In order to implement the spirit of state administration of work safety, the former Ministry of Health, Ministry of Human Resources and Social Security and the All-China Federation of Trade Unions "Notice on Printing and Distributing the Measures for the Administration of Heatstroke Prevention and Cooling" (No.89 issued by the General Administration of Work Safety [2065438+02]), strengthen labor protection in hot and hot weather operations, and safeguard workers' health and related rights and interests, with the consent of the provincial people's government, we decided to adjust the standard of high-temperature allowance for employees in the province. The relevant matters are hereby notified as follows:

1. Distribution scope of high temperature allowance: employers such as enterprises and individual economic organizations that arrange employees to work during high temperature operation and high temperature weather. Balance allocation and self-supporting institutions refer to the implementation.

Second, the conditions and standards for the payment of high temperature allowance: the employer arranges workers in 35? Engaged in outdoor work in high temperature weather above C, and unable to take effective measures to reduce the workplace temperature to 33? If the temperature is lower than C, workers should be paid high temperature allowance. Workers exposed to high temperature in the open air are paid per person per day 12 yuan, and other workers are paid per person per day in 8 yuan, calculated according to the actual attendance days of employees on the job, in June, July, August and September every year.

Three, the high temperature allowance issued by the enterprise is included in the total wages, and is charged to the employee welfare fund, which is not regarded as an integral part of the minimum wage standard.

Fourth, the human resources and social security departments at all levels shall, jointly with the departments of safety production supervision, health and family planning and trade union organizations, urge enterprises and institutions to implement the provisions on heatstroke prevention and cooling in summer workplaces, establish and improve the labor safety and health system, and ensure the normal operation of enterprises and institutions in summer.

Gansu province has adjusted the standard of granting high temperature allowance since this year. It is reported that this adjustment not only adjusted the distribution standard, but also extended the distribution time. Specifically, if the employer arranges the workers to engage in outdoor operations in high temperature weather above 35℃ and cannot take effective measures to reduce the workplace temperature below 33℃, it shall pay the workers a high temperature allowance. Open-air workers in high temperature are allowed to work in 8 yuan every day 12 yuan, and other workers are allowed to work in every day, which will be paid from June to September every year according to the actual attendance days of employees. At the same time, the distribution standard of cool drinks in summer should be appropriately raised, with high-temperature workers in 45 yuan every month, non-high-temperature workers in 40 yuan every month, and general staff (including administrative institutions) in 35 yuan every month. The distribution time is 7, 8 and 9 months (the distribution standard of other health products is still implemented according to Ganlaohu [1992] No.436).

● Salary: per person per day in hot weather above 35℃ 12 yuan.

The adjusted payment standard is: 12 yuan per person per day if the employer arranges workers to engage in outdoor operations in high temperature weather above 35℃; If effective measures cannot be taken to reduce the workplace temperature below 33℃, 8 yuan will be given to everyone every day.

● What if you don't send it? Report to the local labor security supervision department.

The high temperature allowance is paid according to the actual attendance days of employees, and it is paid in June, July, August and September every year. Workers who meet the scope and conditions of payment but do not receive the high temperature allowance may report the situation to the local labor security supervision department and safeguard their legitimate rights and interests. Workers who suffer from heatstroke due to high-temperature operation or high-temperature weather operation and are diagnosed as occupational diseases are entitled to work-related injury insurance benefits.
