Article 1 In order to strengthen the protection, development and utilization of tourism resources, promote the development of tourism in Xiamen, and speed up the construction of Xiamen as a port scenic city, these Provisions are formulated in accordance with the relevant provisions of the state and the actual situation of Xiamen. Article 2 The protection, development and utilization of tourism resources within the jurisdiction of Xiamen City must abide by these Provisions.

The term "tourism resources" as mentioned in these Provisions refers to the natural and social factors that can attract tourists and be used by the tourism industry, and thus produce certain economic and social benefits. Tourism resources are divided into natural resources and human resources. Article 3 The management of tourism resources shall adhere to the principle of paying equal attention to the protection and proliferation of resources and the development and utilization of resources, and the synchronous planning and coordinated development of resources protection and development and urban and rural economic construction. Article 4 All units and individuals have the obligation to protect tourism resources according to law, and have the right to put forward opinions and suggestions on the protection and development of tourism resources, and report and accuse the units and individuals that destroy tourism resources: Article 5 Encourage domestic capital, foreign capital and all sectors of society to invest in the development of tourism resources in Xiamen, and protect the legitimate rights and interests of investors according to law. Article 6 The protection and development of tourism resources must be incorporated into the national economic and social development plans of the people's governments at all levels.

Xiamen Tourism Administration Department (hereinafter referred to as the Municipal Tourism Department) shall make overall planning and coordination on the protection and development of the city's tourism resources according to law, and lead the relevant functional departments of the municipal government and the District People's Government to implement planning, supervision and management on the protection and development of tourism resources according to their respective functions and duties. The planning of tourist areas is jointly reviewed by the municipal tourism department and the municipal planning commission. Eleventh in the planning and development or development and utilization of tourist areas, the biological resources and water resources in this area should be protected, and hunting of wild animals in tourist areas is prohibited, destroying the living environment of wild animals. Maintain the landform and landscape of the tourist area. It is forbidden to cut mountains for quarrying, dig sand to gather judges, cover the water surface, cut down trees and carry out other activities that may change the landform and landscape of tourist areas. Those that have caused ecological damage must be actively rectified and restored within a time limit. Article 12 The scale of development, construction and tourism activities in tourist areas shall not exceed the environmental capacity of tourist areas, and its nature, layout, scale, volume, height, shape, texture and color must be in harmony with the surrounding natural landscape and environment.

Tourist areas should control the intensity of resource development, strengthen green vegetation, reduce building density and floor area ratio, and strictly control building volume and height. No unit or individual may illegally sell, transfer or occupy scenic tourism resources and scenic spots in any name or manner, and change their nature for public sightseeing. The coastal side of island road or seaside road built along the coastline of life and tourism should be used as public rest green space for the convenience of the public, and it is forbidden for any unit or individual to occupy it for other purposes without authorization.

In the coastal areas where people live and travel, the volume and density of buildings should be strictly controlled in the construction of a small number of service facilities for tourism, and it is strictly forbidden to occupy beaches. Fifteenth the development and utilization of ancient sites, celebrities' former residences, historical sites, temple buildings, ancient castles, gardens, characteristic buildings and other human resources as tourism projects should adhere to the principle of strict protection, rational development and sustainable utilization, and their unique historical features should not be changed during the renovation.

To endanger the protection of human resources, the municipal tourism department shall, jointly with the relevant departments, order the construction and business units to take effective protective measures immediately until they are ordered to suspend the development and organization of sightseeing activities.
