Regulations of the Tibet Autonomous Region on the Management of Foreigners Coming to Tibet for Mountaineering
Chapter 1 General Provisions Article 1 These Regulations are formulated in order to develop the mountaineering industry in the Tibet Autonomous Region and strengthen the management of foreigners coming to climb mountains in the Tibet Autonomous Region. Article 2 These Regulations shall apply to all mountaineering expeditions, alpine skiing, alpine gliding, rock climbing and other alpine adventure activities (hereinafter referred to as mountaineering activities) on peaks above 5,500 meters above sea level in the Tibet Autonomous Region. Article 3 The mountain peaks in the Tibet Autonomous Region are national resources of the People’s Republic of China. The opening of the mountain to the outside world shall be submitted by the People's Government of the Tibet Autonomous Region to the State Council of the People's Republic of China for approval. Article 4: Foreign mountaineering teams (hereinafter referred to as foreign teams) are allowed to carry out mountaineering activities on mountain peaks that are open to the outside world. Article 5 Foreign teams coming to Tibet for mountaineering activities must abide by the laws of the People's Republic of China, these Regulations and the relevant management regulations for foreigners of the Tibet Autonomous Region, and their legitimate rights and interests are governed by the laws and regulations of the People's Republic of China. regulatory protection. Article 6 The Tibet Autonomous Region Sports Committee (hereinafter referred to as the Tibet Autonomous Region Sports Committee) is the administrative department of the People's Government of the Tibet Autonomous Region that manages mountaineering activities. It is responsible for the implementation of these regulations and the unified management of mountaineering activities in the Tibet Autonomous Region. The Tibet Autonomous Region Sports Commission authorizes the Tibet Autonomous Region Mountaineering Association to be specifically responsible for and manage mountaineering activities in the Tibet Autonomous Region. Chapter 2 Mountaineering Procedures Article 7 Foreigners who come to Tibet to climb mountains can form their own teams or form a joint team with a Chinese team. Article 8 Foreign teams coming to Tibet for mountaineering activities should directly submit a written application to the Tibet Autonomous Region Mountaineering Association.
If a foreign team and a Chinese team form a Sino-foreign joint team to carry out mountaineering activities, the Chinese team shall submit a written application to the Tibet Autonomous Region Mountaineering Association. Article 9 Written applications may take the following forms:
(1) Fill in the mountaineering application form;
(2) Fax with pictures and text;
(3) Telephone Transmission and telegram;
(4) Letter.
The written application should contain the following contents:
(1) Name, altitude and geographical location of the mountain to be climbed;
(2) Climbing time and route (Including routes into the Tibet Autonomous Region);
(3) Number of people in the mountaineering team;
(4) Applicant’s name, nationality, residence, telex, fax, and phone number ;
(5) Services required to be provided by the Tibet Autonomous Region Mountaineering Association. Article 10: After the Tibet Autonomous Region Mountaineering Association receives an application for mountaineering activities from a foreign team or a Chinese-foreign joint team, the Tibet Autonomous Region Sports Committee will make a decision on approval or disapproval within 60 days and notify the applicant in writing. Article 11: After receiving the approved mountaineering notice, the foreign team shall sign a mountaineering protocol with the Tibet Autonomous Region Mountaineering Association, pay the mountaineering registration fee, and obtain a mountaineering permit within 60 days.
A copy of the mountaineering protocol signed between the Tibet Autonomous Region Mountaineering Association and the foreign team shall be reported by the Tibet Autonomous Region Sports Commission to the Sports Commission of the People's Republic of China and the State Sports Commission (hereinafter referred to as the National Sports Commission) for record. Article 12 Once the mountaineering protocol is signed, it cannot be changed at will. If there is any change, the contracting parties should negotiate to confirm the changed part or go through the climbing procedures again. Article 13 The funds required for foreign teams to carry out mountaineering activities in the Tibet Autonomous Region shall be budgeted by the Tibet Autonomous Region Mountaineering Association in accordance with the charging items and standards announced by the National Sports Commission. Foreign teams should remit the entire budget to the Tibet Autonomous Region Mountaineering Association thirty days before entering the Tibet Autonomous Region. Article 14: If a foreign team cancels its mountaineering activities due to its own reasons after paying the mountaineering registration fee, the registration fee paid will not be refunded, the mountaineering license received will be invalid, and the agreement signed with the Tibet Autonomous Region Mountaineering Association will be terminated. Article 15 With the approval of the Tibet Autonomous Region Sports Commission, several mountaineering teams can climb the same peak at the same time on the same route. Article 16 Foreign teams entering the country carrying supplies necessary for mountaineering must declare separately as "specially permitted imported items" and "temporarily imported items". After approval by the People's Republic of China and the Customs of the People's Republic of China, taxation and guarantee procedures will be processed. Article 17 A reasonable amount of special food, first-aid medicines, cold-proof clothing, fuel and other consumable items among mountaineering materials can be imported duty-free; if the amount exceeds a reasonable amount, tax must be paid.
Communications, photography, video, surveying and mapping equipment and special transportation vehicles permitted by the relevant departments of the Tibet Autonomous Region can enter the country temporarily duty-free. After the mountaineering activity is over, the above-mentioned materials must be re-transported out of the country. If it cannot be re-exported out of the country due to special reasons, the procedures must be handled through the Tibet Autonomous Region Sports Commission in accordance with the relevant regulations of the People's Republic of China and the State. Article 18 Specimens, samples, fossils and video materials collected by foreign teams and Chinese-foreign joint teams during mountaineering can only be carried out of the country after being inspected and approved by the relevant departments of the Tibet Autonomous Region. Article 19 Foreign journalists who report with a team should apply for mountain climbing at the same time, and the Tibet Autonomous Region Sports Commission will transfer it to the Foreign Affairs Office of the Tibet Autonomous Region People's Government for relevant procedures. Chapter 3 Mountaineering Incidental to Scientific Investigation or Surveying and Mapping Article 20 If a foreign team’s mountaineering is incidental to scientific investigation or surveying and mapping, it must apply for a scientific investigation or surveying and mapping plan at the same time as the application for mountaineering. The plan will be forwarded by the Tibet Autonomous Region Sports Commission to the Tibet Autonomous Region Science and Technology Commission or the Tibet Autonomous Region. Approved by the Bureau of Surveying and Mapping.
Article 21 If mountaineering is approved to be accompanied by a scientific investigation, the following samples and information must be provided to the Science and Technology Commission of the Tibet Autonomous Region through the Chinese contracting unit:
(1) List of collected specimens, samples and fossils;
(2) Discovered new species of animals and plants or special groups of animals and plants;
(3) Collected true type specimens of new species of animals and plants, and specimens of special missing animal and plant groups ;
(4) Indoor analysis results of specimens, samples, and fossils;
(5) Copies of audio and video materials accompanying scientific investigations during mountain climbing.
