Regulations on Safety Management, Supervision and Inspection of Small Open-pit Quarry (announced by the State Administration of Work Safety Order No. 39 on May 4, 2011, revised according to the State Administration of Work Safety Order No. 78 on May 26, 2015 ) Chapter 1 General Provisions Article 1 In order to prevent and reduce production safety accidents in small open-pit quarries and ensure the safety and health of employees, in accordance with the "Production Safety Law", "Mining Safety Law", "Safety Production License Regulations", etc. Relevant laws and administrative regulations shall formulate these regulations. Article 2 These regulations shall apply to the safety production and supervision and management of hillside-type open-pit quarrying units with an annual production scale of no more than 500,000 tons (hereinafter collectively referred to as small open-pit quarries). This provision does not apply to the safety production and supervision and management of small-scale open-pit mines that mine profiles and metal mineral resources. Article 3 The safety production supervision and management departments of the local people's governments at or above the county level shall supervise and manage the safety production of small open-pit quarries. Townships (towns) with small open-pit quarries within their jurisdiction should clearly define the managers responsible for production safety and their responsibilities. Chapter 2 Safe Production Guarantee Article 4 The main person in charge of a small open-pit quarry shall be responsible for the safety production of the unit and shall organize the formulation and implementation of the safety production responsibility system, improve labor conditions and operating environment, and ensure the effectiveness of safety production investments. implementation. The main person in charge of a small open-pit quarry shall pass the assessment of the work safety supervision and management department and obtain a safety qualification certificate. Article 5 Small open-pit quarries shall establish and improve safety production management systems and job safety operating procedures, and be equipped with at least one full-time safety production management personnel. Production safety management personnel shall pass the assessment of the production safety supervision and management department in accordance with relevant national regulations and obtain a safety qualification certificate. Article 6 A small open-pit quarry shall be equipped with at least one professional technician, or hire professional technicians, registered safety engineers, or entrust relevant technical service agencies to provide safety production management services. Article 7 New workers in small open-pit quarries shall receive no less than 40 hours of safety training, and existing workers shall receive no less than 20 hours of safety retraining every year. Special operations personnel must undergo specialized safety technical training and pass the assessment in accordance with relevant national regulations, and obtain a special operation certificate before they can start working. Article 8 Small open-pit quarries must participate in work-related injury insurance and withdraw and use production safety expenses in accordance with relevant national regulations. Article 9 For new construction, reconstruction or expansion of small open-pit quarries, the mining design or mining plan shall be prepared by a design unit with qualifications recognized by the construction authority. When there are major changes in the quarry layout and mining methods, the mining design or mining plan must be re-prepared and reviewed and approved by the original review department. Article 10 Safety facilities for new construction, reconstruction, and expansion projects in small open-pit quarries shall undergo design review procedures in accordance with regulations. Article 11 Small open-pit quarries shall obtain a safety production license for non-coal mining enterprises in accordance with the law. Those who have not obtained a production safety license are not allowed to engage in production activities. If the mining license expires during the validity period of the safety production license, the small open-pit quarry shall report to the original safety production license issuing and management authority within 15 days before the expiration of the mining license and return the original and duplicate of the safety production license. . Article 12 The minimum distance between adjacent quarry mining areas should be greater than 300 meters. For situations that may endanger the other party's production safety, both parties should sign a production safety management agreement, clarify their respective production safety management responsibilities and safety measures to be taken, and designate specialized personnel to conduct safety inspection and coordination. Article 13 Small open-pit quarries shall use medium-deep hole blasting, and it is strictly prohibited to use expansion blasting, bottom caving, excavation mining and non-layered "one wall" mining methods. If the conditions for medium-to-deep hole blasting are not met, the local production safety supervision and management department will hire relevant experts to conduct demonstrations. If the demonstration meets the requirements, shallow hole