Measures for the Administration of Weather Modification in Gansu Province (revised in 2020)

Chapter I General Provisions Article 1 In order to rationally develop and utilize cloud and water resources in the air, effectively prevent and mitigate meteorological disasters, and standardize and strengthen the management of weather modification, these measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Management of Weather Modification, the Meteorological Regulations of Gansu Province and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to weather modification and its management activities within the administrative area of this province. Third people's governments at or above the county level shall incorporate the development of weather modification into the national economic and social development plan, and the funds needed for weather modification shall be included in the fiscal budget at the same level.

The people's governments at or above the county level shall strengthen their leadership over weather modification work within their respective administrative areas, establish and improve the command and coordination mechanism for weather modification work, set up weather modification work institutions or equip relevant personnel, and strengthen the construction of weather modification work units and the infrastructure construction of workplaces. Article 4 The competent meteorological departments at or above the county level, under the leadership of the people's governments at the corresponding levels, shall be responsible for the management, guidance and implementation of weather modification activities within their respective administrative areas.

Development and reform, finance, public security, agriculture and rural areas, forestry, water conservancy, natural resources, emergency management, ecological environment, civil aviation, communications and other relevant departments shall, according to their respective responsibilities, do a good job in weather modification. Article 5 People's governments at or above the county level shall encourage scientific and technological research on weather modification and the popularization and application of advanced technologies. The competent meteorological departments shall organize and carry out weather modification research in disaster prevention and mitigation, response to climate change, protection of ecological environment, protection of production safety of agriculture and animal husbandry, and development and utilization of cloud and water resources. Article 6 The people's governments at or above the county level shall commend and reward the units and individuals that have made remarkable achievements in weather modification. Chapter II Organization and Implementation Article 7 The competent meteorological departments at or above the county level shall, jointly with the relevant departments of development and reform, agriculture and rural areas, forestry and ecological environment at the same level, formulate the development plan and work plan of weather modification in their respective administrative areas, which shall be implemented after being approved by the people's government at the same level. Eighth competent meteorological departments at or above the county level shall, under the organization of the people's government at the same level, formulate emergency plans for weather modification emergencies in conjunction with relevant departments and units.

When a safety accident occurs in weather modification, the local people's government shall promptly organize rescue and disposal, and report to the people's government at the next higher level and the competent meteorological department. Article 9 The weather modification operation site shall be put forward by the people's government of the city (prefecture) according to the local climate characteristics, geographical conditions, traffic, communication, population density and other conditions and the opinions of the people's government of the county (city, district), and the layout plan shall be submitted to the competent meteorological department of the province in conjunction with the flight control department.

The identified weather modification operation site shall not be changed without authorization, and if it is really necessary to change it, it shall be re-determined in accordance with the provisions of the preceding paragraph.

The township (town) people's government and village (neighborhood) committees where the weather modification operation site is located have the responsibility to protect the weather modification operation facilities. Tenth units engaged in weather modification operations shall meet the conditions stipulated by the provincial meteorological authorities. Eleventh weather modification operation units shall, in accordance with the training standards for weather modification operators formulated by the competent meteorological department of the State Council, conduct pre-job training for personnel engaged in weather modification operations.

The weather modification operators shall master the relevant operation specifications and operating procedures before implementing weather modification operations. Article 12 The list of persons who use anti-aircraft guns and rockets to carry out weather modification shall be copied by the local competent meteorological department to the local public security organ for the record. Thirteenth the implementation of weather modification operations shall meet the following conditions before the implementation of operations:

(1) Suitable weather conditions and operation opportunities;

(2) the approval of the flight control department;

(3) The command system is sound and the communication system is smooth;

(4) Operators are in place;

(five) the operation device meets the national mandatory safety technical standards.

The implementation of weather modification operations should avoid densely populated areas and strictly implement operational norms and operating procedures. Article 14 After meteorological conditions suitable for weather modification operations are formed, the competent meteorological departments of the people's governments at or above the county level shall decide to implement corresponding weather modification operations according to needs.

Where anti-aircraft guns, rockets and other launching devices are used to carry out weather modification operations, the competent meteorological department at the place where the operation is located shall apply to the flight control department for airspace and operation time limit; Where an aircraft is used to carry out weather modification operations, it shall apply to the flight control department for operating airspace and operating time limit.

The implementation of weather modification operations shall be carried out within the operation airspace and operation time limit approved by the flight control department, and the airspace operation records shall be kept. Fifteenth the competent meteorological departments in the workplace shall, according to the specific circumstances of weather modification operations, announce the location and time of operations in advance. Sixteenth weather modification work units in the event of a safety accident, it shall immediately report to the local people's government, the competent meteorological department and the emergency management department.

Local people's governments, competent meteorological departments and emergency management departments shall start corresponding emergency plans in accordance with relevant regulations.
