Qinghai Province Meteorological Disaster Prevention Regulations
Meteorological disasters mentioned in these Regulations refer to disasters such as drought, rainstorm, blizzard, cold wave, hail, frost, low temperature, high temperature, lightning, strong wind, sandstorm, fog and haze.
The provisions of relevant laws and regulations shall apply to the prevention of derivative and secondary disasters caused by meteorological factors such as floods and droughts, geological disasters, forest and grassland fires, agriculture, animal husbandry and forestry pests. Article 3 Meteorological disaster prevention is a basic public welfare undertaking.
Meteorological disaster prevention work adheres to the principle of people-oriented and scientific defense, and implements the working mechanism of government-led, departmental linkage and social participation. Article 4 People's governments at or above the county level shall strengthen the organization and leadership of meteorological disaster prevention, establish and improve the coordination mechanism of meteorological disaster prevention, improve the meteorological disaster prevention system, incorporate meteorological disaster prevention into the national economic and social development plan at the corresponding level, and include the required funds into the fiscal budget at the corresponding level.
Township (town) people's governments, neighborhood offices and village (neighborhood) committees shall assist in the work of meteorological disaster prevention emergency liaison, information transmission, disaster report and disaster investigation within their respective administrative areas. Article 5 The provincial people's government shall rationally allocate meteorological disaster prevention resources, promote the balanced development of meteorological disaster prevention work, and give support and inclination to the investment in meteorological disaster prevention infrastructure construction and management in meteorological disaster-prone areas and poverty-stricken areas. Article 6 The competent meteorological departments at or above the county level shall be responsible for the prevention of meteorological disasters such as monitoring, forecasting, early warning, risk assessment, climate feasibility demonstration, lightning protection and weather modification within their respective administrative areas.
The relevant departments of the people's government at or above the county level, such as development and reform, land, transportation, public security, education, housing and urban construction, health and family planning, civil affairs, agriculture and animal husbandry, forestry, water conservancy, environmental protection, tourism, urban management, etc., shall, in accordance with the division of responsibilities, do a good job in the prevention of meteorological disasters within their respective administrative areas. Article 7 People's governments at all levels, meteorological departments and other relevant departments, as well as news media, enterprises and institutions, village (neighborhood) committees and communities should adopt various forms to publicize and popularize the knowledge of meteorological disaster prevention and rescue, and enhance the public's awareness and ability of avoiding risks, avoiding disasters, and saving themselves and each other.
Citizens, legal persons and other organizations shall, under the unified organization and guidance of the government, participate in the prevention of meteorological disasters and carry out self-help and mutual rescue after meteorological disasters occur.
Encourage citizens, legal persons and other organizations to transfer or share the risk of meteorological disasters by participating in insurance. Eighth people's governments at or above the county level shall commend and reward the units and individuals that have made outstanding contributions in the prevention of meteorological disasters. Chapter II Preventive Measures Article 9 People's governments at or above the county level shall organize meteorological departments, civil affairs departments and other relevant departments to conduct a general survey of the types, frequencies, intensities and losses caused by meteorological disasters within their respective administrative areas, establish a meteorological disaster database, conduct meteorological disaster risk assessment according to the types of meteorological disasters, delimit meteorological disaster risk areas according to the distribution of meteorological disasters and the results of meteorological disaster risk assessment, and make them public. Tenth people's governments at or above the county level shall organize the competent meteorological departments and relevant departments to strengthen supervision and inspection of units in areas with high risk of meteorological disasters, focusing on inspection of meteorological disaster prevention facilities, measures and management.
Units in areas with high risk of meteorological disasters shall incorporate meteorological safety guarantee into the safety production work of their own units, and carry out investigation on hidden dangers of meteorological disasters at least once a year. Eleventh people's governments at or above the county level shall organize the competent meteorological departments and relevant departments to prepare meteorological disaster prevention plans, report them to the people's government at the next higher level and relevant departments for the record, and make timely revisions according to the local economic and social development.
The overall land use planning, urban and rural planning and other special planning should be linked with the meteorological disaster prevention planning. Twelfth people's governments at or above the county level and meteorological departments shall, according to the meteorological disaster prevention plan, strengthen the infrastructure construction of meteorological disaster monitoring, forecasting, early warning and emergency response.
No unit or individual may occupy, destroy or move meteorological disaster prevention facilities and signs without authorization, and shall not endanger the meteorological observation environment within the protection scope of meteorological disaster prevention facilities. Thirteenth people's governments at or above the county level shall organize relevant departments to formulate emergency plans for meteorological disasters in their respective administrative areas according to the meteorological disaster prevention plans and local meteorological disasters, and report them to the people's government at the next higher level and relevant departments for the record.
Industries and units susceptible to meteorological disasters shall formulate corresponding emergency plans for meteorological disasters according to actual conditions. Fourteenth meteorological disaster emergency plan should include the start-up standards and procedures of emergency plan, emergency organization and command system and its responsibilities, prevention and early warning mechanism, emergency treatment measures and safeguard measures. Fifteenth people's governments at all levels and meteorological departments shall, according to the characteristics of meteorological disasters, organize emergency drills for meteorological disasters. Enterprises and institutions, village (neighborhood) committees and communities shall assist the local people's governments to do a good job in meteorological disaster emergency drills.
