travel Agency Branch Registration Certificate" or the "Travel Agency Service Network Registration Certificate" to the travel agency. \x0d\ Article 25 The establishment of a cooperative shall conclude labor contracts with the employees of branches and service outlets. \x0d\ Establishing a branch shall strengthen the management of branches and service outlets, implement unified personnel, financial, solicitation, and reception system specifications for branches, and implement unified management, unified finance, unified solicitation, and unified consulting service standards for service outlets. \x0d\ Chapter 4 Travel Agency Business Regulations \x0d\ Article 26 Travel agencies and their branches and service outlets shall submit the "Travel Agency Business License", "Travel Agency Branch Registration Certificate" or "Travel Agency Service Network Registration Certificate" 》, together with the business license, hang in a prominent position of the business premises. \x0d\ Article 27 The travel agency business license shall not be transferred, rented or lent. \x0d\ The following acts of a travel agency are acts of transferring, renting or lending a travel agency business license: \x0d\ Except under certain circumstances, allow or tacitly allow other enterprises, groups or individuals to engage in travel agency business activities in their own names;\x0d\ (2) Allow other enterprises, groups or individuals to operate travel agency business in the form of departmental or individual contracting or affiliation of. \x0d\ Article 28: Offices, representative offices, liaison offices and other offices established by travel agencies shall not engage in travel agency business activities. \x0d\ Article 29 If a travel agency operates travel agency business on the Internet, in addition to complying with laws and regulations, the homepage of its website shall indicate the name, legal representative, license number and business scope of the travel agency, as well as the original license Complaint hotline of the tourism administration department. \x0d\ Article 30 The activities that travel agencies are not allowed to arrange as stipulated in Article 26 of the Regulations mainly include: \x0d\ (1) Containing content that damages national interests and national dignity; \x0d\ (2) Containing ethnic content , racial or religious discrimination;\x0d\; (3) Containing obscene, gambling, drug-related contents;\x0d\; (4) Other contents that violate laws and regulations. \x0d\ Article 31 Travel agencies stipulated in Article 34 of the "Regulations" shall not require tour guides and team leaders to bear the relevant expenses for receiving tourism groups, which mainly include: \x0d\ (1) Advance payment of tourism reception expenses;\ x0d\  (2) Payment to the travel agency for receiving the travel group; \x0d\  (3) Other unreasonable expenses. \x0d\ Article 32 When travel agencies recruit, organize and receive tourists, the transportation, accommodation, catering, scenic spots and other enterprises they choose should meet the requirements for legal business qualifications and reception service capabilities. \x0d\ Article 33 When signing a travel contract, travel agencies shall not require tourists to participate in shopping activities arranged by the travel agency or travel projects that require tourists to pay separately. \x0d\  Within the same travel group, travel agencies shall not propose contract matters that are different from those of other tourists due to the following factors: \x0d\  (1) Tourists refuse to participate in shopping activities arranged by the travel agency or travel projects that require tourists to pay separately; \x0d\  (2) Differences in age or occupation among tourists.

