Measures of Qingdao Municipality on the Administration of Safe Production of Marine Fisheries

Article 1 In order to strengthen the management of fishery production safety, maintain the order of fishery production, ensure the safety of fishermen's lives and property, and promote the development of fishery production, these Measures are formulated in light of the actual situation of our city. Article 2 These Measures shall apply to vessels, installations and personnel engaged in marine fishing and shallow beach culture within the jurisdiction of this Municipality, as well as fishing vessels, installations and their owners and operators entering and leaving coastal fishing ports and fishing port waters of this Municipality. Article 3 The management of fishery safety production must implement the policy of "safety first, prevention first" and adhere to the principle of "management of production must be managed with safety". Article 4 The fishery administrative departments of Qingdao and coastal county-level cities (districts) shall be responsible for the supervision and management of fishery safety production within their respective jurisdictions. The specific work shall be the responsibility of the fishery administration and fishing port supervision and management institution to which it belongs. Fifth city and coastal county-level city (District) people's governments and coastal township (town) people's governments shall set up leading institutions for fishery safety production, which shall be responsible for fishery safety production within their respective jurisdictions. Article 6 Vessels engaged in fishery production must obtain corresponding valid certificates and certificates according to regulations, be equipped with fire fighting, lifesaving, navigation aids, signals and other equipment, be equipped with charts and navigation records, and be equipped with qualified crew. Article 7 Fishing vessels under any of the following circumstances shall not engage in fishery production:

(a) certificate, certificate is not neat or expired;

(two) navigation, signal, life-saving, fire fighting, communication equipment and anchors, cables, warehouses and other accessories are not unified or invalid;

(3) The technical conditions of the hull and mechanical equipment do not meet the safety requirements;

(four) the illegal act has not been closed;

(five) other circumstances that do not meet the safety requirements.

Fishing boats are strictly prohibited from overloading, carrying passengers and loading dangerous goods; Fishing boats are prohibited from changing the nature of operations without authorization. Article 8 After the name, serial number and port of registry of fishing vessels are approved, they must be marked and fixed in accordance with regulations; Changes in the name, number and port of registry of a ship must be approved by the original approving authority. Article 9 When fishing vessels are berthed or anchored, they must be equipped with drivers and other personnel on duty in accordance with regulations, ensure safety and manipulation at any time, and take effective measures against wind, fire, theft and freezing. Tenth fishing boats are strictly prohibited from exceeding the navigation area and exceeding the wind resistance level:

(1) Fishing boats with horsepower below 12 are not allowed to operate in the fishing ground south of Bohai Sea or Haizhou Bay.

(two) fishing vessels moored in the harbor, when encountering a gale of magnitude 5 or above, shall be implemented in accordance with the following provisions:

(1) Fishing boats with wind force above 5, hanging and wooden sails are not allowed to go out to sea;

(2) Fishing boats with winds above 6 and below 60 horsepower are prohibited from going out to sea;

(3) Fishing boats with a wind force of more than 7 and a horsepower of less than 400 are prohibited from going out to sea;

(4) When the wind force is above 8, all fishing boats are prohibited from going out to sea.

Fishing vessels operating at sea must stop their operations and immediately take effective measures to resist wind and shelter from the wind when they encounter the corresponding wind level specified in the second paragraph of the preceding paragraph. It is forbidden to sail through the waves and stand with dead anchors; Forcible towing is prohibited. Article 11 it is forbidden to drive a boat and start a machine after drinking. It is forbidden to wear slippers to work. Fishing boats operating at sea or sailing in stormy weather must wear life jackets.

When a fishing boat sails in bad weather such as fog, rain, wind, snow, etc., as well as in island reef areas, narrow navigation channels and complex sea areas, the captain must steer the boat himself. When icing affects the normal navigation safety, personnel should be organized to break the ice and deice, and the icebreaker must wear a seat belt. Twelfth new, rebuilt or updated fishing boats must be approved by the fishery administration and fishing port supervision and management institutions, and after obtaining the certificate of quasi-construction, they must be built and rebuilt in a shipyard with a shipbuilding license. Fishing vessels shall go through the formalities of annual inspection and annual inspection in accordance with regulations. Article 13 Ordinary crew members, captains (captains, pilots), chief engineers (engineers, drivers) and radio operators (operators) assigned to fishing vessels according to the standard quota must hold qualified job certificates. New crew members of other fishing boats must receive training and obtain certificates before taking up their posts. Fourteenth districts of the city, county-level city (District) fishery administrative departments of fishery radio management agencies, under the leadership of the superior fishery radio management agencies, responsible for the management of fishery radio within their respective jurisdictions. Fifteenth fishing vessels with a length of more than 12 meters shall be equipped with walkie-talkies; Fishing boats with a length of more than 24 meters shall be equipped with intermediate frequency radio and satellite navigation equipment; Returning fishing boats must be equipped with radios and walkie-talkies.

Fishing boats operating in the open sea must be produced in formation and the captain of the fleet must be determined. All fishing boats must be equipped with walkie-talkies, and the captain's boat must be equipped with an intermediate frequency radio device of more than 50 watts, so as to keep in touch with the platform and formation fishing boats at any time, report the situation at sea, accurately grasp the fishing boat movements of the team, and ensure the smooth communication between land and sea. Sixteenth all kinds of fishing vessels must participate in domestic fishing vessel insurance.

The shipowner shall take out employer liability insurance for the crew, and the annual insurance amount shall not be less than RMB 20,000 per person. Article 17 When a fishing vessel fails to rescue itself from an accident at sea, it shall immediately send a distress signal to a nearby vessel, and report the cause, time, place, damage and rescue requirements of the accident to the fishery administration and fishing port supervision and management department in time. After receiving the help report, the relevant departments shall promptly report to the relevant leading organs and must immediately organize rescue.
