Regulations of Anhui Province on Meteorological Disaster Prevention

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Meteorological Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province, in order to prevent and mitigate meteorological disasters, safeguard the safety of life and property of the state and people, and promote economic and social development. Article 2 These Regulations shall apply to meteorological disaster monitoring, forecasting, defense and disaster reduction within the administrative area of this province. Article 3 The prevention of meteorological disasters shall adhere to the principles of giving priority to prevention, seeking advantages and avoiding disadvantages, overall planning and coordination, and taking responsibility at different levels. Article 4 The people's governments at or above the county level shall strengthen their leadership over the prevention of meteorological disasters, incorporate the prevention of meteorological disasters into the national economic and social development plan, and arrange the necessary meteorological capital construction and career funds. Article 5 The competent meteorological departments at all levels (hereinafter referred to as the competent meteorological departments) shall be responsible for the management and supervision of disastrous weather monitoring, forecasting, early warning, meteorological disaster emergency services, weather modification operations and lightning disaster prevention within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall, in accordance with the division of responsibilities, do a good job in meteorological disaster prevention. Article 6 The people's governments at or above the county level shall encourage and support the scientific and technological research on meteorological disaster prevention and the popularization of advanced technologies, and incorporate the scientific and technological research on meteorological disaster prevention into the scientific and technological development plan.

The competent meteorological departments shall strengthen the research and application of meteorological disaster prevention technology, improve the accuracy and timeliness of severe weather forecasting and early warning, and improve the level of meteorological disaster prevention services. Article 7 The competent meteorological department shall, jointly with relevant departments, publicize laws and regulations on meteorological disaster prevention and knowledge of disaster prevention and mitigation, enhance the awareness of social defense against meteorological disasters, and improve the public's ability of self-help and mutual assistance. Chapter II Planning and Implementation Article 8 People's governments at or above the county level shall organize competent meteorological departments and relevant departments to formulate meteorological disaster prevention plans within their respective administrative areas.

The competent meteorological department shall, jointly with relevant departments, carry out a general survey of meteorological disasters and establish a database of meteorological disaster risks. Article 9 The compilation of overall land use planning, urban planning, regional and river basin construction, development and utilization planning, and professional planning of agriculture, forestry, energy, water conservancy, transportation and tourism shall meet the requirements of meteorological disaster prevention. Article 10 The competent meteorological department shall organize climate feasibility demonstration for urban planning, major infrastructure construction, major regional economic development projects and large-scale solar energy, wind energy and other climate resources development and utilization projects, and conduct meteorological disaster risk assessment.

The scope of the climate feasibility demonstration project is determined by the provincial development and reform department in conjunction with the provincial meteorological authorities. Eleventh competent meteorological departments shall establish an urban meteorological disaster monitoring and early warning system to realize dynamic monitoring of meteorological disasters and timely release urban meteorological disaster information. Twelfth competent meteorological departments shall, in conjunction with agriculture, water conservancy and other departments, establish an agricultural meteorological disaster early warning and evaluation system and a food safety meteorological early warning system. Article 13 The competent meteorological department shall, jointly with the departments of transportation, public security, land resources and forestry, establish a professional meteorological monitoring network and a meteorological disaster early warning system to provide real-time meteorological services for road traffic safety, water traffic and water operation safety, geological disaster prevention, forest fire prevention and forest pest control. Article 14 The competent meteorological department shall, jointly with the health and environmental protection departments, establish a meteorological early warning system for the impact of meteorological changes on diseases, epidemic situations and environmental quality, and provide meteorological real-time services for emergency treatment such as public health emergencies and environmental incidents. Fifteenth relevant departments of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the prevention of secondary and derivative disasters caused by meteorological factors such as geological disasters, floods, forest fires, pests and diseases, environmental pollution and epidemic diseases. Chapter III Construction and Protection Article 16 The people's governments at or above the county level shall organize the construction of meteorological disaster monitoring networks within their respective administrative areas in accordance with the principles of rational distribution and effective utilization. The meteorological disaster monitoring network consists of meteorological stations belonging to the competent meteorological departments and monitoring stations belonging to relevant departments and units such as agriculture, water conservancy, forestry, transportation, environmental protection, land resources and civil aviation.

The competent meteorological departments shall exercise unified guidance and supervision over the meteorological monitoring business of the monitoring network. Seventeenth people's governments at or above the county level shall organize the competent meteorological departments and relevant departments to strengthen the construction of meteorological early warning infrastructure and smooth the channels for the release and dissemination of early warning information.

Newly built airports, railways, expressway, large-scale water conservancy projects, large bridges and ports equipped with large-scale port machinery shall, according to the needs of meteorological disaster prevention, incorporate meteorological disaster monitoring and early warning facilities into construction projects and make unified planning and construction; Those that have been put into use shall be equipped with meteorological disaster monitoring and early warning facilities according to the needs of meteorological disaster prevention. Eighteenth people's governments at or above the county level shall, in accordance with national standards, delimit the scope of environmental protection for meteorological observation and incorporate it into urban planning or village and market town planning.

Development and reform, planning, construction, land and resources, radio management and other related departments. When examining and approving construction projects that may affect the detection environment and facilities of existing meteorological stations, the consent of the competent meteorological department with the right to examine and approve shall be obtained in advance. Nineteenth meteorological disaster monitoring and early warning facilities shall be protected according to law, and no unit or individual may occupy, damage or move without authorization.

When meteorological disaster monitoring and early warning facilities are damaged due to force majeure, the local people's government shall take emergency measures to organize the repair.
