Regulations of Jiangsu Province on Meteorological Disaster Prevention (202 1 Revision)
Meteorological disaster prevention as mentioned in these Regulations refers to the monitoring, forecasting and disaster prevention and mitigation activities of meteorological disasters. Article 4 The competent meteorological departments at or above the county level (hereinafter referred to as the competent meteorological departments), under the leadership of the competent meteorological departments at higher levels and the people's governments at the corresponding levels, are responsible for the management and supervision of disastrous weather and climate monitoring, forecasting and early warning, weather modification operations and lightning disaster prevention within their respective administrative areas.
The relevant departments of the local people's governments at or above the county level, such as agriculture and rural areas, water conservancy, housing and urban and rural construction, transportation, emergency, public security, civil affairs, health, radio and television, ecological environment, natural resources, maritime affairs, etc., shall, in accordance with the division of responsibilities, do a good job in meteorological disaster prevention. Article 5 The local people's governments at or above the county level shall strengthen their leadership in meteorological disaster prevention, incorporate meteorological disaster prevention into the national economic and social development plan of the region, incorporate the funds needed for local meteorological infrastructure investment and local meteorological undertakings into the local fiscal budget at the corresponding level, increase investment in meteorological undertakings, and increase capital investment according to the needs of meteorological disaster prevention and mitigation and relevant regulations. Article 6 Local people's governments at or above the county level shall organize competent meteorological departments and relevant departments to strengthen the publicity of laws, regulations and knowledge on meteorological disaster prevention and mitigation, enhance the public's awareness of meteorological disaster prevention, and improve their ability of disaster prevention and mitigation. Chapter II Defense Planning and Organization and Implementation Article 7 Local people's governments at or above the county level shall, according to the characteristics of local meteorological disasters, organize development and reform departments, competent meteorological departments and other relevant departments to formulate local meteorological disaster prevention plans and meteorological disaster emergency plans.
Meteorological disaster prevention planning mainly includes the following contents:
(a) the status quo and development trend of meteorological disasters;
(two) the objectives and tasks of meteorological disaster prevention;
(three) meteorological disaster prevention standards, key time periods and key defense areas;
(4) Responsibilities of meteorological disaster prevention institutions and departments;
(five) meteorological disaster prevention system and related infrastructure construction.
The emergency plan for meteorological disasters mainly includes the nature and grade of meteorological disasters, emergency organization and command and emergency linkage system, responsibilities of relevant departments, monitoring and early warning mechanism, emergency start-up and response procedures, emergency support and post-disposal, supervision and management, and accountability. Eighth competent meteorological departments and relevant departments shall, according to the meteorological disaster prevention plan and emergency plan of the people's government at the same level, formulate departmental meteorological disaster emergency plans and report them to the people's government at the same level for the record.
Units vulnerable to meteorological disasters shall formulate corresponding emergency plans for meteorological disasters according to their actual conditions. Ninth local people's governments at or above the county level and their departments shall, according to the specific circumstances of meteorological disasters, start or terminate the emergency plan for meteorological disasters and announce it to the public in a timely manner. Tenth competent meteorological departments shall organize the climate feasibility demonstration of urban planning, major engineering construction and major regional economic development projects according to law, and carry out meteorological disaster risk assessment.
The scope and procedures of climate feasibility demonstration shall be formulated by the provincial development and reform department in conjunction with the provincial meteorological authorities. Eleventh competent meteorological departments shall, jointly with the departments and units of transportation, public security, natural resources, agriculture and rural areas, and maritime affairs. Establish and improve professional meteorological monitoring networks and disaster early warning systems to provide meteorological support and real-time services for road traffic safety, water traffic and operation safety, geological disaster prevention, fishery production safety, marine resources development and emergency rescue.
The relevant departments shall set up warning signs in areas prone to meteorological disasters. Twelfth competent meteorological departments shall, in conjunction with agriculture, rural areas, water conservancy and other departments, establish an early warning and evaluation system for agricultural meteorological disasters, improve the safety meteorological early warning system for major crops such as grain, and reduce the losses caused by meteorological disasters to agricultural production. Article 13 The competent meteorological departments shall establish cooperation mechanisms with health, ecological environment and other departments, improve the meteorological early warning system for the impact of meteorological environment changes on diseases, epidemic situations and environmental quality, and provide meteorological support services for public health emergencies, environmental incidents and other emergency treatments. Article 14 The competent meteorological department shall, jointly with the departments and units of development and reform, industry and informatization, housing and urban construction, ecological environment, transportation, water conservancy, civil aviation, communication management, etc., establish a coordination mechanism for lightning protection management of construction projects, and urge the lightning protection design, construction, supervision, testing and owner units to implement the main responsibilities. Article 15 The competent meteorological department shall, jointly with the relevant departments of the people's government at the corresponding level, timely assess the serious and extraordinarily serious meteorological disasters within their respective administrative areas, and submit them to the people's government at the corresponding level and the competent meteorological department at a higher level to provide decision-making basis for organizing disaster reduction and relief.
The nature and grade of meteorological disasters shall be determined and published by the competent meteorological departments, and no other unit or individual may determine and publish them.