Or threaten to refuse to continue to perform the contract or provide services. \x0d\ Article 39 Travel agencies and their appointed tour guides and team leaders shall give true explanations and clear warnings to tourists regarding matters where the services they provide may endanger the personal and property safety of tourists. \x0d\ During the free time during the travel itinerary, tourists should choose activities that they can control the risks and carry out activities within the scope of the risks they can control. \x0d\ Article 40 In order to reduce the damage caused to tourists by accidental risks such as natural disasters, travel agencies may prompt tourists to purchase travel accident insurance when soliciting and receiving tourists. \x0d\ Encourage travel agencies to obtain insurance agent qualifications in accordance with the law, and accept the entrustment of insurance companies to provide tourists with services to purchase personal accident insurance. \x0d\ Article 41 If an outbound tourist illegally stays abroad or an inbound tourist illegally stays within the country, the travel agency shall immediately report to the local tourism administrative department at or above the county level, the public security agency and the foreign affairs department. \x0d\ Article 42 During the travel itinerary, travel agencies and their appointed tour guides and team leaders shall remind tourists to abide by civilized travel conventions and etiquette. \x0d\ Article 43 Travel agencies and their appointed tour guides and team leaders shall enjoy the following rights in their operations and services: \x0d\ (1) Require tourists to truthfully provide personal information necessary for travel and submit relevant certification documents on time ;\x0d\ (2) Tourists are required to abide by the travel itinerary stipulated in the travel contract and properly keep their belongings; \x0d\ (3) Public emergencies or other critical situations occur, and the travel agency violates the travel contract When taking remedial measures, require tourists to cooperate to prevent the expansion of losses and reduce losses to a minimum; \x0d\ The person’s words and deeds violate the laws, customs and habits of the tourist destination. \x0d\ Article 44 Travel agencies shall properly preserve various contracts and related documents and materials for soliciting, organizing, and receiving tourists stipulated in the Regulations for verification by the tourism administrative department at or above the county level. \x0d\ The contract, documents and information referred to in the preceding paragraph shall be kept for no less than two years. \x0d\ Travel agencies shall not disclose the personal information provided by tourists for signing travel contracts to other operators or individuals; tourists’ personal information that has exceeded the retention period shall be properly destroyed. \x0d\ Chapter 5 Supervision and Inspection \x0d\ Article 45 According to the "Regulations" and these Implementing Rules, the tourism administrative department that accepts travel agency applications or filings may require the applicant or travel agency to process the application for the establishment of a travel agency. The original supporting documents and materials submitted during the filing as stipulated in the "Regulations" shall be provided with copies and stamped for confirmation, and shall be retained by the tourism administrative department.

\x0d\ Article 46 When the tourism administrative departments at or above the county level supervise and inspect travel agencies and their branches, they may enter their business premises and review various contracts, relevant documents, and materials for soliciting, organizing, and receiving tourists, and Travel agencies and their branches shall cooperate with the financial account books, transaction records, business documents and other materials. \x0d\ When the tourism administrative department at or above the county level supervises and inspects travel agencies and their branches, it shall be conducted by more than two law enforcement officers holding tourism administrative law enforcement certificates. \x0d\ If the travel agency and its branches do not meet the requirements of the preceding paragraph, they have the right to refuse inspection. \x0d\ Article 47 Travel agencies shall submit the following operational and financial information and other statistical data on an annual basis to the original licensing tourism administrative department before the end of March of the following year:\x0d\ (1) Basic information of travel agencies, Including the form of the enterprise, investors, number of employees, department setup, branches, network system, etc.;\x0d\ (2) The operating situation of the travel agency, including operating income, profits and taxes, etc.; The organization of domestic tourism, inbound tourism, and outbound tourism, the number of people received, etc.; \x0d\ (4) Safety, quality, and reputation of travel agencies, including travel agency liability insurance, certification and accreditation, rewards and punishments, etc. \x0d\ The tourism administrative department shall keep confidential the information contained in the preceding paragraph that involves the business secrets of travel agencies. \x0d\ Article 48 The various announcements stipulated in Articles 17 and 42 of the Regulations shall be released to the public by the tourism administrative department at or above the county level through the government website of the department or the higher-level tourism administrative department. . \x0d\ If the amount of quality guarantee deposit is reduced or the travel agency business license is issued, changed or canceled, the tourism administrative department of the State Council or the provincial tourism administrative department shall make an announcement to the public within 20 working days after making the licensing decision or filing. . \x0d\ If a travel agency operates illegally or has its travel agency business license revoked, the tourism administrative