Whoever intentionally harms another person's body shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. 3. If the victim dies, the compensation obligor shall compensate other reasonable expenses such as funeral expenses, living expenses of dependents, death compensation, funeral expenses of the victim's relatives, accommodation expenses, lost time and so on, in addition to the relevant expenses stipulated in Article 1 for rescue treatment.

4. If the victim or a close relative of the deceased suffers mental damage and the obligee requests the people's court for compensation, it shall be determined according to the Interpretation of the Supreme People's Court on Several Issues Concerning Determining the Liability for Compensation for Mental Damage in Civil Tort. But if it constitutes a criminal offence, there is no compensation for mental damage.
