Regulations of Hubei Province on Meteorological Disaster Prevention (revised 20 17)

Chapter I General Provisions Article 1 In order to strengthen the prevention of meteorological disasters, actively respond to climate change, avoid and mitigate losses caused by meteorological disasters, ensure the safety of people's lives and property, and promote comprehensive, coordinated and sustainable economic and social development, these Regulations are formulated in accordance with the provisions of the Meteorological Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to meteorological disaster prevention activities within the administrative area of this province.

Meteorological disasters mentioned in these Regulations refer to disasters caused by rainstorm (snow), drought, fog, haze, lightning, strong wind, low temperature, high temperature, hail, frost, cold wave and typhoon.

Where laws and administrative regulations have other provisions on the prevention and control of derivative and secondary geological disasters, forest fires, pests and diseases, environmental pollution and epidemics caused by meteorological factors, those provisions shall prevail. Article 3 Meteorological disaster prevention is a basic public welfare undertaking. Meteorological disaster prevention adheres to the principles of government-led, departmental linkage, social participation and scientific defense. Article 4 The people's governments at or above the county level shall strengthen their leadership in meteorological disaster prevention, incorporate meteorological disaster prevention into the national economic and social development plan of the region, improve the construction of meteorological disaster prevention system, and establish and improve the coordination mechanism for meteorological disaster prevention and the responsibility system for disaster prevention and mitigation.

Meteorological disaster prevention work should be based on the overall requirements of meteorological modernization, improve the ability of meteorological forecasting, meteorological disaster prevention and mitigation, coping with climate change and developing and utilizing meteorological resources. Fifth competent meteorological departments at or above the county level shall be responsible for the monitoring, forecasting, early warning, evaluation and weather modification management of meteorological disasters within their respective administrative areas; Guide relevant parties to carry out meteorological disaster prevention activities; Assist relevant departments in monitoring, forecasting, early warning and disaster reduction of meteorological derivative and secondary disasters.

The relevant departments of the people's governments at or above the county level shall, in accordance with the division of responsibilities, do a good job in meteorological disaster prevention.

Township people's governments, sub-district offices and community and village (neighborhood) committees shall integrate the existing disaster prevention human resources at the grassroots level, and equip and clarify meteorological disaster prevention assistants and information officers. Under the leadership and guidance of the local people's government and relevant departments, assistants and information officers carry out meteorological disaster prevention facilities management, meteorological disaster collection, meteorological disaster early warning information release, meteorological science popularization and meteorological service for agriculture. Article 6 The provincial people's government shall rationally allocate meteorological disaster prevention resources, promote the balanced development of meteorological disaster prevention work, and support and tilt the investment in the construction, operation, management and maintenance of disaster shelters and public lightning protection facilities in old revolutionary base areas, ethnic minority areas and poverty-stricken areas. Seventh all units and individuals have the obligation to participate in meteorological disaster prevention activities, and actively carry out self-help and mutual rescue after meteorological disasters.

Units and individuals that have made outstanding contributions to the prevention of meteorological disasters shall be commended and rewarded. Chapter II Disaster Prevention Article 8 People's governments at or above the county level shall organize meteorological departments and other relevant departments to conduct a general survey of meteorological disasters within their respective administrative areas, establish a meteorological disaster database, conduct meteorological disaster risk assessment according to the types of meteorological disasters, delimit meteorological disaster risk areas, set up early warning signs and make an announcement.

Meteorological disaster risk assessment shall include the following contents:

(1) Historical and current situation analysis of meteorological disasters;

(2) Meteorological disaster risk prediction;

(3) Countermeasures and measures to prevent or mitigate the impact of meteorological disasters;

(4) The conclusion of meteorological disaster risk assessment. Article 9 People's governments at or above the county level shall organize relevant departments to formulate meteorological disaster prevention plans in their respective administrative areas according to local meteorological disaster characteristics, risk assessment results and economic and social development trends, and make timely revisions according to the changes of meteorological disasters.

Meteorological disaster prevention planning shall include the following main contents:

(a) the guiding ideology, principles, objectives and tasks of meteorological disaster prevention;

(2) Forecasting, forecasting and evaluating the present situation and development trend of meteorological disasters;

(3) Meteorological disaster-prone areas and key defense areas;

(4) Meteorological disaster prevention standards;

(five) meteorological disaster prevention projects, measures and implementation plans;

(six) the construction and management of meteorological disaster prevention facilities;

(7) Emergency measures for meteorological disasters;

(eight) other contents stipulated by laws and regulations. Tenth meteorological disaster prevention planning should be used as an important basis for the preparation of urban and rural planning, regional and river basin construction, development and utilization planning and overall land use planning.

The site selection and construction of major infrastructure projects such as land and resources, environmental protection, transportation, agriculture, forestry, water conservancy, communications, energy and tourism should meet the requirements of preventing meteorological disasters. Article 11 People's governments at all levels, relevant departments and units shall, according to the disastrous weather conditions and forecasts provided by the meteorological stations (stations) under the local competent meteorological departments, timely organize inspections of various drainage facilities and strengthen inspections of geological disasters and flood-prone areas; Patrol electric power and communication lines in time, and make preparations for traffic diversion, snow (ice) removal and line maintenance; Timely organize and carry out supervision and inspection on wind prevention and avoidance of rivers, lakes, reservoirs, ports, construction sites and buildings.
