Measures of Hebei Province for Implementing the Law of the People's Republic of China on Road Traffic Safety

(Adopted at the 25th meeting of the Standing Committee of the Tenth People's Congress of Hebei Province on June 25th, 2006 +065438+)

Chapter I General Provisions

Article 1 These Measures are formulated in accordance with the Road Traffic Safety Law of the People's Republic of China and the Regulations for the Implementation of the Road Traffic Safety Law of the People's Republic of China, combined with the actual situation of this province.

Article 2 These Measures shall apply to drivers, pedestrians, passengers and units and individuals related to road traffic activities within the administrative area of this province.

Article 3 People's governments at or above the county level shall strengthen road traffic safety work, increase investment in road traffic safety infrastructure and scientific and technological management means, improve the modernization level of road traffic safety management, and ensure the coordinated development of road traffic safety work and economic construction.

The people's governments at or above the county level shall establish a coordination mechanism for road traffic safety work and an accountability system for road traffic safety; Commend and reward citizens, legal persons and other organizations that have made outstanding contributions to road traffic safety.

The township (town) people's government shall urge the units under its jurisdiction to implement the responsibility system for road traffic safety and eliminate traffic safety hazards in a timely manner.

Article 4 The traffic administrative department of the public security organ of the people's government at or above the county level shall be responsible for the management of road traffic safety in their respective administrative areas.

The competent department of agriculture (agricultural machinery) of the people's government at or above the county level is responsible for the registration of tractors on the road, issuing registration certificates, number plates, driving licenses and safety technical inspection marks, as well as the issuance, verification and use management of driver's exams and driving licenses.

The departments of transportation, construction, planning, urban management, production safety supervision and management, quality and technical supervision, industrial and commercial administration, environmental protection, health, supervision, education, finance and price of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in road traffic safety.

Fifth newspapers, radio, television, Internet and other news media should regularly carry out publicity and education on road traffic safety, and timely release public service advertisements, information and management measures on road traffic safety.

Chapter II Vehicles and Drivers

Article 6 When a motor vehicle runs on the road, it shall comply with the following provisions in addition to the relevant provisions of laws and administrative regulations on road traffic safety:

(1) No license plate other than the statutory motor vehicle license plate shall be hung;

(two) the school bus carrying primary and secondary school students and kindergarten children should be painted with uniform signs on both sides of the body;

(3) On both sides of the cab of large and medium-sized passenger vehicles and freight vehicles, the name and residence of the owner of the vehicle, the number of passengers allowed or the approved weight are painted, and the enlarged motor vehicle number plate number is painted on the rear of the vehicle body;

(four) motor vehicle spraying, labeling or body advertising, shall not affect the safe driving;

(five) the taxi sign is installed in the taxi, and the name of the operator is sprayed on both sides of the cab;

(six) the vehicle is equipped with fire fighting equipment and warning signs for faulty vehicles;

(seven) shall not install and use photoelectric equipment, loudspeakers, high-power audio and other devices that affect road traffic safety.

Article 7 When recycling scrapped motor vehicles, an enterprise for recycling scrapped motor vehicles shall register the identity certificate of the owner of the scrapped motor vehicle, the license plate number, engine number, driving license and other information, and issue a certificate for recycling scrapped motor vehicles to the owner of the motor vehicle.

Article 8 Non-motor vehicles that should be registered according to law can only drive on the road after being registered by the traffic administrative department of the public security organ.

The types of non-motor vehicles that should be registered according to law shall be stipulated by the provincial people's government according to the actual situation of this province.

Ninth police cars, fire engines, ambulances, engineering rescue vehicles, the installation and use of sirens and sign lamps, should be reported to the traffic management department of the provincial public security organs for approval, to obtain a license.

Tenth school bus drivers who pick up primary and secondary school students and kindergarten children should have more than three years of safe driving experience of the corresponding quasi-driving type.

Article 11 When dealing with road traffic safety violations, the traffic administrative department of the public security organ and its traffic police shall record the drivers' road traffic safety violations, cumulative scores, administrative penalties given and the specific circumstances of road traffic accidents, and provide them to the drivers, their units, insurance institutions and relevant departments.