blasting can be used for mining. The review methods for medium and deep hole blasting conditions in small open-pit quarries shall be formulated by the provincial-level work safety supervision and management department. Article 14 If an excavator is directly used for mining operations without blasting, the height of the steps shall not exceed the maximum digging height of the excavator. Article 15 Small open-pit quarries shall adopt step mining. If stepped mining cannot be used, mining should be carried out in layered and sequential steps from top to bottom. The layer height of layered mining, the maximum mining height (the vertical distance from the slope top line of the first layer to the slope bottom line of the last layer) and the final slope angle are determined by the design. When implementing shallow hole blasting operations, the layering The number of layers shall not exceed 6, and the maximum mining height shall not exceed 30 meters; when implementing medium-deep hole blasting operations, the layer height shall not exceed 20 meters, the number of layers shall not exceed 3, and the maximum mining height shall not exceed 60 meters. The width of the rock drilling platform for layered mining is determined by the design, and the minimum rock drilling platform width shall not be less than 4 meters. The width of the bottom loading platform for layered mining is determined by the design and should meet the minimum platform width requirements for shunting operations. Article 16 Small open-pit quarries shall comply with national safety regulations on civil explosives and blasting operations, blasting shall be carried out by blasting operators with corresponding qualifications, blasting warning ranges shall be set, and a timed blasting system shall be implemented. Do not avoid blasting within the blasting warning range. Blasting operations are prohibited under severe weather conditions such as thunderstorms, heavy fog, and strong winds.
Non-electric detonation systems should be used in areas with high lightning incidence. Article 17 The large pieces of ore rock produced after blasting shall be crushed mechanically, and blasting shall not be used for secondary crushing. Article 18 Professional service units contracting for blasting operations shall obtain a blasting operation unit license, and excavation construction units contracting for mining and stripping operations shall obtain a non-coal mining enterprise safety production license. Article 19 If the upper part of the quarry needs to be stripped, the stripping working face shall be more than 4 meters ahead of the mining working face. Article 20 In small open-pit quarries, safety inspections of slope surfaces should be carried out before and during operations and after each blasting. When cracks are found on the working surface, or there are pumice stones, dangerous stones and umbrella eaves on the slope that may collapse, the operation should be stopped immediately and personnel should be evacuated to a safe location, where safety measures should be taken and hidden dangers eliminated. Safety warning signs should be set up on the entrance road to the quarry and related hazard points, and no one is allowed to rest or stay at the bottom of the slope. Article 21 When carrying out danger removal operations on slopes, operators should wear safety belts and are not allowed to stand on dangerous rocks or pumice or work in the air. It is strictly prohibited to work on double or multiple floors at the same time on the same slope. Gravel processing operations are not allowed within 50 meters from the bottom line of the working step slope. Article 22 Small open-pit quarries should use mechanical shoveling operations, and manual loading of ore is strictly prohibited. When two shovel-loading machines are operating on the same working surface, the minimum distance should be greater than twice the maximum rotation radius of the shovel-loading machines. Dump trucks are strictly prohibited from carrying flammable and explosive items; overloaded transportation is strictly prohibited; and people are strictly prohibited from standing outside the cab or inside the truck during loading and transportation operations. Article 23 Waste rock and waste debris shall be discharged to the waste rock pit. The setting up of the waste rock pit shall comply with the design requirements and relevant safety regulations. If waste rocks and debris are discharged along mountains or ditches, specific measures should be taken to prevent debris flows. Article 24 Electrical equipment should have grounding, overcurrent, and leakage protection devices. The substation should have an independent lightning protection system and measures to prevent fire, moisture and small animals from entering live parts. Article 25 Small open-pit quarries shall formulate complete flood prevention measures. If it affects the safety of water collection above the mining boundary, a water intercepting ditch should be set up. Article 26 A small open-pit quarry shall formulate an emergency rescue plan, establish a part-time rescue team, clarify the responsibilities of rescue personnel, and sign a rescue agreement with the adjacent mine rescue team or other units with rescue conditions. When a production safety accident occurs, rescue should be organized immediately and reported