Interim Measures of Wuxi Municipality on the Administration of National Flag

Article 1 These Measures are formulated in accordance with the relevant provisions of the Constitution and the National Flag Law, combined with the actual situation of this Municipality, in order to safeguard the dignity of the national flag, enhance citizens' concept of the country and promote the spirit of patriotism. Article 2 National Flag of the People's Republic of China is the symbol and symbol of People's Republic of China (PRC).

Every citizen and organization should respect and care for the national flag. Article 3 The people's governments of cities, cities (counties), districts and townships (towns) shall supervise and manage the display and use of the national flag within their respective administrative areas. The Legislative Affairs Bureau of the Municipal People's Government is responsible for the organization, implementation and daily supervision and management of the National Flag Law. Article 4 The national flag shall be hoisted daily in the following places in this Municipality:

City, city (county) airports, main stations and ports. Article 5 The Standing Committees of local people's congresses, people's governments, people's courts, people's procuratorates and local committees of China People's Political Consultative Conference shall display the national flag on working days.

Full-time schools raise the national flag every day except winter vacation, summer vacation and Sunday.

City, city (county), the District People's government important meeting rooms, important venues and the office of the principal responsible person can fly the national flag. Article 6 On National Day, International Labor Day, New Year's Day and Spring Festival, state organs and people's organizations at all levels shall display the national flag; Conditional enterprises, institutions, villagers' committees, new residential villages and communities may display the national flag; The national flag can be displayed in units along the street such as Zhongshan Road and public places such as square parks. Seventh major celebrations, commemorative activities, large-scale cultural and sports activities and large-scale exhibitions, you can fly the national flag. Article 8 The national flag of China and the national flag of foreign countries may be hoisted at the same time in the foundation laying, opening and completion ceremonies and major celebrations of foreign government economic aid projects and large-scale Sino-foreign joint ventures, Sino-foreign cooperative ventures and foreign-funded enterprises (hereinafter referred to as foreign-invested enterprises).

When a foreign-invested enterprise flies its national flag outdoors or in public places, it can only fly the national flag of the country that has diplomatic relations with China, and it must also fly the national flag of China. When necessary, the national flag of a country that has not established diplomatic relations with China may be hoisted, and it shall be reported to the Municipal Foreign Affairs Office for implementation according to relevant regulations. Article 9 The measures for diplomatic activities (foreign affairs activities) and the display and use of the national flag by diplomatic representative offices shall be implemented in accordance with the relevant regulations of the Ministry of Foreign Affairs.

Military organs and barracks shall display the national flag in accordance with the relevant regulations of the Central Military Commission (CMC).

Civil ships and foreign ships entering China's territorial waters shall fly the national flag in accordance with the relevant provisions of the Ministry of Communications.

Ships carrying out frontier defense, public security and fire control tasks by the public security department shall fly the national flag in accordance with the relevant provisions of the Ministry of Public Security. Article 10 The national flag shall be raised in the morning and lowered at night. In case of rain, snow, typhoon and other bad weather, don't hang up. Article 11 State organs and units that fly the national flag on a daily basis shall set up flagpoles for flying the national flag or choose appropriate locations in accordance with regulations. On National Day, International Labor Day, New Year's Day and Spring Festival, organs and units that can fly the national flag should also set up flagpoles to fly the national flag in accordance with regulations or choose suitable places. If there is no flagpole, it should be hung at the door. Article 12 When the national flag is hoisted, a flag-raising ceremony may be held.

When holding a flag-raising ceremony, during the process of raising the national flag, participants should respect the national flag and can play or sing the national anthem.

Full-time primary and secondary schools hold a flag-raising ceremony once a week except holidays. Article 13 When the national flag is hoisted, it shall be placed in a prominent position.

When carrying the national flag and other flags, the national flag should precede the other flags. When the national flag and other flags are hoisted at the same time, the national flag should be placed in the center, higher or prominent position. Article 14 When the national flag is hoisted or lowered on the erected flagpole, it should be hoisted or lowered slowly. When raised, the national flag must be raised to the top of the pole; When lowered, the national flag must not land.

In case of a major funeral, the national flag will be lowered at half mast. When the flag is lowered at half mast, the national flag should be raised to the top of the pole first, and then the distance from the top of the flag to the top of the pole is one third of the total length of the flagpole; When descending, the national flag should be raised to the top of the pole before descending. Fifteenth more than two organs and units in a building or a courtyard, can hang a national flag.

Organs and units at all levels shall determine specialized agencies and personnel to be responsible for the hoisting and daily management of the national flag. Article 16 No damaged, defaced, faded or substandard national flag may be hoisted. Seventeenth national flag and national flag design shall not be used as trademarks or advertisements for industrial and commercial products; May not be used for badges, commemorative badges and badges of institutions, schools and organizations; May not be used for private funeral activities. If there is any special purpose, it must be reported to the State Council for approval. Article 18 When making and selling the national flag, the relevant regulations must be strictly implemented, and illegal making and selling of the national flag is prohibited. Nineteenth in violation of the provisions of Article sixteenth and Article seventeenth of these measures, the legal department of the municipal government shall order it to make corrections within a time limit, and give it to informed criticism, give it a warning or impose a fine of less than 50 yuan, and if the circumstances are serious, impose a fine of 1000 yuan. In violation of the provisions of article eighteenth, according to the seriousness of the case, respectively, impose a fine of more than 50000 yuan in 50 yuan. Article 20 Whoever intentionally insults the people and the national flag of China by burning, damaging, scribbling, defileing or trampling in public places shall be investigated for criminal responsibility according to law; If the circumstances are relatively minor, the public security organ shall impose an administrative detention of less than 15 days with reference to the punishment provisions of the Regulations of the People's Republic of China on Administrative Penalties for Public Security.