department that made the administrative penalty decision will make an announcement to the public within 10 working days after the penalty takes effect. \x0d\  Information on tourists’ complaints against travel agencies will be announced to the public every quarter by the tourism administrative department that handles complaints. \x0d\ Article 49 If any of the following circumstances causes damage to the legitimate rights and interests of tourists, tourists have the right to complain to the tourism administrative department at or above the county level: \x0d\ (1) Travel agencies violate the "Regulations" and As stipulated in these Implementation Rules; \x0d\ (2) The services provided by the travel agency do not meet the service standards or grades agreed in the travel contract; \x0d\ (3) The travel agency goes bankrupt or other reasons cause losses to tourists in advance of travel expenses. \x0d\ The decision to allocate quality guarantee funds to travel agencies shall be made by the tourism administrative department at or above the county level that handles tourist complaints where the travel agency or its branch is located. \x0d\ Article 50 Tourism administrative departments at or above the county level may, within their statutory authority, entrust tourism quality supervision and law enforcement agencies at the same level that meet statutory conditions to conduct supervision and inspections. \x0d\ Chapter 6 Legal Responsibilities \x0d\ Article 51 Violates the provisions of Article 12, paragraph 3, Article 23, and Article 26 of these Implementing Rules, introducing foreign investment or establishing service outlets without authorization If a travel agency fails to file within the prescribed time limit, or if a travel agency and its branches and service outlets fail to issue a travel agency business license or registration certificate, the tourism administrative department at or above the county level will order it to make corrections and may impose a fine of not more than 10,000 yuan. \x0d\ Article 52 Violates the provisions of Article 22, Paragraph 3 and Article 28 of these Implementing Rules, if the service outlet exceeds the business scope of the establishment agency to solicit tourists, provide travel consultation services, or the office of a travel agency , liaison offices, representative offices, etc. that engage in travel agency business operations shall be punished by the tourism administrative department at or above the county level in accordance with the provisions of Article 46 of the Regulations. \x0d\ Article 53 If the provisions of Article 32 of these Implementing Rules are violated, if the transportation, accommodation, catering, scenic spots and other enterprises selected by a travel agency to receive tourists do not have legal business qualifications or reception service capabilities, the county shall The tourism administrative department at or above the provincial level shall order corrections, confiscate the illegal income, and impose a fine of less than three times the illegal income but not exceeding 30,000 yuan. If there is no illegal income, a fine of not more than 10,000 yuan shall be imposed. \x0d\ Article 54 violates the provisions of Article 33 of these Implementation Rules by requiring tourists to participate in shopping activities arranged by travel agencies, tourism projects that require tourists to pay separately, or by raising objections to tourists in the same travel group. If other tourists have different contract matters, the tourism administrative department at or above the county level will order them to make corrections and impose a fine of not more than 10,000 yuan. \x0d\ Article 55 If a travel agency violates the provisions of paragraph 2 of Article 34 of these Implementing Rules and fails to inform tourists about the reception of travel agencies at tourist destinations, the tourism administrative department at or above the county level shall, in accordance with the "Regulations" Penalties specified in Article 55. \x0d\ Article 56 If a travel agency violates the provisions of paragraph 2 of Article 35 of these Implementing Rules and transfers tourists to other travel agencies for organization and reception without the consent of the tourists, it shall be managed by the tourism administration at or above the county level. If any, the tourism administrative department at or above the county level shall impose penalties in accordance with the provisions of Article 59 of the Regulations. \x0d\ Article 58 Anyone who violates the provisions of Article 44 of these Implementation Rules by failing to properly preserve various travel contracts and related documents and materials, with a retention period of less than two years, or leaking personal information of tourists, shall be prosecuted by the county level The above tourism administrative departments shall order corrections, confiscate illegal gains, and impose a fine of less than three times the illegal gains but not exceeding 30,000 yuan; if there are no illegal gains, a fine of less than 10,000 yuan shall be imposed. \x0d\ Article 59 The administrative penalty of revoking the travel agency business license shall be imposed by the original licensing tourism administrative department at or above the provincial level. \x0d\ If an administrative penalty is imposed on a travel agency for suspension of business for rectification, the travel agency shall not solicit tourists or sign travel contracts during the period of suspension of business for rectification; the period of suspension of business for rectification shall not affect the performance of the signed travel contract. \x0d\ Chapter 7 Supplementary Provisions\x0d\ Article 60 These implementation rules shall be interpreted by the tourism administrative department of the State Council. \x0d\ Article 61 These Implementing Rules shall come into effect on May 3, 2009. The "Implementation Rules of the Travel Agency Management Regulations" announced by the National Tourism Administration on December 27, 2001 were abolished at the same time.