to the local production safety supervision and management department within one hour. Article 27 Small open-pit quarries shall strengthen dust detection and prevention, take effective measures to prevent and control occupational hazards, establish employee health files, provide employees with labor protection supplies and labor protection facilities that comply with national standards or industry standards, and Instruct and supervise its correct use. Article 28 Small open-pit quarries shall survey and map the current plan and section drawings of the quarry mining at the end of each year, and file and manage them. Chapter 3 Supervision and Inspection Article 29 The safety production supervision and management department shall strengthen the supervision and inspection of small open-pit quarries, and handle on-site treatment or impose administrative penalties in accordance with the law for potential accident hazards and safety production violations discovered during the inspection. Article 30 The production safety supervision and management department shall establish and improve the production safety files of small open-pit quarries within its administrative region, and record the results of supervision and inspections, the investigation and punishment of production safety accidents and illegal acts, etc. Article 31 Small open-pit quarries that have not entrusted a design unit with corresponding qualifications to prepare a mining design or mining plan, and that have production and living facilities within 300 meters of the surrounding area, shall not be reviewed and accepted. Article 32 The production safety supervision and management department shall strengthen the supervision and inspection of the conditions for medium and deep hole blasting in small open-pit quarries. Strictly restrict the use of shallow hole blasting in small open-pit quarries. Article 33 The production safety supervision and management department shall urge small open-pit quarries to strengthen the management of mining and construction units contracting operations and clarify the safety production responsibilities of both parties. Article 34 The production safety supervision and management department shall strengthen the management of emergency plans for small open-pit quarries within its own administrative region, and urge the township (town) people's governments to coordinate accident emergency rescue. Chapter 4 Legal Responsibilities Article 35 If the safety production supervision and management department and its staff violate laws, regulations and these regulations and fail to perform their duties of supervision and inspection of safety production in small open-pit quarries in accordance with the law, they shall be given administrative sanctions in accordance with the law. Article 36 Anyone who violates the provisions of Article 6 of these Regulations shall be ordered to make corrections within a time limit and shall be fined not more than 10,000 yuan. Article 37 Anyone who violates the provisions of Paragraph 1 of Article 10 of these Regulations shall be ordered to stop construction or production and business for rectification, and make corrections within a time limit; if corrections are made within the time limit, a fine of not less than RMB 500,000 but not more than RMB 1 million shall be imposed, and the person directly responsible for the violation shall be ordered to make corrections within a time limit. The person in charge and other directly responsible persons shall be fined not less than RMB 20,000 but not more than RMB 50,000; if a crime is constituted, criminal liability shall be pursued in accordance with the relevant provisions of the Criminal Law. Article 38 Anyone who violates the provisions of paragraph 1 of Article 11 of these Regulations shall be ordered to stop production, illegal gains shall be confiscated, and a fine of not less than RMB 100,000 but not more than RMB 500,000 shall be imposed. Article 39 Violation of Article 12, Paragraphs 1 and 2 of Article 13, Article 14, Article 15, Article 16, Article 17, Article 19 and Article 2 of these Provisions Those who violate the provisions of Article 10, Paragraph 1, Article 21, and Article 22 shall be given a warning and shall be fined not less than RMB 10,000 but not more than RMB 30,000.
Article 40 Anyone who violates Articles 23, 24, 25 and 28 of these Regulations shall be given a warning and fined not more than 20,000 yuan. Article 41 The administrative penalties stipulated in these regulations shall be decided by the work safety supervision and management department. If laws and administrative regulations have other provisions on administrative penalties, those provisions shall prevail. Chapter 5 Supplementary Provisions Article 42 The work safety supervision and administration departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation details in accordance with these regulations and submit them to the State Administration of Work Safety for filing. Article 43 These regulations will come into effect on July 1, 2011. The "Interim Regulations on Safety Production in Small Open-pit Quarry" (former State Administration of Work Safety Order No. 19) promulgated by the former State Administration of Work Safety (State Coal Mine Safety Supervision Administration) on December 28, 2004 was abolished at the same time.