The traffic administrative department of the public security organ shall provide online inquiry, SMS inquiry, telephone inquiry and traffic police help inquiry to facilitate the relevant units and individuals to inquire about traffic safety information.

Article 12 The traffic administrative department of the public security organ shall set up information inquiry windows or electronic inquiry equipment in places where traffic management business is concentrated. If possible, it may set up a home page of traffic management information on the Internet, so as to facilitate the people to inquire about the relevant provisions and information such as handling motor vehicle registration and applying for motor vehicle driver's license.

Article 13 The traffic administrative department of the public security organ shall implement the public commitment system for the time limit for processing motor vehicle number plates. If the application materials are complete and conform to the statutory form, it shall be completed within one working day; If the application materials are incomplete or inconsistent with the statutory form, the applicant shall be informed of all the contents that need to be supplemented at one time.

Chapter III Road Traffic Conditions

Article 14 When examining and approving large-scale buildings and other major construction projects along urban roads, the planning administrative department shall, jointly with the traffic administrative department of the public security organ, conduct traffic impact assessment, and make adjustments if it does not meet the requirements for safe and smooth road traffic.

Fifteenth new construction, renovation and expansion of roads, traffic safety facilities should be designed, constructed, accepted and put into use at the same time.

On the sidewalks of major urban roads, blind roads and kerb ramps should be set up to facilitate the passage of the disabled.

Article 16 Traffic safety facilities such as traffic lights, traffic signs, traffic markings and traffic isolation guardrails on urban roads shall be set up and maintained by the traffic management department of the local public security organ. Setting costs are included in the budget of road construction projects, and maintenance costs are included in the local financial budget.

Road traffic safety facilities built by units and individuals to allow social motor vehicles to pass shall be set up and maintained by units or individuals.

Article 17 Highway departments should set up standardized warning signs, yield signs, marking lines and deceleration devices at obvious positions at intersections of national highways, provincial highways and county roads.

Eighteenth due to construction needs to interrupt the traffic of expressway, national and provincial roads, it shall obtain the consent of the traffic management department of the provincial public security organ; If it needs to be closed at half width, it shall obtain the consent of the traffic management department of the municipal public security organ with districts.

In case of traffic jam or other emergencies, the traffic administrative department of the public security organ may request to temporarily stop road construction and temporarily resume traffic.

Article 19 When planning parking spaces on urban roads, the traffic administrative department of the public security organ shall solicit the opinions of the competent department of urban roads in writing, and adjust the use time of parking spaces according to the changes of traffic flow. Other units and individuals are not allowed to set up or dismantle parking spaces on urban roads, or set up parking obstacles in parking spaces.

Twentieth people's governments at or above the county level shall, according to the urban and rural development and the traffic needs of residents, give priority to the development of public transport to facilitate urban and rural residents to travel.

The relevant competent departments shall listen to the opinions of the traffic management department of the public security organ and the residents along the line before the examination and approval of the opening and adjustment of the bus, coach and tourist bus routes and stations.

The traffic administrative department of the public security organ shall, jointly with the relevant departments, set up temporary taxi stops on the main roads of the city according to the local traffic conditions. On urban roads with temporary parking stations, taxis are not allowed to stop outside the station to carry passengers.

Chapter IV Road Traffic Regulations

Section 1 General Provisions

Twenty-first in case of large-scale mass activities, large-scale construction, etc., when the traffic management department of the public security organ needs to take traffic restriction measures or make decisions directly related to public road traffic activities, it shall announce it to the public in advance.

Twenty-second motor vehicles really need to pass in restricted areas or road sections, they should carry the pass certificate issued by the traffic management department of the public security organ with them and pass in accordance with the designated time, area and route.

Twenty-third motor vehicles should run in motor vehicle lanes. Where there are more than two motor vehicle lanes in the same direction, freight motor vehicles, large passenger motor vehicles, low-speed trucks, three-wheeled vehicles, tractors, wheeled special-purpose mechanical vehicles, empty taxis and motor vehicles driven during the internship period should drive in the slow lane, and motorcycles should drive in the rightmost lane. On roads with main roads and auxiliary roads, low-speed trucks, tricycles, tractors, wheeled special-purpose mechanical vehicles and motorcycles should run on the auxiliary roads.

Non-motor vehicles should drive in non-motor vehicle lanes; On the road without non-motor vehicle lanes, you should drive on the right side of the roadway.

