Regulations of Shandong Province on Meteorological Disaster Prevention (revised in 2022)

Article 1 In order to prevent meteorological disasters, safeguard the safety of people's lives and property, and promote economic and social development, these Regulations are formulated in accordance with the Meteorological Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 Meteorological disasters mentioned in these Regulations include weather and climate disasters and meteorological secondary and derivative disasters.

Weather and climate disasters refer to typhoon (tropical storm, strong tropical storm), rainstorm (snow), thunderstorm, hail, strong wind, sandstorm, tornado, fog, high temperature, low temperature, continuous rain, freezing rain, frost, ice accumulation, cold wave, drought, dry hot wind, heat wave and flood.

Meteorological secondary and derivative disasters refer to landslides, mudslides, storm surges, forest fires and other disasters caused by meteorological factors. Article 3 Those who engage in meteorological disaster prevention activities within the administrative region of this province and the sea areas under its jurisdiction shall abide by these regulations; Where laws and regulations provide otherwise, such provisions shall prevail. Article 4 The prevention of meteorological disasters shall follow the principles of giving priority to prevention, combining prevention with control, overall planning and graded responsibility. Article 5 The people's governments at or above the county level shall strengthen their leadership in the prevention of meteorological disasters, organize the publicity and popularization of laws, regulations and scientific and technical knowledge on meteorological disaster prevention, support scientific research on meteorological disaster prevention, incorporate meteorological disaster prevention into the national economic and social development plan, and include the required funds into the fiscal budget at the corresponding level. Sixth competent meteorological departments at or above the county level shall be responsible for the monitoring, forecasting and early warning of meteorological disasters, organize weather modification operations, and do a good job in lightning disaster prevention according to the division of responsibilities.

Emergency management, agriculture and rural areas, water conservancy, ecological environment, natural resources, housing and urban construction, civil affairs, transportation, communications, culture and tourism, marine and other relevant departments shall do a good job in meteorological disaster prevention in accordance with the division of responsibilities. Seventh people's governments at or above the county level shall organize the competent meteorological departments and other relevant departments to prepare meteorological disaster prevention plans.

Meteorological disaster prevention planning shall include the following main contents:

(1) Forecasting and evaluating the present situation and development trend of meteorological disasters;

(two) the guiding ideology, principles and objectives of meteorological disaster prevention;

(three) the prone period of meteorological disasters and key defense areas;

(four) the main tasks and safeguard measures of meteorological disaster prevention;

(five) the construction and management of meteorological disaster prevention facilities. Article 8 The people's governments at or above the county level shall, according to the meteorological disaster prevention plan, organize the preparation of meteorological disaster prevention plans and emergency plans, and decide to issue and start implementation according to the meteorological disaster forecasts, warnings and suggestions provided by the competent meteorological departments; All relevant departments should do a good job in emergency response according to the division of responsibilities.

The start and termination of the meteorological disaster emergency plan shall be announced to the public in a timely manner and reported to the people's government at the next higher level in a timely manner. Article 9 People's governments at or above the county level and relevant departments shall publicize and popularize meteorological disaster prevention knowledge to the society, organize meteorological disaster emergency drills, carry out inspection of meteorological disaster prevention measures, and improve the public's ability to avoid risks, avoid disasters, and save themselves and each other.

The production and business operation entity shall incorporate meteorological safety guarantee into the safety production work of the entity, improve the defensive measures, and eliminate the hidden dangers of meteorological disasters in time.

Encourage volunteers to participate in meteorological disaster prevention knowledge propaganda and emergency rescue according to law. Article 10 Plans for the construction, development and utilization of regions, river basins and sea areas, as well as plans for agriculture, forestry, fisheries, transportation, water conservancy, tourism and natural resources development, shall meet the requirements of meteorological disaster prevention, and meteorological disaster risk assessment may be conducted in the process of compilation.

Large and medium-sized engineering construction projects shall carry out meteorological disaster risk assessment in the feasibility study stage. Article 11 People's governments at or above the county level shall strengthen the infrastructure construction of meteorological disaster monitoring, early warning, investigation, evaluation and emergency service system, build mobile meteorological stations according to the needs of meteorological disaster prevention work in the local area, and set up facilities for broadcasting meteorological disaster early warning signals in prominent positions in cities and towns. Airports, ports, railway stations, expressway, water conservancy projects, tourist attractions, transportation hubs and key projects can build facilities for broadcasting meteorological disaster warning signals according to needs.

No organization or individual may occupy, damage or move the meteorological disaster prevention facilities specified in the preceding paragraph without authorization. Twelfth people's governments at or above the county level shall establish a joint monitoring mechanism for meteorological disasters, organize and carry out joint monitoring across regions and departments, and the specific work shall be implemented by the competent meteorological departments.

Members of the joint monitoring shall include the following units:

(1) Meteorological offices and stations subordinate to the competent meteorological departments at all levels;

(2) Meteorological offices and stations belonging to other relevant departments;

(3) Hydrology, hydrology and forest fire prevention observation (monitoring) stations;

(4) Other relevant units. Thirteenth competent meteorological departments shall establish a meteorological disaster information sharing platform.

The member units of meteorological disaster joint monitoring shall provide meteorological and hydrological information, drought, disaster situation and other information to the meteorological disaster information sharing platform in time to realize the sharing of meteorological disaster information resources; Those involving state secrets shall abide by the relevant state secrecy provisions.
