Regulations of Hainan Province on Meteorological Disaster Prevention

Chapter I General Provisions Article 1 In order to strengthen the prevention of meteorological disasters, avoid and reduce losses caused by meteorological disasters, ensure the safety of people's lives and property, and promote economic and social development, these Regulations are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Prevention of Meteorological Disasters of the State Council and other laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to meteorological disaster prevention activities within the administrative area of this province.

Meteorological disasters mentioned in these Regulations refer to disasters caused by typhoons, rainstorms, droughts, thunder and lightning, strong winds, low temperatures, high temperatures, fog, hail, haze and tornadoes. Article 3 The prevention of meteorological disasters shall follow the principles of people-oriented, scientific defense, government-led, departmental linkage and social participation. Article 4 People's governments at or above the county level shall strengthen their leadership in meteorological disaster prevention, establish and improve the coordination mechanism for meteorological disaster prevention and the responsibility system for disaster prevention and mitigation, improve the infrastructure construction for meteorological disaster prevention, incorporate meteorological disaster prevention into the national economic and social development plan of the region, and include the required funds in the fiscal budget at the corresponding level. Article 5 The competent meteorological departments at or above the county level shall be responsible for monitoring, forecasting and early warning of disastrous weather, climate feasibility demonstration, weather modification and lightning protection within their respective administrative areas, and organize meteorological stations to carry out climate change analysis and climate impact assessment; Assist relevant departments in monitoring, forecasting, early warning and disaster reduction of meteorological derivative and secondary disasters.

The relevant departments of the people's governments at or above the county level shall, in accordance with the division of responsibilities, do a good job in the prevention of meteorological disasters and their derivatives and secondary disasters in this province. Article 6 Township people's governments and sub-district offices shall be equipped with meteorological disaster prevention assistants, and village (neighborhood) committees shall be equipped with information officers.

Assistants and information officers are specifically responsible for the management of meteorological disaster prevention facilities, meteorological disaster collection, meteorological disaster early warning information release, emergency contact, disaster report, meteorological science popularization and meteorological services for agriculture. Article 7 People's governments at or above the county level shall organize competent meteorological departments and relevant departments to publicize meteorological disaster prevention laws and regulations to the society, popularize meteorological disaster prevention knowledge, enhance the public's awareness of meteorological disaster prevention, and organize emergency drills according to the characteristics of local meteorological disasters, so as to improve the public's emergency ability to avoid risks, avoid disasters, and save themselves and each other.

Village (neighborhood) committees, enterprises and institutions shall assist the local people's governments to publicize the knowledge of meteorological disaster prevention, carry out emergency drills for meteorological disasters, and provide relevant information on meteorological disaster prevention to the local people's governments. Article 8 Where meteorological disaster prevention involves more than two administrative regions, the relevant local people's governments and relevant departments shall establish a joint defense system and strengthen information communication. When necessary, the provincial people's government or its relevant departments shall organize and coordinate. Article 9 The provincial people's government shall rationally allocate meteorological disaster prevention resources, promote the balanced development of meteorological disaster prevention work, and support the investment in the construction and management of infrastructure such as emergency shelters and public lightning protection facilities in old revolutionary base areas, ethnic minority areas and poverty-stricken areas. Chapter II Preventive Measures Article 10 People's governments at or above the county level shall organize competent meteorological departments and relevant departments to carry out general surveys of meteorological disasters, establish meteorological disaster databases, conduct meteorological disaster risk assessment, draw up meteorological disaster risk zoning, delimit meteorological disaster risk areas and make an announcement.

Meteorological disaster risk assessment shall include the following contents:

(1) Historical and current situation analysis of meteorological disasters;

(2) Meteorological disaster risk prediction;

(3) Countermeasures and measures to prevent or mitigate the impact of meteorological disasters;

(4) The conclusion of meteorological disaster risk assessment. Eleventh people's governments at or above the county level shall organize the competent meteorological departments and relevant departments, combined with the characteristics of local meteorological disasters, risk assessment results and economic and social development trends, the preparation of meteorological disaster prevention plans in their respective administrative areas and organize their implementation. Meteorological disaster prevention planning shall be revised in a timely manner according to the changes of meteorological disasters.

Meteorological disaster prevention planning shall include the following contents:

(a) the guiding ideology, principles, objectives and tasks of meteorological disaster prevention;

(2) Forecasting, forecasting and evaluating the present situation and development trend of meteorological disasters;

(3) Meteorological disaster-prone areas and key defense areas;

(4) Meteorological disaster prevention standards;

(five) meteorological disaster prevention projects, measures and implementation plans;

(six) the construction and management of meteorological disaster prevention facilities;

(7) Emergency measures for meteorological disasters;

(eight) other contents stipulated by laws and regulations. Article 12 The requirements of meteorological disaster prevention shall be taken into account in the preparation of overall land use planning, urban and rural planning, regional and river basin development and utilization planning, and special plans for agriculture, forestry, energy, environmental protection, marine fisheries, water conservancy, transportation and tourism. Article 13 The people's governments at or above the county level and relevant departments shall, according to the meteorological disaster prevention plan, combine the characteristics of local meteorological disasters and the possible harm, organize the formulation of meteorological disaster emergency plans in their respective administrative regions and departments, report them to the people's governments at the next higher level and relevant departments for the record, and make them public.

The emergency plan for meteorological disasters shall include the following contents:

(a) meteorological disaster emergency organization and command system and responsibilities;

(2) Meteorological disaster prevention and early warning mechanism;

(3) Initiation and response procedures of meteorological disaster emergency plan;

(4) Emergency treatment and safeguard measures for meteorological disasters;

(5) Post-disaster recovery and reconstruction measures.