Pedestrians should walk on the sidewalk; If there is no sidewalk, you should walk on the side of the road.

Article 24 Local people's governments at or above the county level may impose restrictions on large trucks, motorcycles, human tricycles and motor tricycles entering the city center according to the road traffic conditions in the city center, and the contents of the restrictions shall be decided and announced after hearing.

Section 2 Motor Vehicle Traffic Regulations

Twenty-fifth motor vehicles can borrow roads or change lanes without affecting the normal running of other vehicles, but they shall abide by the following provisions:

(1) Let the vehicles driving in the borrowed lane go first;

(2) Driving in sequence, and not changing lanes frequently;

(3) Vehicles that should drive in the slow lane are allowed to overtake on the road without hindering the normal driving of vehicles in the fast lane, but return to the original lane immediately after overtaking;

(4) When the vehicles in the left and right lanes are changed to the same lane, the vehicles in the left lane will let the vehicles in the right lane go first;

(five) when the vehicle driving in the fast lane is lower than the prescribed minimum speed, it will be changed to the slow lane in time.

Twenty-sixth in the time specified by the traffic administrative department of the public security organ, the bus lane allows the school bus to pick up and drop off primary and secondary school students and kindergarten children; In case of traffic control and traffic jam, other vehicles can borrow bus lanes under the command of the traffic police.

Twenty-seventh in the same direction, there are more than two motor vehicles on the road without speed limit signs and markings, and the maximum speed of motor vehicles in urban closed motor vehicles is 90 kilometers per hour; The unclosed motor vehicle road in the city is sixty kilometers; It's eighty kilometers on the highway.

Twenty-eighth schools, kindergartens, nursing homes, hospitals in front of the road without crossing facilities, should be a crosswalk, set up signs.

When a motor vehicle meets the blind, the disabled, pregnant women, the elderly and children, it should stop and make way.

Twenty-ninth motor vehicles turn, change lanes, overtake, turn around or park on the side of the road, and should turn on the turn signal 100 to 50 meters in advance.

Article 30 When a motor vehicle enters or leaves the road, it should give way to pedestrians and vehicles running normally on the road. When driving into or out of a road with a main road and an auxiliary road, a motor vehicle driving into the main road should give way to vehicles driving normally on the main road and driving out of the main road.

Thirty-first motor vehicles running on roads with water, mud or dust should slow down when they meet pedestrians and vehicles.

Article 32 It is forbidden to carry people on freight car trailers, semi-trailers, flatbed cars, cranes, dump trucks and tractor trailers.

Thirty-third motor vehicles traction fault motor vehicles on the road should comply with the following provisions:

(a) the driver of the tractor and the towed vehicle has obtained the motor vehicle driver's license for more than one year;

(2) When soft connection is used for traction at night, a reflective sign is set on the traction device;

(three) if there are more than two motor vehicle lanes in the same direction, driving in the slow lane;

(four) there are auxiliary roads on the road, driving on the auxiliary road;

(5) Full trailers and motor vehicles loaded with dangerous goods shall not tow faulty motor vehicles.

Thirty-fourth motor vehicles parked on the road, temporary parking shall comply with the following provisions:

(1) If there is no parking lot or road parking berth specified by traffic signs or markings, park it in a place that does not hinder traffic;

(two) according to the direction of parking, car body close to the right side of the road edge line, shall not exceed thirty centimeters;

(three) when there is no street lighting at night or in case of fog, rain, snow, dust and other low visibility meteorological conditions, turn on the hazard warning flash, position light and rear position light;

(four) the bus * * * near the roadside, in order, single row in and out of the parking site, not outside the site parking passengers.

Thirty-fifth driving test vehicles on the road shall comply with the following provisions:

(a) the driver has obtained a motor vehicle driver's license for more than one year;

(2) Driving according to the time and route designated by the traffic administrative department of the public security organ;

(three) shall not take personnel unrelated to the trial operation;

(4) No braking test shall be conducted.

Article 36 When a freight motor vehicle is loaded with articles that are easy to scatter or float, it shall use a closed cargo hold or adopt other methods to seal it tightly.

