Can the tour organized by the company take the place of annual leave?

There are preconditions.

The Regulations on Paid Annual Leave for Employees stipulates that the unit shall make overall arrangements for employees' annual leave, taking into account employees' own wishes. "Unit tourism" is not a time when workers can freely control their rest, so it should not be treated as annual leave. Unless the unit and employees reach an agreement in advance or comply with the legal and effective rules and regulations of the unit.

Regulations on paid annual leave

Article 1 These Regulations are formulated in accordance with the Labor Law and the Civil Service Law in order to protect the right of workers to rest and vacation and arouse their enthusiasm for work.

Article 2 Employees of government organs, organizations, enterprises, institutions, private non-enterprise units and individual industrial and commercial households with employees who have worked continuously for more than 1 year shall enjoy paid annual leave (hereinafter referred to as annual leave). The unit shall ensure that employees enjoy annual leave. During the annual leave, employees enjoy the same salary as during normal work.

Article 3 If an employee has worked for more than 1 year but less than1year, he/she shall have an annual leave of 5 days; Annual leave 10 days if it is over/kloc-0 years but less than 20 years; Annual leave 15 days for those who have completed 20 years.