Article 37 When a freight motor vehicle carries indecomposable articles beyond the limit, it shall take measures to ensure traffic safety according to the requirements of the traffic management department of the public security organ, and the required road inspection and traffic organization and guidance fees shall be paid by the carrier.

Thirty-eighth tractors are prohibited from passing through urban expressways, motor vehicles and main roads of national and provincial highways with auxiliary roads. On the road where tractors are forbidden to pass, obvious no-pass signs should be set at the entrance.

When a tractor needs to pass through a restricted road due to transitional operation, it shall pass with a driver's license and pass certificate obtained according to law.

When the tractor turns around on the road, the driver should signal.

Section 3 Traffic Rules for Non-motor Vehicles, Pedestrians and Passengers

Thirty-ninth driving a non-motor vehicle shall comply with the following provisions:

(1) Driving forward on a non-motor vehicle lane;

(two) are not allowed to enter the city expressway and motor vehicle lane;

(three) keep a safe distance from the adjacent non-motor vehicles, and non-motor vehicles with a body width of more than one meter shall not drive in parallel;

(four) to avoid pedestrians when driving on a road mixed with pedestrians or passing through a crosswalk;

(five) it is forbidden to drive or park vehicles in the no-motor vehicle area at the intersection;

(six) if there is a turn signal, turn on the turn signal before turning or turning around;

(seven) brake failure shall not be on the road;

(eight) a bicycle shall not carry a person who has reached the age of twelve, and a person under the age of sixteen shall not carry a person when driving a bicycle;

(nine) driving human tricycles manned shall not exceed two people, and the disabled wheelchair can only be accompanied by an escort.

Fortieth pedestrians on the road shall not have the following acts:

(1) Sitting, staying, frolicking, selling, sending articles, advertising, begging or asking for property on the roadway;

(2) Crossing, crossing and leaning against road isolation facilities;

(three) the central city roads and motor vehicles in large and medium-sized cities.

If pedestrians can't pass on the sidewalk, they can borrow adjacent lanes to pass, and passing vehicles should avoid them.

Article 41 A motor vehicle shall comply with the following provisions:

(a) when the motor vehicle is not parked, it is not allowed to get on or off;

(2) Do not pick up vehicles, get up and down windows or park motor vehicles in places where parking is prohibited;

(three) knowing that the driver of a motor vehicle is drinking, he shall not take a motor vehicle;

(four) riding a two-wheeled motorcycle should sit in the back seat of the driver.

Section IV Special Provisions of expressway

Article 42 In case of natural disasters, bad weather conditions, construction or traffic accidents that seriously affect traffic safety, the traffic management department of the public security organ may take traffic control measures such as speed limit, lane change, suspension of traffic and closure of expressway. When taking traffic control measures, it shall promptly inform the relevant departments, set up traffic signs and make an announcement.

Article 43 Except for police cars, fire engines, ambulances and engineering rescue vehicles that perform traffic safety management or traffic accident handling tasks on expressway, motor vehicles driving on expressway should stop and wait in turn in case of traffic jam ahead, vehicles waiting in line or driving slowly. Do not drive or park on the right shoulder or emergency lane.

Article 44 When a motor vehicle running on expressway breaks down or needs to stop immediately in case of emergency such as vehicle dropping, drifting, sudden illness of the driver or passengers, it shall stop on the right shoulder or emergency lane.

Chapter V Prevention and Treatment of Traffic Accidents

Forty-fifth people's governments at or above the county level shall formulate emergency plans to deal with natural disasters, bad meteorological conditions and other emergencies that affect road traffic safety. Public security, transportation, construction, health, environmental protection and other relevant departments shall formulate specific implementation plans.

Forty-sixth state organs, enterprises and institutions, social organizations and other organizations shall establish and implement the responsibility system for road traffic safety prevention within their own units, and incorporate it into the assessment content of comprehensive management of social security:

(a) the establishment of motor vehicle drivers road traffic safety education, training, assessment and management system;

(two) to establish the use, maintenance, repair and inspection system of motor vehicles in this unit, and to keep the vehicles in line with the national safety technical standards;

(three) professional transport units and units with more motor vehicles shall be equipped with full-time traffic safety personnel.

Motor vehicle drivers' trade organizations shall safeguard the legitimate rights and interests of drivers according to law and educate them on road traffic safety laws and regulations. ......
